Resolution Ratifying Assessment — 10-128 — In the matter of the assessment of benefits, cost, and expenses for weekly garbage hauling services from September 23 to November 18, 2009 at 1999 Itasca Avenue. [J0923G] (GS 3094896-Ward 3) (Legislative Hearing Officer recommends reducing the assessment from a total of �575.00 to a total of $288.00) Adopted as amended, per the recommendation of the Legislative Hearing Officer Yeas — 6 Nays — 0 December 1, 2009 Legislative Hearing Minutes 1999 Itasca Avenue (J0917G) 10-128 Page 10 Ms. Seeley stated orders were sent on August 26, 2009 to provide proof of garbage hauling service at the property with a compliance date of August 26. The property was re-inspected on September 2 and the owner had failed to provide proof of service. A work order was sent to Parks who dropped off a container and began weekly garbage service on September 9, 2009 for a total assessment of $225. There were nine additional weeks of hauling service at this property before the owner provided proof of service and the container was removed by Pazks. Macrina Cassidy, property owner, stated that she never received any complaint and provided Ms. Moermond with a copy of the letter indicating that she needed to provide proof of trash hauling service at the property. She claimed the letter was vague, did not indicate it was a complaint, and she never received any phone call from any inspector concerning a complaint. She said her tenant was responsible for trash service and when she called Waste Management, she was told they were not providing service at the property. She now had Highland Sanitation as of November 18. She did not believe she should be responsible for the city providing trash service at her property. Ms. Seeley indicated that the letter to provide garbage service at the property was mailed to the owner and a copy was also left in the door. There was no returned mail. Ms. Moermond recommended approving this assessment and recommended reducing all future assessments for garbage hauling service at this property by half. Per Tanya, Real Estate, there are five future assessments for garbage hauling service at this property in the total amount of $575.
