petitioners or some of them shall convey to the City
for street purposes those portions of lots 1 and 24,
Block 1; Lots 1 and 24, Block 2; Lots 1 and 24, Block
3, Guerney Highland Park, lying within 40 feet of the
north line of Section 19, Township 29 north, Range 22
west, and that compensation of $1.00 be paid the City
and a surety band of $1,000.00 be filed with the City.

SUBJECT: Vacation of alleys in Blocks 1, 2, and 3 and in those parts
of Blocks 6, 7, and 8 lying northerly of Wheelock Parkway,
all in Gurney Highland Park
Hearing - December 14, postponed to December 21, 1955
This supplements my previous report on the above described matter which
came up for hearing on December 14, and the recommendations herein con-
tained as to the sections of alleys to be vacated and conditions to be
imposed as a part of the vacation are the result of an agreement reached
at a conference suggested by the Council between the writer and Mr. Frank
P. Conney representing the petitioners.
No one having appeared objecting to the vacation of the alley in that part
of Block 6, Gurney Highland Park, lying north of Wheelock Parkway, in
which case one owner did not join in the petition, it is recommended that
the same be included in the vacation, thereby eliminating creation of a
dead-end and the necessity for a turn-around as described in the second
paragraph of the prior report.
It was brought out that financing the development of twenty-seven build-
ing sites adjoining some of the alleys to be vacated had been approved
by the Federal Housing Authority on the basis of a proposed site lay-
out, and it is found that the original requirement of a 15-foot widening
of Larpenteur Avenue on the south side would make it difficult to re-
align the sites on the remaining land and still conform to Federal Hous-
ing Authority requirements.
Since the County Engineer stated in his letter that an 80-foot right-of-
way along this section of Larpenteur Avenue, involving a 10-foot widen-
ing on each side, would meet the minimum requirements, it is recommended
that the petition be gpranted subject to the condition that the respec-
tive owners convey to the City of St. Paul for street purposes those por-
tions of Lots 1 and 24, Block 1, Lots 1 and 24, Block 2, Lots 1 and 24,
Block 3, Gurney Highland Park, lying within 40 feet of the north line
of Section 19, Township 29 North, Range 22 West, and that compensation - , J ; ;
for the vacation be fixed at $1.00 with a bond in the amount of $1,000 ¢ ;' r

Hearing - December 14, 1955
All of the subject alleys are 12 feet wide and unimproved and lie in an
undeveloped area west of Jackson Street and between Wheelock Parkway
and Larpenteur Avenue. The purpose of the vacation is to eliminate the
expense of grading the alleys to obtain approval of the Federal Housing
Administration for financing the development of the area.
I see no objection to the vacation of any of the alleys described, with
the possible exception of the alley in Block 6 which is shown in green
on the plat attached to the petition, in which case only one of the
owners signed the petition on behalf of the land located on the west
side of the alley while the other owner refused to sign and was opposed
to the vacation. If, because of opposition this half block of alley is not
vacated, then a turn-around should be provided at the northerly end as
shown on the plat.
The County of Ramsey is planning on continuing the widening and recon-
struction of Larpenteur Avenue, and for this purpose additional right-
of-way will be required on the sectir v:—ch lies along the north side

Dear Mr. Seamer:
Mr. Forrest W. Crowley of your department discussed with this
department a sketch showing the proposed vacation of the alleys referred to
in this letter. This skech also indicated the proposed building locations
together with proposed lot divisions.
In the best Interest of the City of St. Paul and the County of
Ramsey may we suggest that the petition to vacate said alleys be granted sub-
ject to the following conditions: That owner deed to the City of St. Paul
that part of said blocks and alleys lying North of a line parallel to and
45 feet South of the North line of Section 19, Township 29,North, Range 22
West. (However, if 45 felt creates too much of a hardship/ then as a minimum
condition this could be changed to read 40 feet South.) This would provide
the minimum right of way for the South side of Larpenteur Avenue for the
reconstruction of that road in the near future.
It is also our belief that the City of St. Paul should establish
a building setback line on Larpenteur Avenue. In this connection we believe
it would be advisable for the developer to construct his homes adjacent to
Larpenteur Avenue on or about the present grade of Larpenteur Avenue, thereby
eliminating the need for excessive slopes and backslopes.
In consideration of the acceptance of these conditions the petitioner
shall be granted his request to vacate alleys lying south of described line as
set forth in this letter;

limits of the City of Saint Paul, hereinafter described, be and
the same are hereby vacated and discontinued as public alleys,
viz:
