An ordinance authorizing the issuance of a permit to e
Minnesota Transfer Railway Company, its successors and assigns,
to construct and maintain a track on Wabash Avenue over a
sewer easement. This is an emergency ordinance rendered
necessary for the preservation of the public peace, health and
safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That upon compliance with the conditions herein- .
after set out, the Commissioner of Public Works is authorized
to issue a permit to The Minnesota Transfer Railway Company,
its successors and assigns, to construct and maintain a track
for the purpose of operating cars or trains over the same on
Wabash Avenue over a sewer easement, described in Document 63
as recorded in Miscellaneous, page 113, dated April 21, 1910,
in the office of the Register of Deeds in and for Ramsey
`County, Minnesota, and which sewer was built pursuant to and
under Ordinance No. 9564; that the center line of the proposed
track is described as follows:
Commencing at the point of switch in track No. ,
309 as now laid and operated at a point 206 feet east
of the west line of the north 30 feet of the east 220
feet of the west 844.5 feet, lying between Lot I of
Winstonts Addition and Hollinshead' sAddition in St. Paul,
Minnesota; thence northwesterly 90 feet to a point on
the center line of said north 30 feet; thence west on said
center line 68 feet; thence southwesterly, on a 12 degree
curve to the left, 50 feet; thence southwesterly on a
line tangent to said curve, 22.1 feet to the south line
of the 20 foot sewer easement granted by ordinance No.
2728, dated November 14, 1907.
The conditions are as follows:
1. Permittee shall save said City harmless from �-
any and all liability, judgments, suits, costs, charges,
` damage or expense accruing to person or property, arising
out of the construction, maintenance, use, presence, or
' removal of said track.
2. Permittee shall file plans and specifications
1I for said track with the Commissioner of Public Works,
which shall be satisfactory to him and to the Chief
Engineer of the City of Saint Paul, and said track shall
be constructed asthey shall direct. Permittee will so
construct the track as not to cover existing manholes and
will adjust the manholes to the grade of top of tie of
the track. Permittee shall pay the cost of inspection,
if any.

3. Permittee shall pay the cost of the publi-
cation of this ordinance.
4. This permit may be revoked by the Council
at any time, and thereupon permittee shall remove
said track.
5. Permittee shall, within 10 days after the
publication of this ordinance, file a written
acceptance thereof with the City Clerk.
Section 2. That said track and any addition thereto or
extension thereof shall be used for the purpose of serving
industries now located or to be hereafter located on property
adjacent to or to be served industrially by said track and to be
used by said Railway for other railway purposes.
Section 3. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservaliOn
of the public peace, health and safety.
Section 4. This ordinance shall take effect and be in force
from and after its passage, approval and publication.
