10-208Susaension 2/24/2010 Council File # 10 �08 Green Sheet # 3100257 RESOLUTION OF SAINT PAUL, MINNESOTA E� iing Council File No. 10-29, adopted January 6, 2010 Ordering the Abatement of Nuisance Buildings located at 389-393 Clinton Avenue 4 WHEREAS, the Council of the City of Saint Paul, on January 6, 2010, duly adopted Council File No. 10- 5 29 which ordered the abatement of buildings constituting a public nuisance condition on property 6 commonly known as 389-393 Clinton Avenue and legally described as set forth in the said Resolution, 7 either by the property owner or, if necessary, by the appropriate City agency within 15 days of the adoptaon 8 thereof; and 10 The subject buildings were not removed by the owners and the City is taking the steps necessary to abate 11 the said nuisance condition; and 12 13 14 15 16 17 WHEREAS, it has come to the attention of the Council that the Northeast Area Neighborhood Development Corporation (NENDC), in conjunction with and for the convenience of the Housing and Redevelopment Authority (HRA) stands ready to acquire the subject properties, rehabilitate them and thereby preserve them as decent, safe and sanitary housing auailable to the citizens of Saint Paul; and 18 WHEREAS, the City Council finds that the NENDC's desire to rehabilitate these properties is far 19 preferable to demolition; and 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 NOW, THEREFORE, BE IT RESOLVED, that the Council of the City of Saint Paul hereby temporarily rescinds Council File 10-29 in order to permit the NENDC to take whatever steps it deems necessary to: acquire control over the said properties; to the extent necessary and practicable, secure them and register them as vacant buildings and otherwise abide by the requirements of Leg. Code § 43.03 during the pendency of the rehabilitation proj ect; and, commence and complete the rehabilitation of the said properties; and (Lines 26 - 42 intentionally left blank) 10-208 43 BE IT FINALLY RESOLVED, by this Resolution, that the authority of the Department of Safety and 44 Inspections (DSn to abate the nuisance conditions of this property by taking "whatever steps are necessary 45 to demolish and remove this shucture, fill the site and charge," as set forth in Council File No. 10-29, is 46 hereby temporarily rescinded pending the NENDC's acquisition and rehabilitation of the said properties, 47 provided; should the NENDC determine that it is unable to acquire or otherwise rehabilitate the said 48 properties, upon written notice provided by the NENDC to DSI, the HI2A, and this Council, given within a 49 reasonable period of tune from the NENDC's determination of its inability to acquire or otherwise 50 rehabilitate the said properties, the matter of the previously deterxnined nuisance condition created by the 51 said properties, as determined in Council File No. 10-29, shall be placed back before the Council following 52 only the process necessary for the abatement of nuisance conditions set forth under Leg. Code § 4511(3-6) 53 for the Council to determine whether the appropriate City agency shall take the steps necessary to make the 54 said properties safe and not detrimental to the public health, welfare and safety in the most expeditious 55 manner possible.
