NOTICE OF CONDEMNATION AS
UNFIT FOR HUMAN HABITATION AND
ORDER TO VACATE

The Department of Safety and Inspections, Division of Code Enforcement, has determined that
the dwelling and premises at 418 CURTICE ST E is "Unfit for Human Habitation". In
accordance with Saint Paul Legislative Code, Chapter 34, Section 23, the premises will be
placarded on January 12, 2010 and ordered vacated no later than January 12, 2010.
Your attention is called to the following provisions of Section 34.23, Subsection 6 entitled,
"Vacarion of Structure or Unit":
"Any residential structure or residential unit which has been wndemned or
placarded as unfit for human habitation shall be vacated within the time set forth in
the placard and/or order. It shall be unlawful for any person to let to any person for
human habitation any structure or unit so condemned or placarded, and no person
shall occupy the structure or unit after the date set forth in the placard and/or
notice."
THIS DWELLING SHALL NOT AGAIN BE USED FOR HUMAN HABITATION
UNTIL WRITTEN APPROVAL IS SECURED FROM THE CITY OF SAINT PAUL;
DEPARTMENT OF SAFETY AND INSPECTIONS, DIVISION OF CODE

Princiqle Violations: These deficiencies must be corrected before this condemnation and vacate
order will be removed.
FIRE HAZARD
1. Smoke Detector: Lack of properly installed and operable smoke detector. Provide
functioning smoke detectors.
1. Extension Cord wiring: There is extension cord wiring, running along and attached to
walls, that is being used in lieu of permanent wiring.

maintained in a location within ten (10) feet of each sleeping azea. Installauon shall
be in accordance with manufacturers instructions.
4. Toilet: The toilet must be fully functional and properly connected to the water supply
and sanitary sewer.

5. Refuse and Debris: There is an excessive accumulation of clothing, paper, household
items and refuse in the second floor bedrooms and in the front porch.

7. LIGHT FIXTURE: There is evidence of water leakage that may have damaged the
light fixture in the living room.
8. RECEPACLES: There aze missing receptacle covers.
BATHROOM
9. FT.00R/SUB FLOOR: The floor/sub floor is deteriorated.
10. TOILET: The toilet is loose due to deteriorated floor.
11. FLOOR COVERING: The floor covering is not impervious to water.
GENERAL:
12. CEILINGS: The interior ceilings are defective.
13. WALLS: The interior walls are defective.
14. SPINDLES: The spindles on the stairways to the second floor are loose.
15. BASEMENT STAIRS. The stair treads are defective, loose.
16. REINSPECTION/CODE COMPLIANCE: A completer inspection is not possible at
this time due to an excessive accumulation of household items, refuse and debris.
Further inspection will be required once the dwelling is cleared out.
Other Violations These deficiencies must be corrected in order to bring this property into
compliance with the Saint Paul Legislative Code.
2. GARBAGE AND RUBBISH STORAGE AND REMOVAL: Lack of approved
containers with tight fitting covers. These containers must be of sufficient quantity
and capacity to contain the rubbish and garbage from the unit(s). No rubbish or

garbage may be stored outside in plastic bags. Weekly garbage and rubbish removal
service is required. It is the prooerty owner's resnonsibility to provide containers and
removal service. The Saint Paul L.egislative Code requires occupants to properly
dispose of gazbage and rubbish by placing it in approved containers.
Authorization to reoccupy this/these dwelling unit(s) will not be given until it is demonstrated
that all principat violarions have been corrected and that no new conditions exist which could
constitute material endangerment or which threaten the peace, health, safety or welfare of the
occupants of this building.
All repairs and new installations must be made in accordance with the appropriate codes. Permit
informauon may be obtained from the Building Inspection and Design Section, 375 Jackson
Street, Suite 220, (651) 266-8989.
You may file an appeal to this notice by contacting the City Clerk's Office at (651) 266-8688.
Any appeal must be made in writing within 10 days of the date of this notice.
It is the responsibility of the property owner to keep all buildings secured and to properly
maintain the premises at all times.

Appeal of Alma Adamez-Randle to a Notice of Condemnation and Order to Vacate property
at 418 Curtice Street East
Alma Adamez-Randle, appellant, appeared.
Mr. Essling stated that he received a call from the St. Paul Police Deparhnent on January 12, 2010
to inspect the property and found the conditions such that he condemned the building with an
immediate vacate. The owner then filed an appeal and due to the holiday on January 18, he had not
been able to re-inspect the property to see what progress had been made. He said he would like to
hear from the appellant and schedule a re-inspection.
Ms. Moermond asked who else lived at the property. Ms. Adamez-Randle responded that she lived
with her husband, her 15 year-old son, and 27 year-old stepson. She explained that she had grown
up in this house and had moved back in 2000 to take care of her ailing father after her mother had
passed away. She said her father had passed away in September 2009 and there had been a family
feud ever since as her father had given title of the property to her. Her siblings were contesting her
ownership and brought charges against her for exploitation of a wlnerable adult. As a result, she
had been ardered not to dispose of any personal belongings of either her father or mother which
were in the home. Since the property had been condemned, she had ardered a dumpster and began
throwing things out. She had also donated clothing to Goodwill. She said she now had the required
smoke detectors and carbon monoxide detectors installed and operating. She claimed that the
extension cord had been used for an air conditioner which was no longer being used. She said the
upstairs toilet had overflowed and caused water damage to the ceiling, walls and light fixtures
below. The plan was to replace the subflooring in the bathroom as well as to repair the ceiling,
walls and light fixture.
Mr. Essling stated that he would like to re-inspect the property on Monday, January 25 and if
progress had been made, he would consider lifting the condemnation and issuing a correction
notice.
Ms. Moermond agreed with Mr. Essling that he re-inspect the property on January 25 and if the
principle violations, items 1-6, have been remedied, he could lift condemnation and issue a
correction notice to complete the repairs; however, the owner must submit a work plan with
timelines for completing the work. She continued the hearing to January 26, 2010.

Mr. Magner stated that according to Inspector Essling, he inspected the property on Januazy 25,
2010. Ms. Adamez-Randle had obtained a roll-off dumpster and had emptied and cleaned the entire
house. All of the items on the condemnation had been corrected with the exception of items 4, 12,
13 and 15. Conceming item 4, the plumbing, Ms. Adamez-Randle had obtained an estimate in the
amount of $3,200 to do the work. She would like to obtain one more estimate before choosing a
licensed contractor to do the wark. A work plan to complete the remainder of the repairs was
agreed to and is as follows: 1) the damaged soil stack shall be repaired under permit by February 5;
2) the bathroom floor must repaired or replaced, under permit if required, by February 22; and 3)
the dining room floor and wall, and the basement stairs must repaired, under permit if required, by
March 8. Inspector Essling recommended lifting the condemnation and issued a conection notice
for the above-aforementioned items.
Ms. Moermond recommended denying the appeal; however, it was moot since DSI lifted the
condemnation and issued a correction notice to make the remainder of the repairs.
