Employee vehicles may not be parked or stored in the alley. 2. There shall be no exterior storage of vehicle parts, tires, oil or any other similar materials associated with the business. Trash will be stored in a covered dumpster. Storage of vehicle fluids, batteries, etc., shall be in accordance with the Ramsey County Hazardous Waste regulations. 3. At no time shall vehicles be parked in the driveway or in the public right-of-way. Vehicles awaiting repair may not be parked or stored in the alley. 4. The storage of vehicles for the purpose of saivaging parts is expressly forbidden. All vehicles parked outdoors must appear to be completely assembled with no major body parts missing. Vehicie salvage is not permitted. 5. No auto repair of vehicles may occur on the exterior of the lot or in the public right-of-way. 6. Auto body repair and auto body spray painting is not permitted. 7. Customer vehicles may not be parked longer than ten (10) days on the premises. It shall be the responsibility of the licensee to ensure that any vehicle not claimed by its owner is removed from the lot as permitted by law. 8. Vehicle sales are not permitted. 9. Provide maneuvering space on the property to aliow vehicles entering and exiting the site to proceed forward. Backing from the street or on to the street is prohibited. 10. Licensee must comply with all federai, state and local laws. 11. The license holder agrees to maintain the fencing in good repair; and the vehicle barriers and the striping of all vehicle parking spaces according to the approved site plan on file in DSI dated 7/25/07 (any changes to the site plan must be approved by the Zoning Administrator). 12. This particular license requires a Class N notification which means that the neighborhood is notified and people have a chance to voice their concerns. If anyone has a concern, it automatically triggers a hearing. Other Class N Licenses include: tattoo parlors, entertainment, liquor sales, auto sales, etc.—things that have an immediate impact on the neighborhood. In this case, the City received one (1) letter of objection to this license. There are three (3) possible results from this hearing: 1) Ms. Vang may recommend to the City Council that they issue this license without any conditions; 2) she may recommend to the City Council that they issue this license with agreed upon conditions; or 3) she may recommend to the City Council that they not issue this license but refer it to an administrative law judge for a further hearing and findings. Mr. Jeffrey Fischbach, Department of Safety and Inspections (D51), reported that Licensing and Zoning have approved this license with conditions. Building and Environmental Health inspections are not applicable. There has been no response from the district council. The Department of Safety and Inspections (DSI) has recommended approval with the following conditions: 1. Any trees on the licenses premises affecting the condition of the fence shall be removed. Mr. Fischbach noted that the cedar fence is in a state of disrepair and needs some maintenance. Ms. Vang asked Mr. Brian Tursso about his plan and whether he had any questions. Mr. Kroona interrupted and asked if he could explain. He stated that he has been the building owner under L& D Development for close to twenty (20) years. In 1996, he sold the business to Wayne Anderson (Wayne's Auto and Tire), who has come under some hard economic times. He was going to close up shop when Mr. Kroona heard about it in mid November, 2009. He decided to come back to run the operation. He formed a new corporation under the name of Hillcrest Certified Auto Repair, Inc. He brought in Brian Tursso, who has been a long term employee at a couple of other stores owned by Mr. Kroona. Hopefully, he will become the future sole owner. He added that since taking over, they have already done a lot of clean-up. When the weather turns warm again, they intend to finish-up. They want to put on another coat of paint and get the fence totally repaired. The parking lot aiso needs more work. Hopefully, the neighbors will see that they are trying to improve the business' appearance and appreciate their efforts. Ms. Vang stated that the objection concern noted cars being parked there over night. Mr. Fischbach responded that there are no restrictions on vehicles being parked over night for this license. That is typical for an auto repair garage. However, they cannot be parked on the premises for more than ten (10) days per condition #7. Mr. Kroona stated that the previous owner had a large towing business and perhaps that is what accounted for a lot of cars being parked there. The new shop will have a small towing business. Ms. Vang asked how they are handling the snow. Mr. Kroona replied that so far, they have used approximately four (4j parking spaces to mound up the snow. If more falls, they may need to have it hauled away. Mr. Kroona noted that they had a great discussion about the new business at the District 2 meeting on lanuary 19, 2010. District 2 fully supports the new business. Ms. Vang asked Mr. Tursso if he has owned a business like this before. He responded that this is his first ownership. He grew up in the area and now lives in the area also. He is very excited about his new business opportunity. Currently, there are two (2) others on staff full time and, hopefully, if business continues to grow, they will add two (2) more part time staff. Their current hours of io-zis operation are 7:00 a.m. —7:00 p.m., Monday through Friday; and 8:00 a.m. —4 p.m. on Saturday. At some point, they would like to extend their hours to Sunday. They have three (3) mechanic bays. Currentiy, they repair six (6) to eight (8) cars per day; their goal is from fifteen (15) to eighteen (18) per day. Ms. Vang asked about trash and litter. Mr. Kroona responded that they have a covered dumpster which is emptied weekly. They have a trash container that is located in front of the business right now because of the snow and will move it back to the side of the business when the weather is nicer. Litter is picked-up on a daily basis and two waste bins are located in front of the business for customers to throw away trash. When asked whether they would be installing a new fence or repairing the existing fence, Mr. Tursso replied that they would probably repair the existing fence because it is not in horrible condition; there's just a few boards missing that they wiil be replacing and then they will be painting the fence a nice coat of white. They anticipated that the fence would be repaired by July 1, 2010. Mr. Fischbach will re-inspect the fence sometime in July. Ms. Vang stated that she will recommend approval with the condiYions recommended by DSI.
