WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated December 10, 20Q9; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this arder informed the interested or responsible parties that they must repair or demolish the shucture located on the Subject Property by January 11, 2010; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the tlme, date, place and purpose of the public hearings; and 10-230 41 42 43 44 45 46 47 48 49 SQ S1 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 64 70 71 72 73 74 75 76 77 78 79 &0 81 WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, February 9, 2010 and Tuesday, February 23, 2Q1Q to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in acwrdance with all applicable codes and ordinances. The demolition of the structure to be completed within five (5) days after the date of tha Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, March 3, 2010 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the 5ubject Property at 464 BLAIR AVENUE. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legaslative Code, Chapter 45. ?. 3. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abata Nuisance Building(s) was sent to the then lrnown responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. C� � That the deficiencies causing this nuisance condition have not been conected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, VacantlNuisance Buildings. The demolition and removal of the shucture must be completed within Tive (5) days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps aze necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the 5aint Paui Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtwes of any kind which interfere with the demolition and removal shail be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is fiirther ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance wiYh Chapter 45 of the Saint Paul Legislative Code. Accarding to our files, it has been a vacant building since August 29, 2007. The current property owner is Greenpoint Mortgage FundinglCo Countrywide Home, per AMANDA and Ramsey County Property records. The city has had to board this building to secure it from trespass. There have been eleven (11) SUMMARY ABATEMENT NOTICES since 2007. There have been ten (10) WORK ORDER(S) issued for: - BoardinglSecuring - Improperly stored refuse, garbage and misc debris - Removal of ta11 grass and weeds - Removal of snow and ice On September 9, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. Ordering the owner to remove or repair the building(s) at 464 Blair Avenue within fifteen (15) days from adoption of resolution. David Mortensen, attorney with Wilford & Geske, appeared. Ms. Moermond asked for a report from Mr. Ma�ner. Mr. Magner stated the building was a one- story, wood frame, single-family dwelling on a lot of 3,049 square feet and had been vacant since August 29, 2007. A code compliance inspection had been done in Apri12008 and had expired; however a new code compliance inspection had been done on October 27, 2009, the vacant building registration fees in the amount of $1,000 went to assessment on October 1, 2009, and the �5,000 performance bond had not been posted. On September 9, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on December 10, 2009 with a compliance date of January 11, 2010. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $16,200 and the building to be $64,700. Real estate taYes for 2009 were delinquent in the amount of $3,741.21, plus penalty and interest. Code Enforcement estimates the cost to repair the building to exceed $75,000. The cost for demolition was estimated to exceed $10,000. There had also been 11 summary abatements issued to this property since 2007, 10 of which went to work order. to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and debris, boarding/securing, cut tall grass and weeds, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond reviewed the photographs and asked when the fire had occurred. Mr. Magner responded that he did not kave the fire report in the file; however, accarding to STAMP, the fire occurred on May 4, 2008. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1895 and was a warker's cottage-style building. There was a loss of integrity and character to the exterior of the building. The block face itself was contiguous; however, there were only four older homes on the block with the remainder being in-fill housing. Although it was located in the potential Frogtown historic district as identified in the 1983 survey, she did not believe this area would still be eligible for current historic designation. She did not believe demolition would have an adverse effect on the neighborhood. Mr. Mortensen stated his firm had been retained by Green Point Mortgage c!o Countrywide for the foreclosure proceedings which occurred in September 2007. Green Point Mortgage does not exist anymore and he had been attempting to find who the owner was of this property. He believed Capital One now owns the property; however, he had been unable to verify their ownership. He believed they would have an interest in this property and would need time to see what they may want to do with it. He also believed they may not have been notified of these proceedings. Ms. Moermond countered that they would have been informed of these proceedings had they bothered to register title of the property with Ramsey County Taxation. They certainly had not found it in their interest to pay the property taxes ar to maintain the property in any way. 'I'he location of the incident was 464 Blair Avenue. Upon the fire department's arrival they found a small fire buming on the exterior of the northwest corner of the front porch. No ignition sources found in the area of origin. The house was vacant and partiaily boarded up. Edina Realtor, BRUCE JAMES MCALPIN, 9240 State Highway 25, Monticello, Minnesota, 55362, 612-669-6324, DOB 12/O1/1964. BACKGROIJND: I received notification of the fire via the Communications Center. I responded to the incident scene to begin my fire investigation and arrived on the scene at approximately 1027 hours. Engine #22 was the first arriving fire department vehicle on the scene and they arrived at approximately 1020 hours. The fire had been extinguished at the time of my arrival and companies were performing salvage and overhaul operations. PROPERTY DESCRIPTION• The structure is a two story, wood framed, single family dwelling containing a basement. The exterior contained wood siding and the interior wa11s contained lath and plaster. The dwelling measured approximately 15 feet by 46 feet and ran north to south in length. T"here was a three-season porch attached to the front of the structure that measured approximately six feet by 15 feet in dimension. The porch was situated approximately three feet off the �ound. The front of the home faces north. EXTERIOR EXAMINATION: Visual inspection of the exterior noted several first floor windows were boarded up. There were windows on all sides of the home that had holes through their window panes. On the exterior of the northwest corner of the porch the outside support joist was heavily charred. This area was, from the north end, south, approximately five feet. Heavy charring was noted to the southwest window frame in the kitchen. The window opening was boarded up. The realtor for the dwelling stated this damage had occurred before he became the realtor approximately two months ago. Rocks were noted on the floor in front of many of the broken windows. There was no other smoke or fire damage noted to the interior of the structure. The windows that had been boarded-up earlier by the boazd up company were dated April 2, 2008. INTERVIEWS: Edina Realtor, BRUCE JAMES MCALPIN, stated: • His company has had the property for approximately three months. • The last time he was at the property was approximatety two weeks ago. • There were some broken windows but they were boarded-up. • The windows broken now must have been broken in the last two weeks. • The charred window in the kitchen was done before his company took over the property. • He has two contractors coming over later today to bid on refurbishing the house.
