Resolved further, That a public hearing be had before the Council upon said report and for a confirma- tion of the awards of damages made by the Commissioner of Finance, and also upon the said assessment of benefits; at the Council Chamber, in the Court House in the City of St. Paul on the 2nd day of January , 19 57 , at ten o'clock A. PAUL In the matter of partially opening, widening and extending the Mississippi River Boulevard Approach to the pro- OBJECTIONS OF NORTHERN posed New Fort Snelling Bridge, by STATES POWER COMPANY condemning and taking the following A CORPORATION, TO THE described parcel of land: The West PROPOSED TAKING AND TO 100 ft. of Lot 31, Franklin Steele' s THE'AWARD- OF DAMAGES Subdivision of Lot 2, Section 21, Township 28 North, Range 23 West. Northern States Power Company, a corporation, alleges as follows: I Northern States Power Company (hereinafter sometimes referred to as "the Company") is a corporation duly organized, created and existing under and by virtue of the laws of the State of Minnesota for the purposes, among others, of manu- facturing, generating, transmitting and distributing electric energy for light, heat, power and other purposes to the general public, including residents of the City of St. Paul, Minnesota, and is now transacting such business. II In the transaction of its business, Northern States Power Company maintains and operates numerous and extensive generating plants and transmission and distribution systems for the generation, transmission and distribution of electric energy which it supplies to the public . Through its trans- mission system, the electric energy which is generated at the various generating plants of the Company' s interconnected system is made available to its distribution systems and thereby to the public. In order to meet the public demands for electric power, the Company has constructed steam electric generating plants 1 DEN 12 31 56 and substations, among other facilities, in various locations throughout its system, including plants near Minneapolis and St. Paul, Minnesota, and has added additional generating units to existing facilities in and about the Cities of Minneapolis and St. Paul. The Company's generating plants and substations are connected by various existing and proposed transmission lines to electric generating plants and substations throughout the Company' s interconnected electric system. III That on or about February 26, 1955, for a valuable consideration paid by Northern States Power Company, Fred F. Glunz, Louise L. Glunz, Dorothy L. Derks, Elmer A. Derks, Ruth S. Hempel, Erick Hempel, Betty L. Green, Paul Green, Donald C. Peterson, Lorraine K. Peterson, Richard. L. Peterson and Helen Peterson granted to the Company, in writing, the perpetual right, privilege and authority to construct, operate and main- tain its lines for the transmission of electric energy, including the necessary steel towers, wires, guys, stubs and other fix- tures, over, across and upon the following described real estate in the County of Ramsey and State of Minnesota, to wit: All that part of Lot Thirty One 31), Franklin Steele ' s Subdivision of Lot Two 2), Section Twenty One (21), Township Twenty Eight (28) North, Range Twenty Three (23) West, described as follows: Commencing at the Northwest corner of said Lot Thirty One (31); thence running Southerly along the West line of said lot to Southwest corner thereof; thence East along South line of said Lot Thirty One (31) to a point where a line running parallel with said Westerly line of said Lot Thirty One (31), distant One Hundred (100) feet therefrom would intersect South line of said Lot Thirty One (31) ; thence Northerly along last described line to the North line of said Lot Thirty One (31) ; thence Westerly along said North line of said Lot Thirty One (31), One Hundred (100) feet to place of beginning, being a strip of land One Hundred (100) feet in width along the West boundary of said Lot Thirty One (31) . The right of way to be Thirty (30) feet each side of the following described centerline: -2- DEN 12 31 56 Said transmission line shall be constructed on the following described center line: Commencing at a point on the East boundary which is Eleven Hundred Twenty (1120) feet, more or less, South of the East-West quarter line (center line of Norfolk Avenue) ; thence Southwesterly (SWly) to a oint which is Eleven Hundred Sixty (1160) feet, more or less, South of above quarter line and Sixty (60) feet, more or less, East of the West property line; thence Southwesterly (SWly) to the West boundary line at a point which is Eleven Hundred Fifty (1150) feet, more or less, South of above quarter line. That the said grant of easement was filed for record in the office of the Register of Deeds of Ramsey County, State of Minnesota, on April 19, 1955, and was duly recorded in Book 1480 of Deeds at page 75 as Document No. 1363506. That the Company is still the owner and holder of said easement, a true and correct copy of which is hereto attached, marked Exhibit A. IV That in order to meet the public demands for electric power and to utilize the electric energy which is generated by the Company at its Black Dog generating plant located on the Minnesota River south of Minneapolis, Minnesota, the Company has constructed an electric transmission line, operating at a nominal voltage of 115,000 volts, from the Company' s Black Dog generating plant to the Company' s Southtown substation located at East 40th Street and Hiawatha Avenue in Minneapolis, Minnesota. The Company' s Southtown substation is in turn connected with the Company's High Bridge generating plant in St. Paul, Minnesota, by the Company's High Bridge-Southtown transmission line. The Black Dog-Southtown and High Bridge-Southtown transmission lines constitute vital and important segments in the Company's inter- connected electric transmission system. In connection with the construction of the said Black Dog-Southtown transmission line and pursuant to the grant of easement hereinbefore mentioned, the Company has constructed a structural steel tower and the necessary wires, conductors, fixtures and appliances over, upon -3- DEN 12 31 56 • and across the parcel of land hereinabove described in paragraph III. V Unless the proposed taking herein is subject to the aforesaid grant of easement to Northern States Power Company, the Company objects to the taking herein on the ground that such taking is unnecessary; that said taking is contrary to law; that the land above described is already devoted to a prior public use as hereinabove described; and that the taking of said easement will seriously disrupt the furnishing of electric energy to the general public, including the residents of the City of St. Paul, Minnesota. VI Northern States Power Company further alleges that unless the taking herein is subject to the aforesaid grant of easement to the Company, and if said Company is or should be required to remove, relocate or modify its transmission line by the condemning authority herein or by any other governmental agency, the Company will be damaged in an amount which is estimated will be in excess of $30,000, and, therefore, objects to the award of damages herein as reported by the Commissioner of Finance on the ground that said award is totally inadequate and contrary to law. WHEREFORE, Northern States Power Company respectfully petitions the Council of the City of St. Paul as follows: 1. That the taking of the land hereinabove described be made subject to the said easement to Northern States Power Company described in paragraph III above, or 2. That if the taking herein include the taking of the said easement to Northern States Power Company, hereinabove described, the final order or final decree herein shall expressly -4- DEN 12 31 56 provide that in the event that Northern States Power Company, its successors or assigns, shall at any be required by the condemning authority herein or any other governmental agency to remove, relocate or modify the said transmission line herein- above described, or any part thereof, as constructed and main- tained over and upon the land hereinabove described, said condemning authority shall be required to pay all costs of such removal, relocation or modification, including all costs and expenses incident to the obtaining of any other necessary easements and rights-of-way required for such transmission line, or 3. That if neither the provisions of paragraph 1 nor 2 above are acceptable to the said City Council, Northern States Power Company be awarded the sum of $30,000 in damages.
