WHEREAS, Chapter 293 of the Saint Paul Legistative Code was enacted to regulate the subject of
noise in the City of Saint Paul; and
WHEREAS, §293.11 provides for the granting of variances from the sound level limitarions
contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on the applicant, other persons or on the community; and
WHEREAS, Gabe's Roadhouse, represented by Tim Wozniak, Owner/Manager, who has been
designated as the responsible person on the application, has applied for a variance to present amplified
live music in an enclosed tent on the parking lot at Gabe's Roadhouse, 991 Lexington Parkway N.; and
12 WHEREAS, applicant is seeking a variance far the hours of 7:00 p.m. until 12:00 Midnight

WHEREAS, if applicant is not granted a variance it will not be able to present amplified live music
at Gabe's Roadhouse; and
WHEREAS, the Department of Safety and Inspections has reviewed the application and has made
recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Gabe's
Roadhouse, subject to the following conditions:
1) The variance shall be for the hours of 7:00 p.m. to -lz.?90 �i�E ll:00 p.m. on March 17,
2010 and 7:00 p.m. to 12:00 Midnight on March 19, 20, �-� 2010.
2) All electronically powered equipment used in conjunction with the event shall not exceed 95
dBA, as measured from the interior of the tent opposite the stage.
3) The applicant shall provide personnel and equipment that sha11 provide conrinuous sound level
monitoring between the hours of 7:00 p.m. to ":^������� 11:00 p.m. on March 17, 2010
and 7:00 p.m. to midnight on March 19 & 20, c�2�, 2010 to ensure compliance with Condition
Number 2.
4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be
turned off no later than''' -�;a�;�'�* �� °��w �F}'-� ��.��� a���� 11:00 n.m. on March 17, 2010
and 12:00 midnight on March 19 & 20. 2010.
5) Securitv shall be provided until 230 a.m. on March 17 2010.
