10-228Council File # 10-228 GreenSheet# 3Q9957b RESOLUTION � CITY OF SA{NT PAUL, MINNESOTA 3/ Presented by f� 1 WHEREAS, the properiy owner of 1285 Como Boulevard West adjacent to Como Pazk, has 2 requested the diversion of a 944 square-foot area of Como Park abutting their properry for dtiveway 3 access, as shown on the attached map {E�ibit "A"), a copy of which is on file in the Office of Financial 4 Services-Rea1 Estate Division, in the file number 01-PKLDVRS-2010; and 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 WEIEREAS, the City of Saint Paul, Division of Pazks and Recrearion ("Parks & Rec") has given pernussion to the said propetty owner to construct and maintain driveway access over and across said city- owned patk land, as stated in the Saint Paul Parks and Recreation Commission's Resolution Numbered 10- 02, adopted Febriiary 10, 2010, a copy of which is attached hereto; and WHEREAS, said property owner must enter into a driveway easement agzeement with the City of Saint Paul for the construction and continued use of the area requested, and pay just compensation to Parks & Rec as determined by an independent appraisal pursuant to Secrion 13.Q1.1 of the Saint Paul City Charter; now, therefore be it RESOLVED, that the proper city officials aze hereby authorized and directed to enter into a driveway easement agreement with said property owner of 1285 Como Boulevazd West for access to Como Boulevazd West; and be it fiuther RESOLVED, that just compensation far said easement be paid by said property owner of 1285 Como Boulevard West and deposited into the Parkland Replacement Fund and held in reserve for future parchase of park property as required by Chapier 13A1.1 of the City Charter, and that any other costs incurred by the City of 5aint Paul in accordance with the parkland diversion guidelines, shall be fully compensated by said properiy owner. Advantages 1t Approved: The City will receive funding for future pazkland purchases. Disadvantages If Approved: The pazkland will have a driveway access that does not presently exist Disadvantages If Not Apprwretl: The City would forego additional funding for future pazk purchases.
