RESOLVED, that upon appeal of Mattie J. Guttenberg from
the decision of the Commissioner of Parks, Playgrounds and Public
Buildings, and upon the favorable recommendation of the Board of
Zoning, said Mattis J. Guttenberg be permitted to continue to
maintain a two-family residence on Lot 21, Block 6, Louden Park
Addition (at 2105 Stanford Avenue) , subject to the condition that
the duplex use be limited to the time that appellant actually
occupied the property, and provided further that at such time as
said premises are vacated by appellent, said premises will revert
to the original single family Use specified by the area and frontage
requirements of the Zoning Ordinance; provided further that a certified
copy of this resolution be filed with the Register of Deeds and that
the conditions herein set forth run with the land.

Dear Sir:
This is in the matter of the appeal of Mattie J. Guttenberg ,to maintain a
two-family residence on a lot of inadequate area and frontage on the pro-
perty known as lot 21, block 6, Louden Park Addition. This property is
adjacent to the north side of Stanford between Cleveland and 'Finn. The
zoning is "A" residence.
The home on this property was illegally converted to a duplex in 1945 pur-
suant to the building permit issued by the City of St. Paul. In that this
lot has a frontage of only 40' and a land area of 5,020 sq. ft. this use
is not permitted under the Zoning Ordinance.
The adjacent area is all developed in single-family homes. Field investi-
gation discloses that the character of this neighborhood should remain in
its present use. Field investigation also discloses there are no external
changes in the house which would suggest its conversion to a duplex and
the maintenance of the home and grounds appears to be excellent.
The Zoning Board finds that the owner has been a widow since 1947 and is
physically handicapped as is covered in her letter of October 24, 1956:
her income is limited and the renting of the additional dwelling unit is
the only means available for her to continue living in this home. .
In reviewing this matter, the Zoning Board finds that the actual effect of
the present use of the property is not detrimental to adjacent property in
the neighborhood by virtue of the fact that there is no external evidence
of the two-family occupancy construction.
The Board further finds that the applicant did proceed with this construction
in accordance with a permit issued by the City of St. Paul in 1945 which had
the effect of giving sanction to the establishment of this use. The Board
feels that a reasonable means of handling this problem would be to grant the
conditional use of this property as a two-family home on the basis of a hard-
ship for the period of time that the applicant actually Occupies the property
and providing further that at such time as the premises are vacated by the
applicant, the premises would revert to the original single-family use which
is specified by the area and frontage requirements of the Zoning rdinance.

If the Council sees fit to grant an appeal on this basis, the Zoning
Board recommends that this arrangement be recorded by filing/with the
Register of Deeds so that this matter would be understood by any
future purchaser of the property.
In consideration of these factors, the Zoning Board recommends this
appeal be granted.

Gentlemen:
I, Mattie J. Guttenberg, herewith petition, under Section 20, Paragraph
5, of the Zoning Ordinance, for permission to continue my residence at 2105
Stanford Avenue of the City of Saint Paul, in its present condition and for
the purpose of renting the three (3) rooms on the second floor. Said three
(3) rooms will be vacant as of Saturday, October 27, 1956.
I was granted a permit by the Building Department of the City of Saint
Paul, to improve this property in about February, 1915. The improvement
consisted of installing a sink and hot water connections on the second floor.
There was no other improvement to the property inside or out.
The party who had been renting the three (3) rooms on the second flor,
go through my downstairs living room. The three (3) rooms upstairs, are
not shut off in any manner,.
I own said property. I have lived in the property far about thirty
(30) years. My husband died in 1941:7 I have no other income except $54.00
a month pension. My husband was a anish-American War veteran. I also
receive $10.00 to $30.00 a month for special telephone radio work that I
do in my own home. I am an arthritic and have been for about fifteen (15)
years. I also had an injury to my hand and am almost wholly incapacitated
except that I can be around the house by the aid of holding on to furniture
and using a cane. It is very difficult for me to leave the house and cannot
do so without help. My physical condition is such that I really am not able
and should not be in my home alone, particularly at night. I am 72 years of
age.
WHEREFORE, I respectfully petition your honorable body that I be
authorized to continue my home in its present condition, during my ownership
thereof.
