1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two-story, wood frame, duplex and its two-stall, wood frame detached garage
4 located on property hereinafrer referred to as the "Subject Property" and commonly known as
5 611 SIMS AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before September 14,
2009, the following are the now known interested or responsible parties for the Subject Property:

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated December 14, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the inferested or responsible parties that they must repair
or demolish the structure located on the Subject Property by January 14, 2010; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Property
declaring this building(s) to consritute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WF�EREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, February 9, 2010 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
demolition of the structure to be completed within fifteen (15) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
March 3, 20]0 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 611 SIMS AVENUE.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to conect the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ardinances. The demolition and removal of the
structure must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above corrective action is not completed within this period of time Departrnent of
Safety and Inspections is hereby authorized to take whatever steps aze necessazy to
demolish and remove this structure, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fiatures of any kind which interfere with the demolition and remova]
shall be removed from the property hy the responsible par[ies by the end of this time
period. If all personal property is not removed, it sha11 be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a two stoty, wood frame, duplex with a detached two car garage on a lot of 4,792
square feet.
According to our files, it has been a vacant building since July 14, 2008.
The current propert}� owner is Paolee Vang, per AMANDA and Ramsey County Property
records.
The city has had to board Yhis building to secure it from trespass.
There have been five (5) SUMMARY ABATEMENT NOTICES since 2008.
There have been four (4) WQRK ORDER(S) issued for:
- Boarding/Securing
- Improperly stored refuse, garbage and misc debris
On November 24, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photogtaphs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on December 14, 2009 with a compliance date
of January 14, 2010. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees went fo assessment on September 3, 2009.
Tasation has placed an estimated market value of $17,700 on the land and $97,200 on the
building.
As of February 1, 2010, a Code Compliance Inspection has not been completed.
As of February 1, 2010, the $5,000.00 performance bond has not been posted.
Real Estate taxes for the 2009 are delinquent in the amount of $2,818.62, plus penalty and
interest.
Code Enforcement Officers estimate the cost to repair this structure is $50,000 to $60,000.
The esfimated cost to Demolish is $8,000 to $10,000.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this stnzcture within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 4511.
�Jn Nove�nber 24, 2009, a Building Deficiency Inspection Repart was compiled and the
followiug conditions were observed.
This list of deficiencies is not necessarily all the deficienc9es present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate apdating or upgrading the systems involved.

This lisf of deFiciencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Department of Safetp and Inspections, 375 Jackson St., Suite 220. That
inspection wiil identify specific defects, necessary repairs and lebal requirements
to correct this nuisance condition. You may also be required to post a five
thousand dollar ($5,000.00) performance bond with the Department of Safety
and Inspections before any permits are issued, except for a demolition permit.

This building(s) is sub�ecY to Yhe restrictions of Saint Paui Ordinance Chapter 33.03
and shall not again be used for occupancy unCil such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two-story, wood frame, duplex and its two-stall, wood frame detached
garage.
L The chimney is defective, deteriorated or in a state of disrepair. Replace all
missing or defective bricks, tuckpoint as needed to restore the chimney to a
professional state of rriaintenance and repair. Permit may be required.
2. The eaves and soffits are in a state of disrepair or deterioration. Repair ali
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
3. The exterior walls and/or frim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint ar has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
4. These are missing os defective guardrails. Provide all stairways, porohes,
decks or steps which are more than 30" high with guardrails and intennediate
rails with openings in the guardrail no more than four (A) inches apart and in
accordance with the State Building Code.
5. The axterior walls of the house ai�d/or garage are defective. Repair a11 holes,
breaks, loose or rotting siding, to a professional state of maintenance.

6. The windo�v and/or door screens are missing, defective or in a state of
clisrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be t�ght-fitting and securely fastened to the frames.
The ci�indows andror storm windo���s are in a state of disrepair. Keplace all
missing or broken �� indow glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permrt may be
required. �
8. The bathroom floox covering is deteriorated or inadequate. Provide floor
covering which is imperoious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
Lack oti Electricity. Immediately restore electrical service. Pailure to provide
proper electrical service will result in these premises being declared Unfit for
Human Habitation and ordered vacated for lack of thts basic facility. Use of
candles, fuel operated lighting or extension eord wiring is not permitted while
the power is off.
10. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be requixed.
1 l. FURNACE: Have a licensed heating contractar serviee and ciean Yhe furnace
ar boiler and make any necessary repairs. Perform a C10 test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a permit.
12. Lack of Natural Gas Service. Immediately restore naturai gas service. Failure
to provide natural gas service will result in these premises being declared
Unfit for Human Habitation and ordered vacated for lack of this basic facility.
13. G.F.C.l.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May
Be Requrred.
14. The stairs have missing or defective handrails. Provide ali interior and
exterior stairways and steps of more that three (3) risers with handrails which
are grip�able and installed 34" to 38" above the nose of Yhe stair treads.
I5. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.

17. Smoke Detector: Lack of properly installed and operable smoke detector.
Provide funcrioning smoke detectors in accordance with the attached
requirement, within 24 hours.

As owner, agent or responsible part}. you are hereby notified that if these deficiencies and the
resultin; nuisance condition is not corrected by January 14, 2010 the Deparfinent of Safety and
Inspections. Division af Code Enforcement, will begm a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrafive costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building lnspecrion and Design Section, 375 3ackson Street, Suite 220, (651)266-$989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contacY Hentage Preservation (HPC� staff to discnss your proposal for
the repairs required by this arder and compliance with preservarion guidelines. Copies of the
guidelines and design review application and forms are available from the Department of Safety
and Inspections web site (see letterhead) and from the HPC stafF. No permits will be issued

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to ali interested parties, ail present ar subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance ox
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written auTharity of the Department of Safety and Inspections,
Division of Code Enforcement The depa� ls further reqaired to file a eopy of Chis "Order
to At�ate" with the City Clerk's Office.
If corrective actiou is not taken within the time specified in this order, the Enforcement Officer
will notify the Ciry Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council wi11 adopt a reaolution stating
what action if any, it deems appropriate.
If the resolution ca11s for abatement actian the Council may either order the City to take the
abatement action or fix a time within which this nuisance nlust be abated in accordance wzth the
provisions of Chapter 33 of the Saint Paul Legislarive Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs wi11 be assessed against the property as a special
assessment in accordance with law.

6. Ordering the owner to remove or repair the building(s) at 611 Sims Avenue within fifteen
(15) days from adoption ofresolution.
The property owner of record, Paolee Vang, did not appear. No other parties of interest appeared.
Mr. Magner stated the building was a two-story, wood frame, duplex with a detached two-stall
garage on a lot of 4,792 square feet and had been vacant since July 14, 2008. A code compliance
inspection had not been done, the vacant building registration fees in the amount of $1,000 went to
assessment on September 3, 2009, and the $5,000 performance bond had not been posted. On
November 24, 2009, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condition was developed. An order to abate a nuisance building was posted on
December 14, 2009 with a compliance date of January 14, 2009. To date, the property remained in
a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County
Tasation estimated the mazket value of the land to be approximately $17,700 and the building to be
$97,200. Real estate tases for were delinquent in the amount of $2,818.62, plus penalty and
interest. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to
$60,000. The cost for demolition was estimated to be approximately $8,000 to $10,000. There had
also been five summary abatements issued to this property since 2008, four of which went to work
order. to secure the building uid the City had to board the building to secure it from trespass,
remove improperly stored refuse and debris, and boarding/securing. Code Enfarcement
recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1886 and was a Victorian-era building. There was a loss of integrity to the exterior as it had been
stuccoed, the porch had been altered, and the openings had been changed. There appeared to be
large gaps in the block face of the neighborhood and it was not located in any potential historic
district. She did not believe demolition would have an adverse effect on the neighborhood.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
