C• C; RESOLUTION—GENERAL FORM 1 t:ewhetrees, a" r er A PRESENTED BY ' 19N A COMMISSIONE i 40---" DATE p the per 1nL at, h110^o&" WHEREAS , do the 30th day of April, 1955, George Schmidt, a Fire Captain with the Department of Public Safety of the City of Saint Paul, was injured on duty and hospitalized as a result thereof, the City recognizing the injury or dis- ability as a compensable injury arising out of and in the course of his employment ; and WHEREAS , on November ?, 1955, the employee was again disabled, and the disability resulted from a condition similar to that causing the disablement after the incident of April 30, 1955, the onset of the second incident, however, not occurring at a time when aforesaid employee was working for the City; and WHEREAS, the employee contends and alleges that the second disability was caused by and arises out of the compensable injury on duty for the City; and whereas the City denies the second incident is compensable; and WHEREAS , the aforesaid employee and the City, through the office of the Corporation Counsel, have negotiated a tentative compromise settlement, as is more fully set forth in the copy of the Stipulation for Final Compromise Settlement attached hereto, now, therefore, be it RESOLVED, that the proper City officers are hereby authorized to enter into said compromise settlement with employee George Schmidt.
