RESOLVED, that upon appeal of Standard Oil Company,
et al. from the decision of the Commissioner of Parks, Playgrounds
and Public Buildings, and upon the favorable recommendation of
the Board of Zoning, the commercial use authorized on a portion
of Lot 3, Block 3, Ware & Hospets Rearrangement "A" of Ware &
Hospets Addition, is hereby extended to the entire lot, and the
commercial use authorized on a portion of Lot 4, Block 3, Ware
& Hospets Rearrangement "A" of Ware & Hospets Addition, is hereby
extended to the entire lot, and permission is hereby given to the
owner of each such lot to devote the same in its entirety to
commercial use, with the same, intent, purpose and effect as if
each said lot had been entirely classified under Building Zone
Ordinance No. 5840, as amended, in a Commercial District.

appeal of Standard Oil Co. for extension of commercial use to cover all
of Lots 3 and 4, Block 3, Ware and Hospe's Rearrangement "A" of Ware and
Hospe's Addition, at the northwest corner of Dale and Como, pursuant to
facts set forth in appeal dated August 16, 1956.

Dear Sir:
This is in the matter of the appeal of the Standard Oil Company for permission
to extend an existing commercial use to cover all of lots 3 and 4, block 3,
Ware & Hospe's Rearrangement "A" of Ware & Hospe's Addition. The zoning on
these two lots is "C" residence.and "Commercial." In conjunction with this
appeal, the Standard.Oil Company is Also applying for a permit to rebuild an
existing filling station on these premises. This property is located adjacent
to the Northwest corner of Dale & Como and is described as lots 1, 2, 3, and
4 - block 3 - Ware & Hospe's Rearrangement "A" of Ware & Hospe's Addition.

Lots 1 and 2 of this property are zoned "commercial": lots 3 and 4 are zoned
"commercial" and "C" residence. In order to carry out the objectives of the
applicant's.plans.for remodeling and rebuilding this existing filling station,
they desire to use all of lots 3 and 4 as well as lots 1 and 2 for commercial
purposes. Therefore, they are appealing pursuant to Section 5, paragraph !!f"
of the Zoning Ordinance under which the Council may permit - in cases of lots
in single ownership which are divided by a Use District boundary liner the
extension of a use to apply to the entire lot.
The applicant's plans are in accordance with the existing standards and have j
been approved by the Traffic Engineer. Field investigation discloses no
objection from the standpoint of adjacent land use or traffic.
In consideration of these factors, the Zoning Board recommends that this appeal 1
to permit the use of all of lots 3 and 4, Ware & Hospe's Rearrangement "A" of
Ware and Hospe's Addition for commercial purposes be granted. . .
The Zoning Board also recommends that the application for a permit to rebuild !
an existing filling station on the above premises be granted, all in accordance
with the applicant's plans approved October 4, 1956, and pursuant to the facts
which are more particularly set forth in the applicant's appeal dated August
16, 1956.

The undersigned, Standard Oil Co. and Everel R. Belson appeal under
the Building Zone Ordinance #5840, with amendments as of January 26,
1954, Article #5, Section 20, Paragraph A, with respect to zoning
commercial 100% of the following described land and furnish the
following information in that connection.
A. Name of Applicant - Standard Oil Company and Everel R. Nelson.
B. Legal Description of property - Lot four (4) Ware and Nospes Re-
arrangement "A". (Record ownership in name of Everel R. Nelson).
C. Street Location - 637 Como Ave. N.W. corner Como Ave & Dale Street,
St. Paul.
D. Present use of property - Residence and home of Everel R. Nelson.
E. Proposed use of property: To be used as additional property in
connection with the extension and use of present service station
on Lots 1, 2 and 3 Ware and Hoopes Rearrangement "A". See attached
layout of new station re-located on this combined. property.
F. Purpose of appeal - To change present zoning from Residential to
Commercial where applicable.
G. Need of the Appeal - To accommodate new building and expand property.
H. It appears that said Lot four (4) and the adjoining property to the
west are zoned commercial as follows:
Lot four 4) - 95% (40 feet on Como Avenue)
Lot five 5) - 6096 4O feet on Como Avenue
Lot six 6) - 5% k0 feet on Como Avenue;
That the present service station on said lots 1,2 and 3 having a frontage
of 146.15 feet on Ccmo Avenue by 189.97 feet on Dale Street by 29.53 feet
on alley has been an operating service station since 1922.

Therefore, undersigned request appropriate action be taken so that
all of pots 1,2,3 and Ware and Rospes Rearrangement "A" be properly
classified and zoned as commercial so as to permit of the continued
operation and maintenance of a gasoline filling station.
