An ordinance authorizing the issuance of a permit to the Northern Pacific Railway Company, its successors and assigns, to construct and maintain one switch track over an unused corner of the Stadium property. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That upon compliance with the conditions hereinafter set out, the Commissioner of Public Works is authorized to issue a permit to the Northern Pacific Raiiw. Company, its successors and assigns, to construct and main ain one switch track over the following described property: A tract of land, all in the City of Saint Paul, County of Ramsey and State of Minnesota, to-wit: All those parts of the Southwest quarter (SW*) of the Northeast quarter (NEB) and the Northwest quarter (NWk) of the Southeast quarter (SEt) of Section Twenty-seven (27), Township Twenty-nine (29) North, Range Twenty-three (23) West, Fourth Principal Meridian, bounded by the following described lines: Commenting, for the purpose of establishing the point of beginning, at the Northwest corner of the ;� . Southeast quarter (SEt) of Section 27, thence • ;-, south on the west line of the said Southeast quarter (SEt), a distance of fifty (50) feet to a point; thence east on a line parallel to and fifty (50) ((\\\ feet south of the north line of the aforesaid Southeast quarter (SEt), a distance of one hundred forty one and ninety seven one hundredths (141.97) feet to a point, which point is the point of' beginnin:; thence east on the prolongation of the aforesaid line parallel to and fifty (50) feet south of the north line of the said Southeast quarter (SEt) of Section 27, a distance of one hundred forty five (145) feet to a point; thence in aonortherly direction at an angle to the left of 89 -25 '-30", a distance of ninety five (95) feet to a point; thence in a southwesterly direction in a straight line to the point of beginning; for the purpose of facilitating the operation of their track in this area. The conditions are as follows: 1. Permittee shall save said City harmless from any and all liability, judgments, suits, costs, charges, damage of expense accruing to person or property, arising out of the construction, maintenance, use, presence, or removal of said switch track. 3. This permit may be revoked by the Council at any time, and thereupon permittee shall remove said track. 4+. Permittee shall pay the cost of publication of this ordinance. 5. Permittee shall, within ten days after the publi- cation of this ordinance, file a written acceptance thereof with the City Clerk. Sec. 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Sec. 3. This ordinance shall take effect and be in fo ce upon its passage, approval and publication.
