Summary Abatement Assessments referred back by Council on Feb 3: 30919A1 Property clean ups from August 28 to September 18, 2009; J0917G1 Providing weekly garbage hauling services from September 2 to Segtember 16, 2004; and J0920A1 Properiy clean ups from September 18 to October 2, 2009; and J0918G1 Providing weekly garbage hauling services from September 23 to September 3Q 2009 J0907B1 Emergency boarding and securing and/or boarding of vacant buildings in July 2009 1026 Geranium Avenue East (J0920A) (The property owner missed the hearing on Dea 15; referred back by Council on Feb. 3) Property owners Wang Chong Hang and Xai Hang appeared. Mai Vang provided Hmong translation. Mr. Essling read the Summary Abatement History into the record: Orders to remove tires by the alley were mailed September 13, 2009, with a compliance date of September 18. The property was rechecked on September 23 and was not in compliance. A wark order was sent to Parks and the work was done on September 26, 2004. The assessment amount was $320 plus a$75 fee. He confirmed that the norice was sent to the property owners at 1026 Geranium Avenue. Mr. Hang stated that he had put the tires out while he tried to make arrangements to have them disposed of or recycled. He said a friend offered to take them but the city picked them up in the meantime. He said he hadn't received any notice. Ms. Moermond confirmed with Mr. Essling that the notice had been sent to the correct address. Mr. Hang said he didn't see the letter, and that there were a lot of children in the household and the letter might have been misplaoed. Staff showed the video documenting that the city had picked up the tires. Ms. Moermond recommended approving the assessment. 751 Van Buren Avenue (J0917G), (J0919A), (J0918G) and (J0923A) (The property owner missed the hearing on Dea 1; referred back by Council on Feb. 3) Property owner Jerry Chukwama and tenant Charnea Steele appeared. Mr. Essling stated that there were two sets of orders far the property, one for garbage and one for weekly refuse hauling by a licensed hauler. He read the Sumrnary Abatement Histories into the record: Two sets of orders were mailed August 28, 2009 with a compliance date of September 2. The property was rechecked on September 2 and was not in compiiance. A wark order was sent to Parks. The clean up was done September 14, 2009 and the assessment amount was $316 plus a$75 service charge. Refuse hauling service was performed on September 9 and September 16, 2009. The assessment amount was $150 plus a$75 service charge. Mr. Essling said there was one order February 16, 2010 Legislative Hearing Minutes for refuse service in addation to the two being heazd. 10-235 Page 3 Ms. Moermond asked why the assessment was being appealed. Mr. Chukwama stated that he didn't receive a letter. He said they'd been in the process of getting garbage hauling service and hadn't known that they had to call to have the city container picked up. Ms. Steele stated that the city container was there for two or three weeks but they had never put anything in it. Mr. Chukwama stated that they didn't receive notice for either issue. Ms. Steele stated that she knew they were supposed to clean up the yard but didn't know what was left there or what the city had picked up. Ms. Moermond asked where the notices were sent. Mr. Essling said the clean up summary abatement notice was sent to 7amie Parker and 7erry Chulcwama at 1006 Seminary Avenue and to Occupant, and the licensed hauler notice was sent only to 1006 Seminary Avenue address. Ms. Moermond asked whether there was returned mail. Mr. Essling said there was not. Staff showed the video documenting that the city had done the clean up. Ms. Moermond asked whether garbage haiiling service was being provided at the fime the video was taken. Mr. Chukwama said Veolia was providing service at that time. Ms. Steele said she had paid for service with Coolidge prior to Veolia but Coolidge had not followed through. She said the landlord (Mr. Chukwama) arranged for Veolia after receiving the letter. She reiterated that the city container was never used. Ms. Moermond asked whether there was any record of a call coming in to have the city service cancelled. Mr. Essling said he didn't have that information. Ms. Moermond asked for a clarification of the assessment amounts listed on the worksheets. Mr. Essling clarified the amounts for Yhe current and pending assessments. He said the amount of the service charge for the current refuse hauling assessment should be $25 rather than $75. Ms. Moermond asked whether the service with Coolidge could be confirmed. Mr. Essling said that Mr. Coolidge was hard to get a hold of. Ms. Steele stated that the city had not picked up the trash. Ms. Moermond said the city container had been provided, there was no evidence of licensed service being provided at that time, and the yard was a mess. She said the appellants were being charged only for the clean up, and for drop off and pick up of the city container. Ms. Moermond recommended the following: reducing the assessment for garbage hauling service ta a total of $ l OQ and approving the assessment for the clean ups. 1392 Victoria Street North (J0907B) (The owner missed the December 15 Legislative Hearing. The address was referred back by Council on February 3.) The property owner appeared and Ms. Moermond reviewed his paperwork. Mr. Yannarelly stated Febzuary 16, 2010 Legisiative Aearing Minutes 10-235 Page 4 that the address was not in the assessment rolls Ms. Moermond stated that the address had originally been scheduled for a December 15 hearing and was laid over. Mr. Yannarelly reiterated that it as not in the assessment rules, and looked like it might have been a prelim Vacant $uilding. Ms. Moermond said the assessment was for boarding. Ms. Moermond recommended deleting the assessment.
