4 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations
5 contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
6 constitute an unreasonable hardship on the applicant, other persons or on the community; and
8 WHEREAS, The University of St. ThomaslSTAR, represented by 7ese Ledbetter and Matt
9 Gustafson, Assistant Directors of Campus Life who have been designated as the responsible
10 persons on the application, has applied far a vaziance to present live music on Parking Lot O,
I 1 south campus of The University of St. Thomas, at 2260 Summit Avenue; and

WHEREAS, applicant is seeking a variance for the hours of 7:00 p.m. until 9:OQ p.m. on May 8,
2010;and
WHEREAS, if applicant is not granted a varianee it wi11 noY be able to present live music at 2260
Summit Avenue; and
WAEREAS, the Department of Safety and Inspections has reviewed the application and has made
recommendations regarding conditions for the variance; now, therefore, be it

22 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to The University
23 of St. Thomas/STAR, subject to the following conditions:

1) The variance shall be for the hours of 7:00 p.m. until 9:00 p.m. on May 8, 20] 0.
2) All electronicatly powered equipment used in conjunction with the event shall not exceed 90
dBA, as measured at 50 feet from the noise source.
3) The applicant shall provide petsonnel and equipment who shall provide continuous sound level
monitoring at all stages and each sound mix during the hours of the variance, to ensure
compliance Fvith Condition #2.
4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be
ttuned off no later than 9:00 pm, on the event date.
WHEREAS, Chapter 293 of the Saint Paui Legislative Code was enacted to regulate the subject of

36 FURTHER RESOLVED, that any violations of the conditions set forth above on the May 8, 2010
37 event date may resuit in denial of future requests for the grant of a noise variance, in addition to any
38 cnminal citation which mighC issue.
