WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one and one-half story, wood frame duplex and its two-stall, detached gazage
located on property hereinafter referred to as the "Subject Property" and commonly known as
654 JESSAMINE AVENUE EAST. This property is legally described as follows, to wit:

9 WHEREAS, based upon the records in the Ramsey County Recorder's Office and
10 information obtained by Department of Safety and Inspections on or before June 15, 2009, the
11 following are the now known interested or responsible parties for the Subject Property: Postal
12 Credit Union, 8499 Tamazack Rd, Woodbury, MN 55125; Glenn M. Meech, 959 Arcade Street,
13 St. Paul, MN 55106; Wilford & Geske, PA, 8425 Seasons Parkway, #105, Woodbury, MN

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated November 3, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by December 14, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, February 9, 2010 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
demolition of the structure to be completed within fifteen (15) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
March 3, 2010 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 654 JESSAMINE AVENUE EAST.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Deparnnent of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by demolishing and removing the structure in
accordance with all appiicable codes and ordinances. The demolition and removal of the
structure must be completed within fifteen (15) days after the date of the Council
Hearing.

If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, duplex with a detached two car garage on
a lot of 4,792 square feet.
According to our files, it has been a vacant building since April 23, 2009.
The current property owner is Postal Credit Union, per AMANDA and Ramsey County Property
records.
Tha city has had to board this building to secure it from trespass.
There have been five (5) SUMMARY ABATEMENT NOTICES since 2409.
There have been six (b) WORK ORDER(5) issued for:
- Boarding/Securing
- Improperly stored refuse, garbage and misc debris
- Removal of snow and ice
On October 12, 3009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on November 3, 2009 with a compliance date of
December 3, 2009. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees went to assessment on 7uly 17, 2009.
Taxation has placed an estimated market value of $19,400 on the land and $ ll 5,300 on the

As of December 1, 2009, a Code Comptiance Inspection has been completed.

Dear Sir or Madam:
The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On October 12, 2009, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the de�ciencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.
This is a one and one-half story, wood frame duplex and its two-stall, detached garage.

EXTERIOR
The eaves and soffits aze in a state of disrepair or deterioration. Repair all
defects, holes, breaks,loose or rotting boards, to a professional state of
maintenance. Permit may be required.
2. The exteriar walls andior trim of the house and/or garage has defective,
peeled, flaked, scaled or cha3king paint ar has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the
door(s).
4. The window andlor door screens are missing, defective or in a state of
disrepair. Pmvide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.

The bathroom floor covering is deteriarated ar inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
2. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for
all enhy doors to dwelling unit(s).
3. Lack of Electricity. Immediately restore electrical service. Faalure to
provide proper electrical service will result in these premises being
declared Unfit for Human Aabitation and ordered vacated for lack of this
basic facility. Use of candles, fuel operated lighring or exYension cord
wiring is not permitted while the power is off.
4. The foundarion is deferiorated, defective or in a state of disrepair. Repair
all foundation defects in a professional manner to a weathex-tight,
water-tight and rodent-proof condition. Permit may be required.
FURNACE: Have a licensed heating contractor service and clean the
fiu•nace or boiler and make any necessary repairs. Perform a C{O test on
the heating plant. Then, send the attached form back to the Inspector.
Repair of gas fired appliances requires a permit.
6. Lack of Natural Gas Service. Immediately restore natural gas service.
Failure to provide natural gas service will result in these premises being
declared Unfit for Human Habitarion and ordered vacated for lack of this
basic facallty.

G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit
May Be Required.
8. The stairs have missing ar defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails
which are g and installed 34° to 38" above the nose of the stair
treads.

9. The interior ceilings are defective. Repair all ceiling defects and finish in
a professional manner.
10. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
11. There is evidence of a mdent in£estation. Irnmediately exterminate and
eliminate all rodents from the entire building. Remove rodent harborages
in the yard areas. Tuckpoint the foundation if necessary to rodent-proof
the building to prevent re-infestation. Immediately remove any dead
rodents from the premises.
12. SANITATION: Irnmediately remove nnproperly stored or accumulated
refuse including; garbage, rubbish, junk, vehicle parts, wood, metal,
recycling materials, household items, building materials, rubble, tires, etc.,
from yard. The Saint Paul Legislative Code requires all exterior property
areas to be maintained in a clean and sanitary condition. Usable materials
must be stored in an approved manner, so as not to constitute a nuisance.
13. Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectars in accordance with the attached
requirement, within 24 hours.
14. Lack of Water Service. Immediately restare water service. Failure to
provide water service will result in these premises being declared Unfit for
Hwnan Habitation and ardered vacated for lack of this basic facility.
15. The windows andfor storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit
may be required.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by December 3, 2009 the Aeparhnent of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs

and demolirion cosfs will be assessed against the property taxes as a special assessment in
accordance withlaw.

As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Desib Section, 375 Jackson Street, Suite 22Q (651)266-8989. This
inspection will ideniify specific defects, necessary repairs and legal requirements to correct tkris
nuisance condition.
I£ this buiiding is located in a historic district ar site (nofed above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Department of Safety
and 7nspections web site (see letterhead) and from the HPC staff. No pennits will be issued
without HPC review and approval. F3PC staff also can be xeached by calling 651-266-9078.
As an owner or responsible party, you are required by la`v to provide full and complete
disclosure of tlus "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Condi�ions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", sub}ect to demolition and removal by the City. This placard shall
not be removed without the written authority of the Departrnent of Safety and Inspections,
Division of Code Enfarcement. The department is further required to file a copy of this "Order
to Abate" with the City C1erk's Office.
If corrective action is not taken witYun the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties_ After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

fifteen (15} days from adoption ofresolution.
The property owner of record, Postal Credit Union, did not appear. No other parties of interest
appeazed.
Mr. Magner stated the building was a one-and-one-half story, wood frame, duplex with a detached
twastall �arage on a lot of 4,742 square feet and had been vacant since April 23, 2004. A code
compliance inspection had been done on December l, 2009, the vacant building registration fees in
the amount of � 1,000 went to assessment on July 1, 2009, and the $5,000 performance bond had not
been posted. On October 12, 2009, an inspection of the building was done and a list of deficiencies
which constitute a nuisance condition was developed. An order to abate a nuisance building was
posted on November 3, 2009 with a compliance date of December 3, 2009. To date, the property
remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey
County Taxation estimated the market value of the land to be approximately $19,400 and the
building to be $ll 5,300. Real estate taxes for the second half of 2009 were delinquent in the
amount of $1,097.89, plus penalty and interest. Code Enforcement estimates the cost to repair the
building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be
approYimately $10,000 to $12,000, There had also been five summary abatements issued to this
property since 2009, six of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse and debris, cut tall
grass and weeds, and boarding. Code Enforcement recommends the building be repaired or
removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that she had not had a chance
to complete her report of this property. In reviewing the photographs, she did not believe
demolition would have an adverse effect on the neighborhood.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.

Larry Paulson (581 Blair Avenue, St. Paul 55103), Ronald Scott (A69 Lafond Avenue, St. Paul
55103), and Steve Flannigan (449 Lafond Avenue, 5t. Paul 55103) appeared.
Mai Vang said the code compliance was not posted yet.
Mr. Magner gave a staff report: He said an attorney representing the mortgage company had
appeazed at the February 9 hearing, and a letter had been sent to the mortgage holder with a list of
the conditions to be met. He said the bond had not been posted ar a work plan submitted, and a
work order far snow and ice had been issued as recently as February 12.
Ms. Moermond asked about the ongoing issue with getting the code compliance posted. Mr.
Magner said it looked like the inspection had been done but he would check. He said the real estate
taaces for 2009 had not been paid.
Neighbar Larry Paulson stated that Frogtown had a lot of vacant homes and this one had been
boarded up for a couple of years. He said the property was not being maintained and he'd like to
see the structure torn down and the lot put to better use.
Neighbor Ronald Scott stated that the house had been vacant for a couple of years and the property
was being maintained by the city.
Neighbor Steve Flannigan said that when there were renters at the property they were terrible
renters, and the neighborhood needed homeowners. He said the property was rodent-infested and
an eyesore, and he did not feel that the shucture was sound.
Ms. Moermond said records indicated that there had been a fire at the property. The three neighbors
said they weren't aware of a fire. Ms. Moermond asked whether the property had been broken into.
The neighbors said that it had not, and there were no tracks in the snow around the house.
Ms. Moermond said it didn't appear that the bank was interested in doing anything with the house;
she recommended ordering the building removed within five days.
