3 WHEREAS, District Energy St. Paul, Ina filed a notice and an official affidavit on September 21, 2009
4 notifying the Ciry of Saint Paul of a proposed heating rate change; and
6 WHEREAS, the heating rate change became effective October 1, 2009, until approved or denied by the
7 Saint Paul City Council pursuant to Section 6 of the Saint Paul Legislative Code, Appendix F— District
8 Heating Franchise; and

10 WHEREAS, evidence and recommendations have been presented to the City Council in the form of a City
11 staff report submitted to the City Council on February 19, 2010, in conjunction with a public hearing on
12 this matter; and

WHEREAS, the overall heating system customer rates as proposed by District Energy St. Paul, I�ic
represent a 1.9%decrease from fiscal year 2009's rates, and thus formal approval by City Council
Resolution is recommended; and
NOW, THEREFORB BE IT RESOLVED, that the City Council approves the following heating system
customer billing rate decreases as proposed by District Energy 5t Paul, Inc.:
1. The heating demand rate changes from $4.71 to $4.90 per ldlowatt per month effective for
fiscal year 2010
2. The heating energy rate changes from $30.51 to $26.86 per megawatt hour effective for Sscal
year 2010
3. The overall heating single rate changes from $0.06376 to $0.06145 per kilowatt hour effective
far fiscal yeaz 2010.

District Hearing has proposed a rate change for FY 2010. Tf approved the overall single rate will decrease from $0.06376 to $0.06145
per killowatt how effecrive for fiscal yeaz 2010.
According to its franchise agreement with District Energy, St. Paul, the Ciry must review all proposed rate changes from District
Heating.

District Heating's rates will be established for 2010. G�stomers will be able to benefit from the decreased rate for 2010.

None.
Disadvantages If Not Approved:
The proper District Heating rates will not be in place for 2010. Customers will not benefit from the proposed rate decrease.

Attached is a resolution from OFS detailing District Heating's proposed rate change for
FY2010. The resolution is the means through which the Council formally approves of
District Heating's 2010 rates. If approved, District Heating's rates will actually decrease
by 1.9% from 2009's rates. OK to sign.
