RESOLVED, by the Council of the City of Sain
Paul, upon due consideration of the report of the Commis loner
of Public Works and being otherwise fully advised in the
premises, that it satisfactorily appears and the Council
hereby finds that all necessary rights and easements for the
purposes of constructing, maintaining and enlarging sewe .s
and appurtenances reserved or granted unto the City of S-int
Paul, by or pursuant to City of Saint Paul Ordinance No. 3925,
approved July 5, 1917, in real estate of Twin City Belt
Railway Company, have been exercised and the purposes of the
same as contemplated by said Ordinance will be fully acc.mplished
without the exercise of any such right or easement in the follow-
ing described read estate constituting a fractional part of
that affected by said Ordinance No. 3925, subsequently con-
veyed by said Twin City Belt Railway Company to John E.
Blomquist, and situate in the City of Saint Paul, County of
Ramsey, State of Minnesota, to-wit :
The South Ninety (90) feet of the North
five hundred sixty-three (563) feet of
the East two hundred (200) feet of that
part of government lot number one (1)
lying West of the West line of Clarence
Street, Section 22, Township 29 , Range
22, according to the government survey
thereof on file and of record in the
Office of the Register of Deeds in and
for Ramsey County, Minnesota.
RESOLVED, FURTHER, that no such right or easement
so reserved or granted unto said City of Saint Paul aff .cting
said parcel of real estate conveyed as aforesaid by sai.
company to said John E. Blomquist,- is necessary for any
purpose or use of said City, and each thereof constitut=s
an undue cloud upon the title of said last mentioned parcel
of real estate, and should be removed therefrom.

RESOLVED, FURTHER, that each such right or easement
so reserved or granted unto said City of Saint Paul in said
hereinabove described parcel of real estate conveyed as
aforesaid by said Twin City Belt Railway Company to said
John E. Blomquist hereby is released,and that henceforth,
said City shall be deemed to hereby disclaim any such right
or easement therein for the constructing, maintaining or
enlarging of sewers or appurtenances thereto which may have
been heretofore reserved or granted to said City under or
pursuant to said Ordinance No. 3925; provided, nevertheless ,
that said City reserves all rights and easements in respect
of its constructing, maintaining and enlarging of sewers and
appurtenances within any public street or public way contiguous
or adjacent to said parcel of real estate, that conveyed as
aforesaid by said company to said John E. Blomquist, and
all other rights and easements reserved or granted by or
unto said City under or pursuant to said Ordinance No. 3925.

Dear Mr. Sheehan :
In keeping with our conference of yesterday, I will now
give you the details which I consider important in connection
with the obtaining of a waiver from the City of St. Paul of
residue rights vested in it, in certain property, by virtue
of an agreement of the Twin City Belt Railway Company.
On August 7, 1956 I examinee title to a parcel of land
legally described as follows :
"The South ninty (90) feet of the North five
hundred sixty-three ( 63) feet of the East two
hundred (200) feet 4n -' that part of government
lot number one (1) lym West of the `Vest line
of Clarence Street, Section 22, Township 29,
Range 22. "
This property was sold to John E. Blomquist by the Twin City
Belt Railway Company subject to the right of the City of St.
Paul to use any of the property, described in the deed to
Blomquist, for the purpose of constructing, maintaining and
enlarging sewers, as provided in Section 8 of Ordnance number
3925, passed by the City Council July 5, 1917.
I made inquiry And found that the sewers had been installed
and assumed that, as far as our pi6ce was concerned, the sewers
had been installed and that there would be no further deman as
against that particular parcel. However, application for title
insurance has been refused because of the unfortunate wordi g
which gave the City of St. Paul the right to use any of the
property for sewer purposes, indicating that the city may, at
any time, step in and claim rights in and to every part of the

tract of land involved. I do not agree with this contention
but the other fellow is in the "driver' s seat" so I am oblig.d
to do something to remove the obstruction to the title so that
his loan can be completed and his construction bills paid. I
believe that you indicated yesterday that a resolution could be
adopted by the City Council waiving any claim against the pa eel
of property above described if the Engineering Department inf• i-
cated that all necessary demands for sewer had been filled. I
would appreciate your early attention to this matter so that I
can take a certified copy of the action of the City Council < o
the St. Paul Abstract Company and obtain the relief neeessar,+ for
my client.
I neglected to say that the parcel of land lies entire/,4
West of the West line of Clarence Street and that the sewer ' s
in the street in front of my clientl'a land.
