1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a rivo-story, wood frame single family home and its two-stall detached wood
4 frame garage located on property hereinafter referred to as the "Subj ect Property" and commonly
5 known as 947 ST. ANTHONY AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before Apri120, 2009, the
following are the now lrnown interested or responsible parties for the Subject Property: Susan E.
Gallagher, 267 Smith Ave N, St Paul, MN 55102; Wilford & Geske, PA 8425Seasons Parkway,
#105, Woodbury, MN 55125; Wells Bank NA Attn: Jeremy Aammann, 1 Home Campus, Des

WHEREAS, Department of Safety and Inspections has served in accardance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated November 12, 2009; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subj ect Property is a nuisance building(s) pursuant to Chapter 45; and
WHEI2EAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by December 14, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condirion; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held befare the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, January 12, 2010 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
February 3, and 17, 2010 and the testimony and evidence including the action taken by the
Legislative Hearing Officer was considered by the Council; now therefare
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 947 ST ANTHONY AVE .
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollaxs ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lmown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficienoies causing this nuisance condition ha�e not been corrected.
6. That Department of Safety and Inspecrions has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Deparhnent of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

and removing the structure in accordance with all applicable codes and ordinances. The
.�.'�°�an�i demolition and removal of the structure must be completed within
fifteen (l5) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Depariment of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

3. Ordering the owner to remove or repair the building(s) at 947 St Anthony Avenue within
fifteen (15) days from adoption of resolution.
David Mortensen, attorney with Wilford & Geske, appeared on behalf of Wells Fargo Bank, the
mortgage company. The property owner of record, Susan Gallagher, did not appear.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two-
story, wood frame, single-family dwelling with a detached two-stall gazage on a lot of 4,792 square
feet and had been vacant since April 19, 2005. A code compliance inspection had not been, the
vacant building registration fees in the amount of $1,000 went to assessment on Apri129, 2009, and
the $5,000 performance bond had not been posted. On October 30, 2009, an inspection of the
building was done and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on November 12, 2009 with a compliance date of
December 14, 2009. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Itamsey County Taxation estimated the market value of the land
to be approximately $15,500 and the building to be $103,600. Real estate taYes were. Code
Enforcement estimates the cost to repair the building to exceed $75,000. The cost for demolition
was estimated to exceed $10,000. There had also been 24 summary abatements issued to this
property since 2005, 23 of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stared refuse and debris,
boarding/securing, cut tall grass and weeds, and remove snow and ice. Code Enforcement
recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1910 as a worker's cottage-style building with clapboard siding. This property was not surveyed as
part of the 1983 survey but she believed it was likely had been surveyed as part of the Central
Corridor when I-94 was built. The property was not located in any potential historic district and she
did not believe demolition would have an adverse effect on the neighborhood.
Mr. Mortensen stated that there were issues concerning the foreclosure process. In 2008, Wells
Fazgo commenced foreclosure proceedings and the property owner then filed a mortgage rescission
law suit which was pending for approximately the last one and one-half years. There was a
settlement conference whereby Wells Fargo was set to take back possession of the property;
however, the borrower then disappeared. Since that time, they were attempting to again commence
the foreclosure proceedings. He said his client was willing to obtain the code compliance
inspection and to make repairs to the property. They had lured a contractor who was attempting to
get into the property for inspection. He was requesting an extension of time to be able to get the
code compliance inspection done, to obtain a bid from the contractor on the estimated cost of the
repairs and to work on the foreclosure proceedings.
Ms. Moermond asked about the history of the sununary abatement orders. Mr. Magner stated that a
work order was sent to Pasks as recent as December 10, 2009. It appeared from STAMP that the
siumnary abatement orders were consistently issued since the vacant building file was opened in
Apri12005 but activity was increased in 2007.
Ms. Moermond asked Mr. Mortensen what his client planned to do to maintain the property. Mr.
Mortensen responded that since the foreclosure proceedings had been stalled and there was no

redemption period in process, they were not in a position to maintain the properiy. Ms. Moermond
expressed concern that the mortgage company had not taken responsibility for maintaining the
property and questioned their ability to undertake the rehabilitation.
Mr. Mortensen asked whether the mortgage company had been receiving the sunmiary abatement
orders. Mr. Magner responded that it appeared most of the abatement orders had been sent to Susan
Gallagher. He said that the department would not obj ect to continuing this matter allowing time for
the mortgage company to come up with a plan of action. He asked what had been done to date to
begin the foreclosure pxocess on the property and whether a notice of pendency had been filed.
Mr. Mortensen responded that he did not believe so. He believed that because the building was
vacant, they could shorten the redemption period to five weeks at the time of the sheriff sale and
believed this would likely take two to three months. He said he also believed that his client would
be willing, in the meanrime, to undertake making repairs to the property under these circumstances.
Mr. Magner asked whether the mortgage company would be willing to undertake that liability if the
property owner then came back during the redemption period and redeemed the property. He said
they may not even want to make repairs to the property and instead allow it to be demolished. Mr.
Mortensen responded that he understood the concerns; however, his client would like the
opportunity to get into the property to determine the extent of the necessary repairs so they can
make an informed decision.
Ms. Moermond stated that the following conditions must be met by February 2: 1) apply to shorten
the foreclosure redemption time period; 2) hire a conshuction contractor to go through the building
to assess the amount of required repairs; 3) apply far the code compliance inspection; 4) post the
$5,000 performance bond; 5) submit foreclosure documentation; and 6) the property must be
maintained. If these conditions are met, recommend continuing the Legislative Hearing to February
23 and the Council Public Hearing to March 17.

6. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler and
make any necessary repairs. Perform a C/O test on the heating plant. Then, send the attached
form back to the Inspector. Repair of gas fired appliances requires a permit. (Water heater not
property vented)
7. All interior and exterior: DEFECTIVE STAIRS. Stairs are broken, defective, ar in
disrepair. Repair in a professional manner.
8. Remove all mold.
9. Interior & Exterior: There are missing or defective guardrails. Provide all stairways,
porches, decks or steps which are more than 30" high with guardrails and intermediate rails with
openings in the guardrail no more than four (4) inches apart and in accordance with the State
Building Code.
10. Interior & Exterior: The stairs have missing or defective handrails. Provide all interior and
Exterior stairways and steps of more that three (3) risers with handrails which aze grippable and
installed 34" to 38" above the nose of the stair treads.
1 I. The interior ceilings are defective. Repair all ceiling defects and finish in a professional
manner.
12. The interior walls are defective. Repair all wall defects and finish in a professional manner.
13. Sleeping room does not meet light, ventilation or escape requirements. Stop this use of this
room ar repair to meet sleeping room requirements.
14. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the door(s).
15. The windows and/or storm windows are in a state of disrepair. Replace all missing or
broken window glass. Make all necessary repairs to frames, sashes, hardware and associated
trim in a professional manner. Permit may be required.
16. The window and/or door screens are missing, defective or in a state of disrepair. Provide
proper window and door screens for all openable windows and doors. Screens must be tight-
fitting and securely fastened to the frames.
17. Repair/Replace all loose electrical wires - Permit Required - Hire a licensed electrician.
18. Hire a licensed plumber to repair/replace broken radiatars
19. Remove all urine and feces from each bedroom and basement.
20. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes,
breaks, loose ar rotting boards, to a professional state of maintenance. Permit may be required.
21. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof
covering to a sound, tight and water impervious condition. Permit may be required.
22. YARD: The yard lacks proper ground cover. Seed, ar sod, where needed.
23. GARAGES AND ACCESSORY STRUCTURES. All garages and accessory structures
must be in sound condition and secure from unauthorized entry. Repair or replace any missing
doors, windows, or hardware for same.
24. Due to the number of deficiencies, a Code Compliance Inspection wi11 be required before a
Placard Lift wiZl be issued.
25. The dwelling unit is over-occupied. No more than four (4) unrelated adults may occupy the
dwelling. Authorization to reoccupy this/these dwelling unit(s) will not be given until it
demonstrated that all principal violations have been corrected and that no new conditions exist
which could constitute material endangerment or which threaten the peace, health, safety or
welfare of the occupants of this building.

ORDER:
Repair the structure to a habitable condition.
This structure is a registered vacant building that must have a Code Compliance Certificate
before the structure may be occupied.
Obtain a Code Compliance Certificate from the Depariment of Safety and Inspections. You
may contact Jim Seeger at 651-266-8989, for a code compliance inspection, permits, and
issuance of the Code Compliance Certificate.
Under Chapter 33.03 of the Saint Paul Legislative Code, failure to obtain a Code Compliance
Certificate before occupying the structure may result in issuance of criminal summonses.
As owner, agent ar responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by December 14, 2009 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Department of Safety
and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Deparhnent of Safety and Inspections,
Division of Code Enforcement. The deparhnent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.

If corrective action is not taken within the time specified in this order, the Enforcement Officer
will norify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings befare the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if correcrive action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.
