Gentlemen:
The writer has analyzed the attached
application by the Congregation of the Sons of Jacob for
a permit to operate a cemetery on certain lands located
northeasterly, of the intersection of Parkway Drive and
Idaho Avenue, and finds that by reason of an exchange of
lands between the Gustavus Adolphus Evangelical Lutheran
Church and the Congregation of the Sons of Jacob, and the
vacation of certain streets and alleys, each of these two
organizations will own a consolidated area of ground which
will be rectangular in shape whereas the present ownerships
are irregular in shape. This is illustrated by the at-
tached plats, sheet " showing present ownerships and pro-
posed vacations now in process and sheet 2 showing owner.

Since a new petition has now been
filed for the vacation of the alley in Block Is, Catlin's
Addition and the hearing thereon is set for December 19,
and since it is the intent of the applicant to have this
alley included in the cemetery permit, I recommend that
action on the cemetery permit be deferred until after the
hearing has been held ,on the new petition, at which time
the applicant intends to file a new application describing
all of the lands to be covered by the permit.

Dear Sir:
The Council referred to you for recommendation the attached petition
of Gustavus Adolphus Evangelical Lutheran Church of Saint Paul,
Minnesota, and The Congregation of the Sons of Jacob for the vacation
of portions of E. California Ave. and Weide St. and that alley lying
in Block 3, Catlin's Addition to the City of Saint Paul between the
east line of Weide St. and the west line of Lots 17 and 2 extended.
Hearing on this matter will be held on December 5, 1956.
Also attached is an application of Lechtman and Goldberg, on behalf
. of the Congregation of the Sons of Jacob, for permission to extend
their cemetery to cover certain property described in the application,
the property to include a portion of Weide St. as proposed to be
vacated. The application was laid over until December 5th for
1 hearing on the vacation proceeding.

Gentlemen:
The undersigned, as the attorneys for the" Congregation of
the Sons of Jacob, a Minnesota corporation, have entered into an
agreement with the Gustavus Adolphus Evangelical Lutheran Church of
St. Paul wherein and whereby the Sons of Jacob has agreed to ex-
change a parcel of property, owned by it and being a part and parcel
of its cemetery, for a piece of property owned by the Church and
adjacent to the Sons of Jacob Cemetery. We request that the Honor-
able City Council authorize and approve, by proper resulution or or-
dinance, the use of the parcel presently belonging to the Church and
in the process of being conveyed to the Sons of Jacob and being adja-
cent to the Sons of Jacob Cemetery, for cemetery purposes.
The legal description of the present Sons of Jacob tract
being conveyed to the Church is as follows:
Lots one (1) , two (2 ) , three (3) , four (4), five (5) six
(6) , seven (7) , eight (8) and nine (9) , Block one (1) ,
"Catlin's addition to the City of St. Paul" and also, all

Gentlemen and Madam:
Under date of December 11, 1956, this
office was advised by Commissioner Marzitelli, of the De-
partment of Public Works, that the 80-acre tract acquired
for agricultural u e in connection with the workhouse farm
was no longer requ red for such use and that a study of the
future needs of th Board of Education in the area indica-
ted that a portion of the 80-acre tract should be reserved
for use as a future school site.
On January 9, 1957, the Board of Edu-
cation presented to\ the Council a resolution, being Board
File No. 21161, adopted January 8, 1957, requesting that an
application for a change of use covering the west 540 feet
of the north 800 felt of the west i of the Southeast * of
Section 2, Township 28 North, Range 22 West, which request
was referred to this office.
Attached hereto are resolutions, one
of which authorizes the application for the change of use
and the other authorizes the reconveyance of the remainder
of the 80-acre tract}
In order to assist in making the ap-
plication and the reconveyance, we are attaching maps of
the area involved, and copies of the resolutions and corres-
pondence in triplicate.
