This pxoperiy is legaily described as follows, to wit: EASTVILLE HEIGHTS LOT 11 BLK 16 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 34 40 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or befare December 28, 2008, the following are the now known interested or responsible parties for the Subject Property: MERS, INC, c/o Flagstar Bank, 5151 Corporate Drive, Troy, MI 48098-2639; Carlos W Thomas, 15196 Dupont Path, Apple Valley, MN 55124; Wilford & Geske, PA, 8425 Seasons Parkway, #105, VJoodbury, MN 55125; Payne Phalen District 5 Planning Council. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paui Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated November 24, 2009; and WHEREAS, this order informed the then lrnown interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the 5ubject Property by December 24, 2009; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before The Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, February 9, 2010 and Tuesday, Febrnary 23, 2010 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property 10-232 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WI�EREAS, a hearing was held before the Saint Paul City Council on Wednesday, March 3, 2010 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public heazings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 836 JESSAMINE AVENUE EA5T. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. � L� 6. �� That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Buiiding code violations at the Subject Property. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been rourinely monitored by Department of Safety and Inspections, VacantlNuisance Buildings. That the known interested parties and owners are as previously stated in this resolution and that the notification requuements of Chapter 45 have been fulfilled. 10-232 78 74 80 81 82 83 84 85 86 87 88 89 90 91 92 93 94 95 96 97 98 99 100 101 102 ••� • The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties sha11 make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition and removal of the structure must be completed within fifteen (1� days after the date of the Council Hearing. 2. If the above corrective action is not completed withan this period of time Department of Safety and Inspections is hereby authorized to take whatever steps aze necessazy to demolish and remove this stsucture, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the 5aint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is fiirther ordexed, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. (Continued from Feb. 9; need copy of the fire report for review) Ms. Moermond read a letter from David Mortenson stating that Flagstar had decided it would not be making the repairs to the property and he would not be attending the hearing. She recommended ordering the building removed within fifteen days with no option for rehabilitation. She said she'd received a copy of the fire report estimating a$100,000 loss at the time of the fire. 10-232 February 9, 2010 Legislative Hearing Minutes Page 5 4. Ordering the owner to remove or repair the building(s) at 836 Jessamine Avenue East within fifteen (15) days from adoption of resolution. David Mortensen, attomey with Wilford & Geske, appeared on behalf of Flagstar Bank, the property owner. Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two- story, wood frame, duplex on a lot of 4,792 square feet and had been vacant since April 17, 2008. A code compliance inspection had not been done, the vacant building registration fees in the amount of $1,000 went to assessment on Apri129, 2009, and the $5,000 performance bond had not been posted. On November 24, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on November 24, 2009 with a compliance date of December 24, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $20,000 and the building to be $80,000. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $80,000 to $9Q000. The cost for demolition was estimated to be approximately $8,000 to $10,000. There had also been nine summary abatements issued to this property since 2008, twn of which went to work arder: remove improperly stored refuse and debris and cut tall grass and weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1888 and was a late Victorian-era building. There was a loss of integrity with the siding being covered and the porch being lost. The two block faces were fairly intact and the property was not located in any potential historic district. She did not believe demolition would have an adverse effect. In reviewing the photographs, Ms. Moermond asked when the fire had occurred. Mr. Magner responded the fire happened on November 3, 2009; however, he did not have a copy of the fire report. Ms. Moermond asked Mr. Mortensen when his client wanted to knock down the building. Mr. Mortensen stated that he had talked to his cl3ent and they were in negotiations with the insurance company. They had also hired a contractor to look at the property to obtain estimates on the cost of the repairs. He said he had in-depth conversation with his client as to what the expectations were of the city if they planned to rehab the building and they indicated they were willing to do the work to save the building. He requested additional time for his client to do the rehab of the building. Ms. Moermond responded that the Order to Abate was sent on November 24, 2009, Flagstar had received personal service of these proceedings on January 20, 2010 and had not done anything with the building thus far. Sased on that information, she did not have confidence that they were serious about the rehabilitation of the property. She said that if they did undertake the rehab of the buiiding, it would need to be converted to a single-family dwelling as the lost size did not support the structure of a duplex. 10-232 February 9, 2010 Legislative Hearing Minutes Page 6 Ms. Moermond laid the matter over laid the matter over to Febnxary 23 with the following conditions to be met: 1) the code compliance inspection must be conducted; 2) the �5,000 performance bond must be posted; 3) obtain a swom construction statement; 4) provide financial documentation; 5) a work plan must be submitted; and 6) the property must be maintained. The location of the incident was 836 Tessanvue Avenue East with fire extansion to the exteriozs of the adjacent homes at 840 Jessamine Avenue East and 832 7essamine Avenue East. The origin of fhe fire was within the first IIoor kitchen, southeast corner. 'I'he cause of the fire is undeternuned pending further investigation. I responded to the incident scene to begin my fire investigation. At the time of my arrival, fire companies were in the process of extinguishing tke fire. PROPERT'I' DESCRIPTION: TTie building of fire origin was a two story, wood frazned, upper and lower duplex of balloon construction. The exterior contained vinyl sidiag over asphalt siding over wood lap siding. Interior finishes contaiued latk and plaster. The roof contained asphalt shingles. Approximate exterior dimensions were 42 feet Iong by 28 feet wide. The address side of the properiy £aced north. Xcel billing records indicated no power and no gas services to either the first or second floors. The exposure properly to the east at 840 Jessamine Avenue East was a two story, wood framed, balloon constr�cted duplex. The e�erior contained vinyI siding and the roof contained asphalt shingles. The address side of the property faced north. Enhy way doors were located on the north, east, and soutlz sides of the first floor. According to property records, the duplex was a registered vacant building. The exposure properry to the west at 832 Jessamine Avenue East was a two story, wood framed, bailoon constructed single family dwelling. The ea�terior contained vinyl siding and the roof contained asphalt shingles. The address side of the property facad north. Entry way doors were located ori the north and south sides. The structure had a reatty company for sale sign posted on tlie north side. EXT'ERIOR EXANIINATION: Visual examina#ion offhe properiy o£fire origin at 836 Jessamine Avenue East noted blackening of the exterior from the first floor southeast comer upwazd, to the roof on the south and east sides. The fire damage extended to the south eicterior wooden stairs. Smoke staining to the vinyl siding was visible above the windo on the north and west sides. Inspecrion of the property located at 840 Jessamine Avenue East noted melting of the vinyI siding on the west side. All entry way doors were secure. No other fire damage was noted. Examination of the property at 832 Jessatuine Avenue East noted melfing of fhe vinyl siding on the east side. No other fire damage was noted. INTERIOR EXAII�IINATION: Visual exaznination of the proper[y of fire origin at 836 7essamine Avenue East Fire damage extended throughout the first floor to the dining room and entry way hall. Fize damage was also noted upward along the north entry way interior stair�vell. Due to the bailoon construction, fire damage extended upward within the lath and plaster exterior wall spaces to the second floor and downward along the wood framework of the basement ceiling. 10-232 Fire Investigation Report 836 Jessamine Avenue East Page Three No interior fue damage was noted to the pmperties of fsre extension at 840 Jessamine Avenue East or 832 Jessamine Avenue East. INTERVLGWS: Engine #17 Captain, STEVE SHAPIRA, stated: • E na n e #17 was the first amving ftre company and positioned their muck in the alley to the south of 836 Jessamine Avenue East. • The entire soutk side of the structure was ful�y involved with fire. • E�eriox flame height was above the roof line. • Engine #17 crew members began ea�tingnishing the fire, but had to discontinue operations due to the electrical service liae from the pole to the entry mast on the house dropping across their engine. Engine #7 Cantain. 70HN HAGEMAN stated• • Engine #7 positionad their truck at the address sida of the structure. • Fn�mne #7 firefighters forced enhy through the north door and advanced a&re line into the structure.
