WHEREAS, heretofore Mrs. D. W. De6oster appealed for the
establishment of a new building line on Lot 2 and part of Lot 1,
Goodkind Terrace, and a $20.00 filing fee in connection there-
with was paid on July 12, 1956, by Fasth, Hillstrom & Horty,
Inc. architects, and
WHEREAS, said appellant has requested the withdrawal of
such appeal and the return of said filing fee, therefore be it
RESOLVED, that the Council hereby authorizes the withdrawal
of said appeal for the establishment of a new building line on
Lot 2 and part of Lot 1, Goodkind ,Terrace, and further authorizes
and directs the proper City officers to refund the sum of
$20.00, filing fee in connection therewith, to Fasth, Hillstrom
& Horty, Inc. , 910 Midland Bank Building, Minneapolis 1 Minn.

withdrawal of an appeal of Mrs. D. W. DeCoster for the establishment

Edward C. Hillstrom, Architect for Mrs. D. W. DeCoster, has requested
a refund of the filing fee paid the city in connection with the appeal
of Mrs. DeCoster for the change of a building line on Lot 2 and part of
Lot 1, Goodkind Terrace.
You will recall that this appeal was withdrawn and you informed us at
that time that she had decided to abide by the existing building line.
Will you please give us your opinion, informal or otherwise, as soon
as possible, as to whether ',or not a refund should be made in this case
8o that we may advise the Council?

Re: Mrs. D. W. DeCoster fees.
Gentlemen: Heather Place
It is hereby requested that an exception be made to the
city zoning ordinance for the front setback line for a
single-family residence on Lot 2 and part of Lot 1
Goodkind Terrace, St. Paul, Minnesota. The owner wishes
to erect this residence as shown on the accompanying
Plot Plan which indicates a setback of 6 feet.
This setback is determined by the precipitous nature of
the topography, and since reasonable access is only
possible from Heather Place, it is necessary to locate
the building at the Heather Place elevation.
Existing adjoining buildings are located within 3 feet of
the property line on Heather Place as a result of similar
topographic conditions.
We would greatly appreciate your consideration of this
matter at the earliest possible time.
