1 WHEREA5, Deparhnent of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two-story, wood frame single family home located on property hereinafter
4 referred to as the "Subject Property" and commonly lrnown as 604 BUSH AVENUE. This
5 property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before July 5, 2009, the
following aze the now known interested or responsible parties far the Subject Property: Bee
Vue, 21301 Purman Street NE, Wyoming, MN 55092; Bee Vue, 825 University Ave W, Unit 2,
St Paul, MN 55104; University National Bank, 200 University Ave W, St Paul, MN 55103;
Anastasi & Associates, PA, 14985 60 Street N, Stillwater, MN 55082; Old Treasure Real
Estate Dev, 1200 Forest Street, St Paul, MN 55106; Payne Phalen District 5 Planning
Commission.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated October 1, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by November 16, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subj ect Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 8, 2009 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendarion to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The demolition of the shucture to be completed within thirty (30) days after the date of the
Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
January 6, 2010 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefare
SE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 604 BUSH AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by deinolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within thirly (30) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Department oF
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subj ect Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.

The VacantlNuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

On September 22, 2009, a Building Deficiency Inspection Report was compiled and the
followzng condifions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.

removed, members that are over-spanned, not being carried properly, door and window
openings that are not adequately supported, etc.) are to be reconstructed in an approved
manner
• Provide smoke detectors per the MN Building Code and carbon monoxide detectors per
State Law.
• Provide general clean-up of premise
• Provide weather sealed, air sealed and vermin sealed exterior
• Repair siding, soffit, fascia, trim, etc. as necessary
• Maintain 6 inches minimum clearance between wood and soil, sloped to drain away
from foundation of dwelling.
• Provide proper drainage around house to direct water away from foundation of house.
• Install downspouts and a complete gutter system.
• Install rain leaders to direct drainage away from foundation.
• Replace siding.
• Re-frame basement stairs rise and run need to be uniform.
• Replace damaged porch shingles.

ZONING
1. This property was inspected as a Single Family Dwelling.

Most of the roof covering could not be inspected from grade. Recommend this be done
before rehabilitation is attempted.
This is a registered vacant building. In order to sell or reoccupy this building, all
deficiencies listed on this code compliance report must be corrected within six (6)
months of the date of this report. One (1) six-month time extension may be requested
by the owner and will be considered if it can be shown that the code compliance work
is proceeding and is more than fifty (50) percent complete in accordance with
Legislative Code Section 33.03(�.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by November 2, 2009 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the bualding(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taaces as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for

the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Departrnent of Safety
and Tnspections web site (see letterhead) and from the HPC staf£ No permits will be assued

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to a11 interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", sub}ect to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The deparhnent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this arder, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will Yhen
schedule dates for Public Aearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a tnne within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate trris nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

3. Ordering the owner to remove or repair the building(s) at 604 Bush Avenue within fifteen
(15) days from adoption of resolution. (Rescheduled from Nov. 24)
The property owner of record, Federal National Mortgage Assn, did not appear. No other parties of
interest appeared.
Mr. Magner stated the building was a rivo-story, wood &ame, single-family dwelling on a lot of
3,049 square feet and had been vacant since October 15, 2008. A code compliance inspection had
been done on May 22, 2009, the vacant building registration fees had been, and the $5,000
performance bond had not been posted. On September 22, 2009, an inspection of the building was
done and a list of deficiencies which constitute a nuisance condition was developed. An order to
abate a nuisance building was posted on October 1, 2009 with a compliance date of November 16,
2009. To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Taxation estimated the market value of the land to be
approximately $10,100 and the building to be $51,700. Real estate taxes were current. Code
Enforcement estimates the cost to repair the building to be approximately $35,000 to $45,000. The
cost for demolition was estimated to be approximately $8,000 to $10,000. There had also been two
summary abatements issued to this property since 2008, one of which went to work order: remove
snow and ice. Code Enforcement reconunends the building be repaired or removed within 15 days.
Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was a
worker's-style building near the railroad and since there was no record of azi original permit, she
was unsure when it was built. Originally, there were two houses on this one lot with two other
similar-type developments next to each other. This property had not been surveyed, it lacked
integrity, and the neighborhood was not intact; therefore, she did not believe demolition would not
have an adverse effect on the neighborhood.
Mr. Magner stated that the HRA had not purchased this property to date and were requesting 90
days to stall demolition. He said he did not feel comfortable allowing the grant of time as the
nuisance would continue to go unabated. He suggested allowing 30 days for the city to commence
demolition of the property.
Ms. Moermond stated that since there wasn't a representative of the HRA in attendance at the
hearing, she recommended the building be removed within 30 days with no option for repair.
