4 AUTHORIZING SUBMITTING THE
5 BROADBAND TECHNOLOGY OPPORTUNITIES PROGRAM GRANT APPLICATION

7 WHEREAS, Congress passed and President Barack Obama signed the American Recovery and
8 Reinvestment Act (AItRA) of 2009 which allocated $4.7 billion to be administered in grants, under the Department
9 of Commerce's National Telecommunications and Information Administration (NTIA), to expand broadband access
10 and adoptian across the counhy; and
11
12 WHEREAS, these funds are intended to support the deployment of broadband infrastructure in unserved and
13 underserved areas, enhance broadband capacity at public computer centers, encourage sustainable adoption of
14 broadband service and to spur job creation and stimulate long-term economic growth and opportunity; and
15
16 WHEREAS, the City of Saint Paul has an ever increasing dependency on technology to provide services,
17 both for internal and external operations, and such services require high bandwidth fiber networks for delivery; and

WHEI2EAS, the City of Saint Paul's institutional network (I-Net) infrastructure is provided to the City
through the franchise agreement with Comcast, and as there is uncertainty of the I-NeYs future due to the eapiration
of Yhis franchise in 2013; and
WHEREAS, the City of Saint Paul and Ramsey County issued an RFP on September 1 l, 2009 seeking to
enter into a Public PrivaYe ParYnership with a proposer representing one or more qualified network service providers
or other qualified proposers to assist in our efforts to obtain funding from the NTIA, or other funding sources, £or the
construction of a next-generation, fiber optic, broadband infrashucture and to provide a turnkey implementation of
this Community Fiber Network (CFN) and associated Community Benefits Agreement for City of Saint Paul,
Ramsey County and other Public Partners to be collectively lmown as the Ramsey Broadband Coalition; and
WHEREAS, Yhe Ciry of Saint Paul and Ramsey County have selected a private pariner for the purposes as
outlined above,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Saint Paul authorizes that,
Mayor Chris Coleman, as Chief Executive Officer of the City of Saint Paul, is hereby authorized and directed to
participate in the submission to the NTIA a request for a Broadband Technology Opportunities Program grant by no
later than March 15, 2010 and be it;
FURTHER RESOLVED, that the Mayor or his designated representative, submit to the NTTA any
assurances, certifications, technical changes or additional information that may be required by said Departrnent; and
be it
FURTHER ItESOLVED, that upon notification of approval that a Broadband Technology Opportunities
Program Grant be awarded by the NTIA to the Ramsey Broadband Coalition, the Council does hereby authorize the
proper Ciry officials to execute the grant agreements and contracts between the NTIA and the Ramsey Broadband
Coalition and the City of Saint Paul; and be it

FINALLY RESOLVED, that the proposed financing from the Broadband Technology Opportunities
Program is utilized in the following manner:
Retain and contract with the private partner, in collaboration with the Ramsey Broadband Coalition, to
design, constmcf and provide project management from conception through testi�g and acceptance of the dual
conduit, Public and Private Community Fiber Network (CFN).

lnitiating Problem, Issues, OppoRunity (Who, What, When, Where, Why):
The City of Saint Paul, in partnership wi[h Ramsey County, and other local government agencies in Ramsey County, (wllectively
known as Ramsey Broadband Coalition - RBC) intend to solicit ARRA grant funds administered by the National
Telecommunicarions and Information Adminis[ration's BTOP program, to fund a dual conduit public/private Community Fiber
Network. The RBC would partner with a private broadband services provider to design, construct and provide project management
oversight of the CF1V with one condui[ reseved for public institutionaUgovemnmetal entities, and the other network for private
services, with a portion reserved for Community Benefits. The CFN would replace the City's reliance on the cm'rent Institutional
Network cunently provided tluough the Comcast franchise agreement.
Advantages If Approved:
The City, along with its partners, will receive an approximate $30 millon in funds to build a dual conduit, public-private network, that
would allow the City [o build a critical city infrashucture to deliver the increased demand for both internal and extemal services.
A portion of the the CF'N private network will provide an opportunity for community benefits azound broadband adoption.

Disadvantages If Not Approved:
Due to changing federal telecom regulation and the pending expiration of the Comcast franchise agreement in 2013 the future
provision of the I-Net as a critical infrastructure is uncertain.
