1 WHEREAS, the properiy owner of 1285 Como Boulevard West adjacent to Como Pazk, has
2 requested the diversion of a 944 square-foot area of Como Park abutting their properry for dtiveway
3 access, as shown on the attached map {E�ibit "A"), a copy of which is on file in the Office of Financial
4 Services-Rea1 Estate Division, in the file number 01-PKLDVRS-2010; and

WEIEREAS, the City of Saint Paul, Division of Pazks and Recrearion ("Parks & Rec") has given
pernussion to the said propetty owner to construct and maintain driveway access over and across said city-
owned patk land, as stated in the Saint Paul Parks and Recreation Commission's Resolution Numbered 10-
02, adopted Febriiary 10, 2010, a copy of which is attached hereto; and
WHEREAS, said property owner must enter into a driveway easement agzeement with the City of
Saint Paul for the construction and continued use of the area requested, and pay just compensation to Parks
& Rec as determined by an independent appraisal pursuant to Secrion 13.Q1.1 of the Saint Paul City
Charter; now, therefore be it
RESOLVED, that the proper city officials aze hereby authorized and directed to enter into a
driveway easement agreement with said property owner of 1285 Como Boulevazd West for access to
Como Boulevazd West; and be it fiuther
RESOLVED, that just compensation far said easement be paid by said property owner of 1285
Como Boulevard West and deposited into the Parkland Replacement Fund and held in reserve for future
parchase of park property as required by Chapier 13A1.1 of the City Charter, and that any other costs
incurred by the City of 5aint Paul in accordance with the parkland diversion guidelines, shall be fully
compensated by said properiy owner.

The property owners of 1285 Como Blvd. W. aze remodeling their home including a new garage and need access to said gazage
across apart of Como Pazk.
Advantages 1t Approved:
The City will receive funding for future pazkland purchases.
Disadvantages If Approved:
The pazkland will have a driveway access that does not presently exist
Disadvantages If Not Apprwretl:
The City would forego additional funding for future pazk purchases. The owners would be unable to uuprove the'u property (gazage)
without access across Ciry pazkland.

RESOLUTION 10-02
WF-IEREAS, the Saint Paul Pazks and Recreation Couunission ("Commission") is an
appointed body established to advise the Mayor and City CounciI on long-range and city-wide
matters related to Parks and Recreation; and
WHEREAS, Section 13.01.1 ofthe City Charter requires that the Commission review
any diversion or disposal of park property and present a recommendation to the Saint Paul City
Council; and
WHEREAS, the City of Sairn Paul, Department of Pazks and Recreation, owns ciry pazk
land, known as Como Pazk, in the nor[hern part of the City; and
WHEREAS, Jeff and Linda Warner, owners of 1285 Como Boulevazd West adjacent to
Como Pazk, have requested the diversion of a 449 square-foot area of Como Pazk abutting theu
proper[y for driveway access (as shown on Attachment A); and
WI�REAS, the Depaztment of Pazks and Recrea6on has determined that the pazk land
may be diverted for this purpose and recommends Commission support for the request; now,
therefore
BE IT RESOLVED, that the 5aint Paul Pazks and Recreation Commission concurs witY!
the request to divert city pazk land over, under and across a portion of the Como Pazk, as shown
on Attachment A through an easement to Jeff and Linda Wamer, and in accordance with City
Charter Section 13.01. I recommends approval by the Saint Paul City Council.

PROJECT DESCRIPTION:
The City of Saint Paul, Department of Pazks and Recreation, owns city park Iand, lmown as
Como Pazk, generatly located within the north end of the city. Residents Jeff and Linda Wazner,
mutually own the pmperty at1285 Como Boulevard West and have requested the diversion of a
949 squaze-foot azea of Como Pazk for driveway access area along the north side of the property
abutting the pazk land (as shown on Attachment A);

I recommend a public hearing before the City Council be held on March 3. 2010.
The purpose of this hearing is to consider a resolution to authorize the diversaon of
city park land. The owners of 1285 Como Boulevard West adjacent to Como Park,
have requested the diversion of a 949 square-foot azea of Como Park abutting thear
property for driveway access
