1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story, wood frame single family dwelling located on property
4 hereinafter referred to as the "Subject Property" and commonly lrnown as 1163 ROSS
5 AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before August 3, 2009, the
following are the now known interested or responsible parties for the Subject Property: John and
Karen Brancamp, 700 Chapel Street, Columbus, WI 53925-1134; Usset, Weingarden & Liebo
PLLP, 4500 Park Glen Road, Suite 300, Minneapolis, MN 55416; Chase Home Finance LLC,
3415 Vision Drive, Columbus, OH 43219-6009; Dayton's Bluff District 4 Community Council;
and
W�IEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, 25
Fourth Sh W, St Paul, MN 55102, purchased the property on January 14, 2010; and
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated November 9, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by December 9, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule pubfic hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, January 12 and January 26, 2010 to hear testimony and evidence,

and after receiving testimony and evidence, made the recommendation to approve the request to
order the interested or responsible parties to make the Subject Property safe and not detrimental
to the public peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure in accordance with all applicable codes and
ordinances, or in the alternative by demolishing and removing the structure in accordance with
all applicable codes and ordinances. The rehabilitation or demolition of the structure to be
completed witlrin three hundred sixty-five (365) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
February 3, 2010 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1163 ROSS AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent tQ the then lrnown
responsible parties to correct the deficiencies ar to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Deparhnent of Safety and
Inspections, VacantlNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternarive by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within three
hundred sigty-five (365) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Deparhnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
persona] property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.

The property was re-inspected on December 1, 2009. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting influence of this
pmperty. It is the recommenda6on of the Department of Safety and Inspections that the City

remove this building in a timely manner, and failing that, authorize the Department of Safety and

The building is a one story, wood frame, single-family dwelling on a lot of 7,405 squaze feet.
According to our files, it has been a vacant building since February 19, 2009.
The current property owner is John & Karan Brancamp per AMANDA and Ramsey County
Property Records. (Note: Vacant Building Registration Form — Chase Home Finance CLC)
The city has had to board this building to secure it from trespass.
There have been seven (7) SUMMARY ABATEMENT NOTICES since 2009.
There have been six (6) WORK ORDER(S) issued for:
- Boarding(Securing
- Improperly stored refuse, garbage and misc debris
On October 27, 2Q09, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on November 9, 2009 with a compliance date of
December 9, 2009. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated mazket value of $27,200 on the land and $96,000 on the
building.
As of December 15, 2009, a Code Compliance Inspection has been completed.
As of January 7, 2010, the $5,000.00 performance bond has not been posted.

Dear Sir & Madam:
The Vacant/Nuisance Buildings Unit, Department of the Department oF Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
1163 ROSS AVE
and legally described as follows, to wit:

STATE OF MINN. EX W 40 FT LOT 21 AND ALL OF LOT 22 BLK 4
to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On October 27, 2009, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.
This is a one and one-half story, wood frame single family dwelling.

The chiinney is defective, deteriorated or in a state of disrepair. Replace all missing or
defective bricks, tuckpoint as needed to restore the chimney to a professional state of
maintenance and repair. Permit may be required.
2. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes,
breaks, loose or rotting boards, to a professional state of maintenance. Permit may be
required.
3. The exteriar wa11s and/or trim of the house and/or garage has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a
sound condition in a professional manner.
4. The roof is deteriarated, defective, or in a state of disrepair. Repair or replace the roof
covering to a sound, tight and water impervious condition. Permit may be required.
5. The window and/or door screens are missing, defective or in a state of disrepair.
Provide proper window and door screens for all openable windows and doors. Screens
must be tight-fitting and securely fastened to the frames.
6. The windows and/or storm windows are in a state of disrepair. Replace all missing or
broken window glass. Make all necessary repairs to frames, sashes, hardware and
associated trim in a professional manner. Permit may be required.
7. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler
and make any necessary repairs. Perform a C/O test on the heating plant. Then, send
the attached form back to the Inspector. Repair of gas fired appliances requires a permit.
The interior ceilings are defective. Repair all ceiling defects and finish in a professional
manner.
9. The interior walls are defective. Repair all wall defects and finish in a professional
manner.
10. There is evidence of a rodent infestation. Immediately exterxninate and eliminate all
rodents from the entire building. Remove rodent harborages in the yard areas.
Tuckpoint the foundation if necessary to rodent-proof the building Yo prevent
re-infestation. Immediately remove any dead rodents from the premises.
11. SANTTATION: Immediately remove improperly stored or accumulated refuse
includang; gazbage, rubbish, junk, vehicle parts, wood, metal, recycling materials,
household items, building materials, rubble, tires, etc., from yard. The Saint Paul
Legislative Code requires all exterior property areas to be maintained in a clean and
sanitary condition. Usable materials must be stored in an approved manner, so as not to
constitute a nuisance.

12. Lack of Water Service. Immediately restore water service. Failure to provide water
service will result in these premises being declared Unfit for Human Habitation and
ordered vacated for lack of this basic facility.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by December 9, 2009 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property tases as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If Chis building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Department of Safety
and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditaons haue been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolirion and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is fixrther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If conective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates far Public Hearings before the City Council at which time tesrimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls far abatement action the Council may either order the City to take the
abatement action ar fix a tune within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if correcrive action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

The following is the Code Compliance report you requested on Noveznber 24, 2009.
Please be advised that this report is accurate and correct as of the date December 23, 2009.
All deficiencies identified by the City after this date must also be corrected and all codes and

2• Ordering the owner to remove or repair the building(s) at 1163 Ross Avenue within fifteen
(15) days from adoption of resolution.
The property owner of record, John and Kazen Brancamp, did not appeaz. No other parties of
interest appeared.
Mr. Ma�er stated the building was a one story, wood frame, single-family dwelling on a lot of
7,405 square feet and had been vacant since February 19, 2009. A code compliance inspection had
been done on December 15, 2009, the vacant building registration fees were current, and the $5,000
performance bond had not been posted. On October 27, 2009, an inspection of the building was
done and a list of deficiencies which constitute a nuisance condition was developed. An order to
abate a nuisance building was posted on November 9, 2009 with a compliance date of December 9,
2009. To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Taacation estimated the market value of the land to be
approximately $27�00 and the building to be $96,000. Real estate taxes were current. Code
Enforcement estimates the cost to repair the building to exceed $3Q000. The cost for demolition
was estimated to exceed $12,000. There had also been seven suminary abatements issued to this
property since 2009, six of which went to wark arder: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse and debris, and
boarding/securing. Code Enforcement recommends the building be repaired or removed within 15
days. Mr. Magner presented photographs of the property and noted that the Vacant Building
Registration form was filed by Chase Home Finance LLC.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1900 and was a bungalow-style building. The two block faces were intact with this property being
located on top of a hill. It was not located in any potential historic district and had not been
surveyed. She encouraged rehabilitation given the block faces and rhythm of the neighborhood.
Ms. Moermond reviewed the photographs and expressed concern with the condition of the boiler
given the amount of rust. Mr. Magner responded that it appeared there was a lot of deterioration
where the flu pipe connected which appeared worn thin which could seep gas. He also concurred
that there was a lot of rust on the boiler which would require it to be tested by a licensed contractor
to determine whether it was safe.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.

Ms. Moermond stated that she was contacted by Cindy Cazlson after the legislative hearing who
indicated that the HRA had just purchased the property and would like to rehabilitate the building.
Since she did not indicate how much time they may need, Ms. Moermond stated that she will
recommend continuing the Council Public Hearing to March 3 in order for the HRA to come up
with a timeline for completing the repairs.
