10-213Council File # 10-213 Green Sheet # 3099636 RESOLUTION C Presented by /0 3 WHEREAS, NEDU, Inc. has submitted for City Councii approvai the attached Registered Land 4 Survey (RLS) to verticaily subdivide a proposed building at the northeast corner of University 5 Avenue and Dale Street; and 6 7 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 WHEREAS, the purpose of the vertical subdivision is to obtain financing for the project, and it does not address the building and fire code issues raised by this development; and WHEREAS, these building and fire code issues will need to be resolved before the buiiding can be safely occupied; and WHEREAS, the Minnesota Statutes Section 508.47(4) requires that registered land surveys shall be approved in the manner required for the approval of plats, which under Minnesota Statutes Section 505.03 inciudes approval by the City Council, which approval shall be endorsed on or attached to the registered land survey; NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached RLS for the Frogtown Square project located at the northeast corner of University Avenue and Dale Street for the temporary purpose of obtaining financing for the project; AND, BE IT FURTHER RESOLVED, that the approval of this RLS is subject to the following condition: The developer has provided written acknowledgment to the City indicating that it understands that a CIC plat must be prepared and fi4ed before the said building may be eligible for a Certificate of Occupancy authorizing the lawful occupancy and use of the building.
