A Resolution requesting the Charter Commission to review and recommend amending Charter Section
5.03 regazding the Office of the City Attorney by ordinance pursuant to Minnesota Statutes § 410.12, subd.
7 (2009).
5 WHEREAS, Section 5.03 of the Charter, effective in 1972, provides that the City Attorney may
6 appoint two deputy assistant city attorneys; and

8 WHEREAS, in the intervening years, for sound management reasons, the Office of the City
9 Attorney is now organized into three divisions; and
10
ll WHEREAS, each of these three divisions would be best managed by a deputy city attorney, but the
12 Charter limits the City Attorney to two deputies; and
13
14 WHEREAS, the City Attorney has recommended that one deputy be designated Chief Deputy to
15 reflect the office-wide responsibilities of one deputy; and
16
17 WHEREAS, the Council and Mayor wish to amend Charter Section 5.03 regarding the Office of
18 the City Attomey to allow three deputies, one of which may be designed a chief deputy; and
19
20 WIIEREAS, pursuant to Minnesota Statutes § 410.12 subd. 7(2009) p:ovides that upon
21 recommendation of the Charter Commission they City Council may enact a charter amendment by
22 ordinance adopted unanimously and approved by the Mayor.

24 NOW THEREFORE BE IT RESOLVED, that the Council and Mayor requests that the Charter
25 Commission review the proposed ordinance (attached) and recommend amending Charter Section 5.03
26 regarding the Office of the City Attorney by ordinance pursuant to Minnesota Statutes § 41012, subd. 7
27 (2009), to allow the City Attorney to have three deputies, one of which may be designated a chief deputy.

An ordinance pursuant to Minnesota Statutes § 410.12, subd. 7(2009) amending Charter
Section 5.03 regarding the Office of the City Attorney.
The Council of the City of Saint Paul does Ordain:
Section i.
Pursuant to Minnesota Statutes § 410.12 subd. 7(2009), on , 2010,
the Saint Paul Charter Commission recommended to the City of Saint Paul that a certain
charter amendment, as more fully stated below, be made by ordinance. Public notice has
been given and a public hearing has been held according to law. The Council of the City
of Saint Paul, by unanimous vote, hereby amends Charter Section 5.03 as follows:
Section 2.
Sec.5.03. Staff.
The city attorney may appoint t�E�) three 3 deputy assistants, one of whom
may be designated the chief deputv, and such other assistants as in the city
attorney's judgment are needed to carry on the legal business of the city. The
deputy assistants and other assistants shall be in the unclassified service. The
deputy assistants shall hold office at the pleasure of the city attorney, and the
other assistants shall be removable at pleasure during their first year of service,
but shall not thereafter be discharged except in the manner provided by
administrative ordinance for employees in the classified service.
Section 3.
This ordinance shall take effect ninety (90) days after passage, approval and publication.
