Property owner did not return gold card; no video was available for the hearing.
Mr. Yannarelly stated that according to STAMP, this was a category 1 vacant building which file
was opened on August 21, 2009. Orders were issued on October 16 to remove improperly stored
refuse, tables, from the yard with a compliance date of October 22, 2009. The property was re-
inspected on October 23 and a work orders was sent to Parks who did the clean up on October 26,
2009 for a total assessment of $363.
Timothy Lisson, property owner, stated that without the video, he couldn't say what was done at the
property. He said he had been attempting to negotiate with the mortgage company to short sale the
house. In the meantime, he had been renting the property until the police served a search warrant
on the tenants in June and found drugs, guns, cash, and arrested four people. The tenants had
promised to make repairs to the property; however, they did not and he evicted them. He claimed
he then stopped the house payments, and then again was attempting to negotiate a short sale of the
property. He said the tenants still had some of their personal belongings at the house which they
refused to claim and he believed the tables which may haue been removed by the city had belonged
to the tenants.
Ms. Moermond asked Mr. Lisson whether he owned any other property. Mr. Lisson responded that
he had one property that was a contract for deed and owned another property with his cousin.
Mr. Yannarelly asked whether he had a C of O. Mr. Lisson responded that he did have a C of O.
Mr. Yannarelly stated that according to STAMP, the C of O was revoked in August, 2009 as being
vacant and that the owner was allowing the property to go into fareclosure.
Ms. Moermond asked Mr. Lisson whether he had a truth-in-sale-of-housing inspection done on the
property since he was trying to sell it. Mr. Lisson responded that he did not. Ms. Moermond told
Mr. Lisson that he needed to have an inspection before he could sell the property.
Ms. Moermond continued the hearing to February 2 to look at the video of the work which was
done.
1218 Bush Avenue (J0922A)
Mr. Essling stated orders were issued on October 12, 2009 to remove a large tree branch and

gazbage from the property with a compliance date of October 16. The property was re-inspected on
October 16 and was not in compliance. A work order was sent to Parks who did the clean up on
October 21, 2009 for a total assessment of $419. The orders were Mike and Aimee Pasiuk at 1218
Bush Avenue. There was no returned mail
Mike Pasiuk, property owner, stated he received a letter to cut tall grass and weeds and called the
inspector, Maureen Mitch, indicating that there wasn't any tall grass and weeds. Ms. Mitch
indicated to him that she had not inspected the properiy yet and if the yard had been mowed,
nothing would be done. He said he never received any order to remove tree branches and if he had
known about any order to remove them, he would have done so. He claimed he had also talked to
Ms. Moermond regarding this issue and was told to attend the hearing.
Ms. Moermond asked to see the video which showed several tree branches and bags of refuse which
were removed by Parks. Ms. Moermond asked about the history at the property.
Mr. Essling responded that at letter was sent on October 9, 2009 to cut tall grass and weeds which
was done by owner; orders were issued on July 7, 2008 to remove bags of yard waste from the yard.
Ms. Moermond stated that the city shouldn't have to send letters telling him to clean up the yard.
She indicated that she would recommend deleting this assessment; however, she would not forgive
any future assessments against the property.

No one appeared; Ms. Moermond recommended approving the assessment.

Property owner called after the hearing and requested to reschedule; rescheduled to February 2.

Property owner did not return the gold card and the inspector did not have the file available for the
hearing.
Rose Ntambwe, property owner, appeared with her son, Bob Mukokolo.
Mr. Essling stated that he was unable to provide a report as the STAMP system on the computer had
crashed.
Mr. Mukokolo stated that his mother had taken in a student from Africa, Nganga Gerald, to live
with her and the vehicle belonged to him. Gerald had all of his personal belongings, including his
passport, in the car and he had attempted to find him to tell him to remove his car and to get his
belongings out of the cas as the city was going to tow the vehicle. He had so far been unable to find
Gerald. He said that he believed Gerald should be responsible for the cost of hauing the vehicle
towed from the property since it belonged to him.

Ms. Moermond asked Ms. Ntambwe how long she had owned the property and how well she was
able to understand English and the orders that had been issued. Mr. Ntambwe responded that she
had owned the property since 1996 and her son would help her with the mail if she had difficulty
understandin�.
Ms. Moermond continued the hearing to February 2 to obtain a report from the inspector and to get
a copy of the police report.

Mr. Essling stated orders were issued October 15, 2009 to provide proof of garbage hauling service
with a compliance date of October 22. The property was re-inspected on October 22 and the owner
failed to provide proof of service. A work order was sent to Parks who dropped off two containers
on October 27, 2009 for a total assessment of $275. He said he had issued a suuunary abatement
order to clean out the gazage which was full to the ceiling with refuse which was also spilling out
into the alley. At that time, the property did not have garbage service. Since this was a duplex, he
ordered two containers be dropped and the city provided six weeks of garbage service. When he re-
inspected the property, one of the units, 662, did have a container from Allied Waste so he ordered
one container removed. As of today's date, the city was still providing garbage hauling service at
the 664 unit.
Mark Patraw, property owner, stated that he was selling the property to his cousin on a contract for
deed and was unaware of the issues at the property. Since then, he has terminated the contract for
deed and his cousin was scheduled to move out at the end of January with both units being vacated.
Ms. Moermond stated that since neither property had garbage service which was required under city
code, she recommended approving the assessment.
644 Robert Street South (J0922A)
Lyle Hall, property owner, appeared. Ms. Moermond acknowledged receipt of Mr. Hall's e-mail
messages she had received contesting the assessment for work done at this property as well as other
properties owned by him. Copies of said messages are attached and made a part of this record.
Mr. Essling stated orders were issued on October 6, 2009 to remove a pile of garbage in the
driveway, bikes & bike tires around the garage, chairs and three tables along the fence, with a

compliance date of October 12. The property owner called and requested an extension of tune to
clean up the property and he met with Mr. Hall at the property. At that tune he indicated to Mr.
Hall that he needed to clean up the property and provide proof of garbage service and granted a one
week extension to clean up the yard. He re-inspected the property on October 19 and found it not in
compliance. A work order was sent to Parks who did the clean up on October 21, 2009 far a total
assessment of $419. The orders were mailed to Lyle Hall at 1361 Lafond Avenue in St. Paul and to
the occupant. There was no returned mail. Mr. Essling noted that Mr. Hall fails to provide gazbage
service at any of the properties he owns.
Ms. Moermond asked to see the video which showed piles of trash, refuse, loose and scattered
debris, a TV, three tables, piles of bikes and bike tires & parts which were removed by Pazks.
Mr. Hall referred to his written testimony and claimed he never received the order. He also claimed
that he had requested two weeks to do the clean up and believed he had been granted that extension
of time.
Ms. Moermond stated that she believed Mr. Hall had received the orders and given the bad
conditions and history of problems at the property, she recommended approving the assessment and
welcomed Mr. Hall to attend the Council public hearing.
733 Sherburne Avenue (J0922A)
Mr. Essling stated orders were issued on October 14, 2009 to remove discarded furniture in the
alley with a compliance date of October 20. The property was re-inspected on October 20 and was
not in compliance. A work arder was sent to Parks who did the clean up on October 21, 2009 for a
total assessment of $233. He noted that there were two work orders for this property; he believed
the other was for a vehicle, as well as two videos.
Tricia McKissick and George Trembulak, Quality Residences, appeared. Ms. McKissick stated that
they had only received one order which was to mow the lawn and which was done by their
maintenance staff. She presented the order and receipts for the charge from Twin City Refuse. Mr.
Trembulak stated that whenever he receives the orders, he immediately goes out to the property and
takes care of the violation.
Ms. Moermond asked to see the video which showed scattered garbage around the garbage
containers as well as furniture which was removed by Parks. There was also a second video which
was the same work order and showed evidence of the clean up that had just been done.
Ms. Moermond stated that it appeared the charge was for mowing the lawn and said that she would
review the material and withhold her recommendation until after the hearing. After the hearing,
Ms. Moermond recommended deleting the assessment.
1129 Sixth Street East (J0922A)
Mr. Essling stated a letter was tnailed on October 8, 2009 to cut tall grass and weeds with a
compliance date of October 12. The property was inspected on October 16 and was not in
compliance. A work order was sent to Parks who mowed the lawn and cut the weeds on October
2Q 2009 for a total assessment of $155. The orders were mailed to Carl Schilling at 117 Churchill

Cazl Schilling, property owner, stated that he had purchased the property in April 2009. A tenant
had been living at the property and moved out in 7uly. He admitted that he had not mowed the lawn
in August; however, he had a new tenant move into the house on October 1 who had mowed the
lawn nntil the mower broke. He said he kad explained Yhis Yo the inspector, Maureen Mitch, and
indicated to her what had happened.
Ms. Moermond asked to see the video which showed Parks mowing the lawn on the boulevard. Mr.
Schilling responded that he didn't believe the grass on the boulevard was that tall.
Ms. Moermond asked what the history was at the property. Mr. Essling responded that there was
nothing under this ownership of the property. Ms. Moermond recommended deleting the
assessment.
951 Watson Avenue (J0906T)
The property owner submitted a written request to spread the cost of the assessment over 10 years.
Mr. Mueller stated that the property was inspected and orders were issued on July 24, 2009 to
remove eight diseased elm trees with a compliance date of August 25. The property was re-
inspected on August 25 and the trees were still standing. Orders were sent to the city's tree
contractor who removed the diseased trees on September 4, 2009 for a total assessment of
$2,660.43.
Ms. Moermond reviewed the letter from the property owner, Mary Zanmiller which is attached and
made a part of this record. Ms. Moermond recommended approving the assessment and spreading
the payments over ten years.

Information for this hearing on this assessment is presented by the owner of this property, Lyle C. Hall.
This assessment arises out of an inspection made by Joel Essling probably about October 7th or 8th. I bought my first house in
St. Paul in 1971 and another in 1991 and after retirement five more, three in 2009. Over the time that I have owned property in St.
Paul. I have issued a few "Summary AbatemenY' orders which I have received in the mail. In most cases I have corrected the
situation and others I have worked out a solution with the inspector. There also have been a couple of assessments. On these
Summary Abatement orders were the dates of the inspection, dates mailed and correct nuisance date. An example is one that has
a date of inspection of 11/17l08; date mailed of 11/18l08 and coRection date of 11/24/O8. This cocrecGon order which is the basis
of this assessment was not done in this way and I question if the way it was done is legal. I never received any mail concerning
this issue until I got the assessment around January 4th or
Sth, 2010 which gave the hme for a legislative hearing for today. I will detail my version of what happened which resulted in this
assessment. As I recall, I was home on the morning of October 8th and I got a phone call from a very angry Joel Essling. I was
very surpnsed to
receive such an angry phone call over an issue such as property Gean up. in that phone call I told him that I would get a crew to do
the clean up and he told me he would meet me at the property on Monday morning at 10:00 am October 12th to inspect the
property again. It is true that debris had been assembled on the property as well as a big pile of brush cut down in a clean up of
dead trees. In February of 2009, I bought'120 E. Elizabeth and in June the vacant lot at 116 E. Elizabeth. Both these properties
had not been cleaned up for years and I had a crew do a clean up and make repairs to a retaining wall and sidewalks on these
properties. There also existed a pile of old concrete, cement blocks and bricks in the back of the property of 644 Robert which was
there when I bought 644 in 2004 to which more was added during the summer. Berause I had purchased the hvo properties in
2009, I had for the first time vehiGe access to the back of 644 Robert
S. The area where there was debris, brush pile and pile of old concrete is surrounded by property that I own and is not visible from
any street.
I had a crew work all day on Saturday, October 10th. All the debris was removed, the brush was hauled to the St. Paul recyGing
facility on Pierce Butler. I met a ver unfriendly Mr. Essling at 10:00 am on October 12th. Everything was qwte neat on that snowy
Monday morning. However we had not removed old bicycles and associated bicyGe tires and parts neatly assembled in a small
area behind the garage. One of my tenants used these things to repair bicycles and he didn't want me to dispose of them. The
concrete pile was also still there as well as two tables by the fence between 644 Robert and 648 S. Robert and a couple of old
chairs behind the house. Mr. Essling told me that the concrete, bicycles also had to go and told me that he would give me one
more week to do it. I got a fellow to haul away the concrete in the early part of that week. I still had the bicycles and tables to
dispose of. On Wednesday evening Odober 14th, I got a rall that
there had been a death of a cousin in lowa and the funeral would be on October 17th. On Thursday morning, I called Joel Essling
and asked him if I could have some more time to remove the bicycles and the tables so I could go to the funeral and he told me,
he would give me another week. This is where it is crucial that nothing was written down because it turns out I was not given
another week. I came to 644 Robert S. on Thursday, October 22nd and found the bicyGes and tables had been hauled away. I
immediately called Mr. Essiing. He was extremely angry and refused to talk with me when I asked him about his commitment to
give me an additional week to comply. It is now obvious to me that he had been determined not to work with me and lery the
assessment. He only told me that he would see me at the hearing. f got the feeling that anything he says would be accepted by
the hearing officer and my case would be futile. I assume that he is probably
correct. I am now having the feeling that because city revenues are down, this method is being used to generate additional
funding. I know a video will be shown at the hearing but I doubt it will be one done the day before the aty came to haul away the
bicycles and tables but probably one done at frst inspection on October 7th or 8th. I feel the city is being very dishonest in this
assessment and I exped the legislative hearing officer will forv✓ard this assessment to the city council which they will probably
approve but I think I can then go to court so I can get Mr. Essling to testify under oath. It is regrettable that I don't have any letters
associated with this matter and it all depends on telephone conversations. I wonder if it is legal to make an assessment of $419
without any documentation. This treatment of city workers to a citizen and property owner of the city Wno are trying to comply with
their order is certainly not something the
mayor and city council should tolerate.

This assessment is for a house in which I rent bedrooms. In the spring and summer of 2008, I had one
tenant who was involved with repairing cars. One thing he did was to collect some tires and put them
along the east side of the house. He moved out and he told me he would be coming to collect the tires
but he didn't and these tires were there when Joe Essling inspected the property on December 10, 2008.
Another tenant who lived there during the summer was a roofer and when he had leftover bundles of
shingles he also brought them to the property. He moved out in November and didn't take the shingles
with him. So it was no surprise when I got a SLTMMARY ABATEMENT ORDER to remove the tires
and shingles and other things also left there. I opened the letter quickly and saw what it was. I wasn't
awaze at that time that there was a second page which was ORDER TO PROVIDE GARBAGE
SERVICE.
I wasn't even aware that there was such an ordinance in the city of St. Paul until November of 2008
when I got a similar order for my residence since 1971 at 1361 Lafond.
I am a retired chemistry professor and I am very aware of the limited resources of our planet so I have
always believed in recycling and have done it since I first bought my home on Lafond. After I am
through taking out all the recyclables waste, there is very little left that actually goes to trash. For
years I have taken that (usually a small bag) along with the recyclables to a transfer station and paid
the $3/bag fee for the non recylables.
I became aware that there was this ORDER TO PROVIDE GARBAGE SERVICE included with
SUMMARY ABATEMENT ORDER when I got a letter dated December 16` from 7oe Essling. This
letter informed me that the city was going to provide this service at a cost much higher than normal
garbage removal contractors.
I may have gotten the letter on the 18th. We had gone to the recycling station of Como and J&J
transfer station to comply with the Si JMMARY ABATEMENT ORDER so on December 18 there
was no waste outside the house (little inside as well as there was only one tenant at the time). I
probably didn't call an order into a waste removal company for that week because there was no waste
at the property that week. As I recall, T did call to Allied to request service on Friday, December 19th
and was told that they needed an advance payment to process the order. I sent in a check that day. As
I recall. I called Joe Essling to tell him that I had ordered waste removal from Allied but when he
called Allied the morning of the 22nd and he was told that there was no contact for garbage pick up at
134 Elizabeth E. That was because they had not yet processed the check. As I recall, the city
delivered the garbage container on the 23rd and Allied delivered their container on the 24th. The city
garbage container was never used. I called Joe to ask about his matter and he told me there would be a
$50 charge for delivering the container, at least one week of pickup ($50) and then another ($50) for
picking up the container. I asked him if I could take the container back to the city facility to save the
$50 and was told no. I now see that the assessment is for $275 and the city never took hauled away
any trash. I had only one paying tenant far the month of December and he paid $200 far the month
and I pay the utilities.
The city has been making it very difficult to provide inexpensive housing to low paid workers. We
now have city fire and safety inspections and to comply with those has been expensive. An example is
the yearly furnace inspection which cost $165 (owner occupied homes almost never have this done)
plus a whole list of things with which to comply. One of which was to change the curtain in the
bathroom which doesn't seem to be related to either safety or fire.
Now that there is weekly garbage pickup, there is no recycling done at this house. I think that
recycling should be an option along with taking non recyclables things to a transfer station which I

Information for this hearing on this assessment is presented by the owner of this property, Lyle
C. Hall.
This assessment arises out of an inspection made by Joel Essling probably about October 7� or
8` I own several properties in St. Paul and in the past I have been issued "Summary
AbatemenY' orders which I haue received in the mail. On these orders were the dates of the
inspection, dates mailed and correct nuisance date. An example is one that has a date of
inspection of 11/17/08; date mailed of 11/18/08 and conection date of 11/24/08. This correction
order which is the basis of this assessment was not done in this way and I question if the way it
was done is legal. I never received any mail concerning this issue until I got the assessment
around January 4 or S 2010 which gave the time for a legislative hearing for today. I will
detail my version of what happened which resulted in this assessment. As I recall, I was home
on the morning of October 8� and I got a phone call from a very angry Joel Essling. I was very
surprised to receive such an angry phone call over an issue such as property clean up. In that
phone call I told him that I would get a crew to do the clean up and he told me he would meet me
at the property on Monday nioming at 10:00 am October 12 to inspect the property again. It is
hue that debris had been assembled on the property as well as a big pile of brush cut down in a
clean up of dead trees. In February of 2009, I bought 120 E. Elizabeth and in June the vacant lot
at 116 E. Elizabeth. Both these properties had not been cleaned up for years and I had a crew
make do a clean up and make repairs to a retaining wall and sidewalks on these properties.
There also existed a pile of old concrete, cement blocks and bricks in the back of the property of
644 Robert which was there when I bought 644 in 2004 to which more was added during the
suminer. Because I had purchased the two properties in 2009, I had for the first time vehicle
access to the back of 644 Robert S. The area where there was debris, brush pile and pile of old
concrete is surrounded by property that I own and is not visible from any street.
I had a crew work all day on Saturday, October 10�'. All the debris was removed, the brush was
hauled to the St. Paul recycling facility on Pierce Butler. I met Mr. Essling at 10:00 am on
October 12 Everything was quite neat on that snowy Monday morning. However we had not
removed old bicycles and associated tires and parts neatly assembled in a small area behind the
garage. One of my tenants used these things to repair bicycles and he didn't want me to dispose
of them. The concrete pile was also still there as well as two tables by the fence between 644
Robert and 648 S. Robert and a couple of old chairs behind the house. Mr. Essling told me that
the concrete, bicycles also had to go and told me that he would give me one more week to do it.
I got a fellow to haul away the concrete in the early part of that week. I still had the bicycles and
tables to dispose of. On Wednesday evening October 14` I got a call that there had been a death
of a cousin in Iowa and the funeral would be on October 17` On Thursday morning, I called
Joel Essling and asked him if I could have some more time to remove the bicycles and the tables
so I could go to the funeral and he told me, he would give me another week. This is where it is

crucial that nothing was written down because it tums out I was not given another week. I came
to 644 Robert S. on Thursday, October 22" and found the bicycles and tables had been hauled
away. I immediately called Mr. Essling. He was extremely angry and refused to talk with me
when I asked him about his commitment to give me an additional week to comply. He only told
me that he would see me at the hearing. I got the feeling that anything he says would be
accepted by the hearing officer and my case would be futile. I assume that he is probably
correct. I am now having the feeling that because city revenues are down, this method is being
used to generate additional funding. I know a video will be shown at the hearing but I doubt it
will be one done the day before the city came to haul away the bicycles and tables but probably
one done at first inspection on October 7� or 8` I feel the city is being very dishonest in this
assessment and I expect the legislative hearing officer will forwazd this assessment to the city
council which they will probably approve but I think I can then go to court so I can get Mr.
Essling to testify under oath. It is regrettable that I don't have any letters associated with this
matter and it all depends on telephone conversations. I wonder if it is legal to make an
assessment of $419 without any documentation.

BACKGROUND:
The cost of this tree removal was extremely excessive. Last fall, I actually got a bid of
$1,500 from this company to remove the entire clump oftrees.
When I got the bid it crossed my mind that if I waited until winter to have the work done
my yazd would not be dug up by the weight of the huck. Come winter l did not act on
this bid because January 29, 2009 I had a house fire and was not able to live in my home
until 11/19/2009. I did not receive notice that the forester had been to the house because
notices were dropped on the porch and I was not living there. I received no notification
by mail. I have been assured that in mid July 2009 a notice was mailed to the property. I
had my mail forwarded to where I was living, but checked that this was temporary. I did
not lmow that to the U.S. Postal Service this meant that I only wanted my mail forwarded
for six (6) months. I did not discover that my mail was not being fonvarded for several
weeks. I never received the mailed notice.
I simply cannot affard to pay this outright. I accept my responsibility to have diseased
trees removed from my property. I just do not earn enough to pay this outright or even in
a couple of years. Please consider allowing me to pay this back over ten (10) years.

J0922A Property clean ups from October 7 to October 28, 2009;
J0920G Weekly garbage hauling services from October 21 to October 28, 2009; and
70905V Towing of abandoned vehicles from private property during June and July, 2009
621 Arlineton Avenue East (J0922A and J0920G)
Laid over from January 19. The property owner sent a written appeal which is attached and made a
part of this record.
Mr. Essling stated orders were issued on October 8, 2009 to remove garbage, rubbish, and yazd
waste from the rear of the yard with a compliance date of October 14. The property was re-
inspected on October 14 and was not in compliance. A work order was sent to Parks who did the
clean up on October 15, 2009 for a total assessment of $419. Orders were simultaneously issued to
provide proof of garbage service with a compliance date of October 14. The property was re-
inspected on October 14 and the owner failed to provide proof of service. A work order was sent to
Parks who dropped off a container and began weekly garbage hauling service for a total assessment
of $225. He noted that this building was now listed as a category 2 vacant building.
Ms. Moermond asked to see the video which showed numerous bags of trash, rubbish, and yard
waste scattered throughout the yard.
Ms. Moermond noted from the letter submitted by Hugh Hadlund, Prime Security Bank, that the
bank took ownership of the property on a cancellation of the contract for deed on November 16,
2009. He requested the assessment be reduced to a total of $250, including the assessment for the
vehicle abatement. Ms. Moermond stated that the tax assessment went with the property and
recommended approving the assessments.
757 Bush Avenue (J0922A)
The owner did not return the gold card for the January 19 hearing and the inspector did not have the
file or video of the clean up that was done.
Mr. Essling stated that the C of O was revoked on August 12 and was transferred to Vacant
Buildings. A category 1 vacant building file was opened on August 21, 209. Orders were issued on
October 19, 2009 to remove tables located on the east side of the property with a compliance date of
October 22. The property was re-inspected on October 23 and was not in compliance. A work
order was sent to Parks who did the clean up on October 26, 2009 for a total assessment of $363.
The orders were mailed to Timothy Lisson at 1126 Cumberland Street in St. Paul. There was no
returned mail.
Ms. Moermond asked to see the video which showed two dilapidated tables which were removed by
Parks. Ms. Moermond reviewed the minutes from the January 19 hearing and noted the other issues
concerning the property. She recommended approving the assessment.

Mr. Essling stated order were issued on May 20, 2009 to remove two vehicles with expired tabs and
were inoperable from the property with a compliance date of May 29. The property was re-
inspected and one of the vehicles had been removed. A work order was sent to the St. Paul Police
Department on June 3 to remove a blue Subaru that appeared inoperable and with expired tabs. The
vehicle was towed from the property on June 4, 2009 far a total assessment of $469.23.
Ms. Moermond reviewed the paperwork which was provided by her outstanding secretary and noted
that a photo of the vehicle showed the tabs had expired in March 2008. Therefore, she
recommended approving the assessment.

Mr. Mueller stated that he had received a call from the property owner, James Hillier, indicating
that he was elderly, disabled, and could not afford the cost of the assessment for removal of the tree
on his property. The total cost of the assessment was $894.78.
Ms. Sheffer indicated that she had talked to Mr. Hillier and referred him to Real Estate to see if he
qualified for a deferment of the tas assessment. It was uulaiown whether the property owner
qualified or not.
Ms. Moermond stated that in the event the property owner did not qualify for a tax deferment, she
recommended approving the assessment and spread the payments over ten years.
