RESOLUTION
MINNESOTA
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one and one-half story, wood frame single family dwelling located on property
hereinafter referred to as the "Subject Property" and commonly lrnown as 1662 MINNEHAHA
AVENUE EAST. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recarder's Office and
information obtained by Department of Safety and Inspections on or before August 3, 2009, the
following are the now known interested ar responsible parties for the Subject Property:
Mortgage Elec Reg Systems Inc c/o Litton Loan Services LP, 4828 Loop Central Drive,
Houston, TX 77081-2166; Wilford & Geske, PA, 8425 Seasons Parkway, #105, Woodbury, MN
55125; District 1 Community Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated November 13, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subj ect Property by December 14, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, January 12, 2010 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

health, safety and welfaze and remove its blighting influence on the community by demolishing
and removing the structure in accordance with all applicable codes and ardinances. The
demolition of the structure to be completed within fifteen (15) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
February 3, 2010 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 1662 MINNEHAHA AVENiJE EAST.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollazs ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then laiown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structure in �.
accordance with all applicable codes and ordinances. The demolition and removal of the j
structure must be completed within fifteen (15) days after the date of the Council
Hearing.
If the above conective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

of this property. It is the recommendation of the Deparhnent of Safery and Inspections that the

remove ihis building in a timely manner, and failing that, authorize the Department of Safety and

The building is a one and one-half story, wood frame, single-family dwelling on a lot of 4,792
square feet.
According to our files, it has been a vacant building since September 18, 2008.
The current property owner is MERS, c/o Litton Loan Servicing, LP per AMANDA and
Property Tax Records.
There have been six (6) SUMMARY ABATEMENT NOTICES since 2008.
There have six (6) WORK ORDER(S) issued for:

Dear Sir or Madam:
The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On October 29, 2009, a Building Deficiency Inspection Report was compiled and ffie following
conditions were observed.
This list of deficiencies is not necessarily all the deficieucies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Cerfificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or the
plumbing system may necessitate updating or upgrading the systems involved.
This is a one and one-half story, wood frame single family dwelling.

BUILDING
l. Remove all insulation and wall board from basement walls and have inspected before
framing and insulation is installed.
2. Remove green board from exterior walls and ceiling in second floor and basement
bathroom.
3. Remove trees from west side of house and properly line behind retaining wall.
4. Rebuild retauung walls with proper plans, permits and inspections.
5. Properly install flashing on chimney.
6. Replace steps to code at exterior entrance to house.
7. Insure basement cellar floor is even, is cleanable, and all holes are filled.
8. Install handrails and guazdrails at all stairways, including basement stauways, per
attachment.

dwelling.
13. Provide thumb type dead bolts for all entry doors. Remove any surface boits.
14. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc.
as necessary.
15. Provide complete storms and screens, in good repair, for all door and window openings.
16. Repair walls, ceilings and floars throughout, as necessary.
17. Where wall and ceiling covering is removed install full-thickness or code-specified
insulation.
18. Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedure if lead base paint is present (See 5t. Paul Legislative Code, Chap. 34 for
additional information).
19. Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly, door
and window openings that aze not headered, etc.) are to be reconstructed as per code.
20. Provide general clean-up of premise.
21. Provide smoke detectors per the Minnesota Building Code and carbon monoxide
detectors per State law.
22. Repair siding, soffit, fascia, trim, etc. as necessary.
23. Provide weather-sealed, air-sealed, and vermin-sealed exterior.
24. Provide proper drainage around house to direct water away from foundation.
25. Maintain 6 inches minimum clearance between wood and soil, sloped to drain away from
foundarion.
26. Install downspouts and a complete gutter system on east side of house.
27. Install rain leaders to direct drainage away from the foundation.
28. Weather-seal exterior doors.
29. Dry out basement and eliminate source of moishu
30. Remove mold, mildew and moldy or water-damaged materials.
31. Install water-proof enclosure in shower azea.
32. Provide adequate access, ventilarion and clearance in crawl space area.

ELECTRICAL
1. Crround the electrical service to the water service with a copper conductor within 5' of the
entrance point of the water service.
2. Bond around water meter with a copper wire sized for the electrical service per Article
250 of the NEC.
3. Provide a complete circuit directory at service panel indicating location and use of all
circuits.
4. Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen
appliance circuit.
5. Verify that fuse/circuit breaker amperage matches wire size.

14. Remove and/or rewire all illegal, improper or hazardous wiring in basement/ garage.
I5. AZI added receptacles must be grounded, tamper-resistant and be on an Arc-Fault Circuit
Interrupter protected circuit.
16. AZI electrical work must be done by a Minnesota- licensed electrical contractor under an
electrical permit.
17. Any open walls or walls that are opened as part of this project must be wired to the
standards of the 2008 NEC.
18. All buildings on the property must meet the St. Paul Property Maintenance Code
(Bulletin 80-1)
19. Illegal service upgrade wire to NEC 2008. Purchase permit for service and all circuits in

1. The water heater has no gas shutoff gas piping is incorrect (strap gas line).
2. The water heater gas venting is inconect.
3. The water heater is not fired or in service.
4. Properly support water meter.

Second Floor

12. The lawn hydrant(s) requires backflow assembly ar device.
13. Verify plumbing vents full size stack is thru the roof.
Comments
14. New plumbing, need permits to cover.
HEATING
1. Clean and Orsat test fiunace burner. Check all controls for proper operation. Check
fumace heat exchanger for leaks; provide documentation from a licensed contractor that
the heating unit is safe.
2. Provide adequate clearance from flue vent pipe on furnace to combustible materials or
provide approved shielding according to code.
3. Vent clothes dryer to code.
4. Provide adequate combustion air and support duct to code.
5. Provide support for gas lines to code.
6. Plug, cap and/ar remove all disconnected gas lines and remove unapproved plug valve
form abandoned gas line in basement by garage door.
7. Repair and/or replace heating registers as necessary.
8. Provide heat in every habitable room and bathrooms.
9. Provide documentation that bathroom exhaust fans are installed to code.
10. Gas and warm air mechanical permits are required for the above work.
ZONING
This house was inspected as a single family dwelling.
NOTES
See attachment for permit requirements and appeals procedure.
Roof, sidewalks, etc. snow covered and could not be inspected. All must meet appropriate codes
when completed.
This is a registered vacant building. In order to reoccupy the building, ali deficiencies
listed on the code compliance report must be corrected in accordance with the Minimum
Housing Standards of the St. Paul Legislative Code (Chapter 34) and all required permits
must receive final approval.

Attachments
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by December 14, 2009 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrarive costs
and demolition costs will be assessed against the property tases as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This
inspecrion will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If this building is located in a historic dishict or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Deparhnent of Safety
and Inspections web site (see letterhead) and from the F3PC staff. No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is fiuther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the tune specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.

If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Lea slative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

1. Remove all insulation and wall board from basement walls and have inspected before
framing and insulation is installed.
2. Remove green board from exterior walls and ceiling in second floor and basement

procedure if lead base paint is present (See St. Paul Legislative Code, Chap. 34 for
additional information).

31. Install water-proof enclosure in shower area.
32. Provide adequate access, ventilation and clearance in crawl space area.
ELECTRICAL
1. Ground the electrical service to the water service with a copper conductor within 5' of the
entrance point of the water service.
2. Bond around water meter with a copper wire sized for the electrical service per Article
250 of the NEC.
3. Provide a complete circuit directory at service panel indicating location and use of a11
circuits.
4. Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen
appliance circuit.
5. Verify that fuse(circuit breaker amperage matches wire size.

4. Properly support water meter.
5. The water meter has incorrect piping.
6. The water meter cannot have soldered fittings befare meter.
7. Repair or replace all conoded, broken or leaking water piping.
8. The water piping has improper piping or usage. Add appropriate hangers.
9. The soil and waste piping has improper pipe supports and improper connections,
transitions, fittings or pipe usage.
10. The faucet is missing, broken or parts missing.
Second Floor

Exterior
12. The lawn hydrant(s) requires backflow assembly or device.
13. Verify plumbing vents full size stack is thru the roof.

HEATLNG
1. Clean and Orsat test fumace burner. Check all controls for proper operation. Check
fumace heat exchanger for leaks; provide documentation from a licensed contractor that
the hearing unit is safe.
2. Provide adequate clearance from flue vent pipe on fumace to combustible materials or
provide approved shielding accordingto code.
3. Vent clothes dryer to code.
4. Provide adequate combustion air and support duct to code.
5. Provide support for gas lines to code.
6. Plug, cap and/or remove all disconnected gas lines and remove unapproved plug valve

1. Ordering the owner to remove or repair the building(s) at 1662 Minnehaha Avenue East
within fifteen (15) days from adoption of resolution.
David Mortensen, attorney with Wilford & Geske, appeared on behalf of MERS c/o Litton Loan
Servicing. He stated that it was his understanding that the client was considering demolishing the
property and had not retained their firm to handle this matter.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a one and
one-half story, wood frame, single-family dwelling on a lot of 4,792 square feet and had been
vacant since September 18, 2008. A code compliance inspection had been done on February 3,
2009, the vacant building registration fees in the amount of $1,000 went to assessment on
November 2, 2009, and the $5,000 performance bond had not been posted. On October 29, 2009,
an inspection of the building was done and a list of deficiencies which constitute a nuisance
condition was developed. An order to abate a nuisance building was posted on November 13, 2009
with a compliance date of December 14, 2009. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value of the land to be approximately $37,100 and the building to be $107,100. Real estate
taxes were current. Code Enforcement estimates the cost to repair the building to exceed $30,000.
The cost for demolition was estimated to be approximately $8,000 to $10,000. There had also been
six summary abatements issued to this property since 2008, all of which went to work order:
boarding/securing, remove improperly stored refuse, and other exterior violations. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1919 and was a bungalow-style building. There was a loss of integrity and the exterior was covered
in vinyl siding. It was located on a prominent comer lot; howevex, it was not located 'm any
potential historic district and did not have any potential historic significance on its own. She did
encourage rehabilitation of the property given the context of the neighborhood. She also noted that
there was a five to six foot retaining wall which wrapped around the front and side of the building
which was deteriorated. In looking at the photographs, she asked whether the retaining wall would
remain in place if the building were demolished.
Mr. Magner responded that generally, they tried to preserve retaining walls; however, given the
physical condition of the wall, it may be considered as part of the demolition.
Ms. Moermond asked whether there was a bid tab for the demolition of this property. Mr. Magner
responded that it was his understanding there was a backlog of requisitions for demolitions being
held up in Finance.
Ms. Moermond stated that she had concern over the failure of the retaining wall and whether the
demolition would be included in the bid far the demolition. NIr. Magner stated that he had received
a letter from Laurie Macko, representing Litton Loan Servicing, indicating that they intended to
proceed with the demolition of the property.
Ms. Moermond continued the Legislative Hearing to January 26 for a report on retaining wall. She
recommended the building be removed within 15 days with no option for repair.

Mr. Ma�er stated that he had not gone out to the property to look at the retaining wall; however,
judging from the condition in the photographs, it appeared that the entire wall was dilapidated and
should be removed when the building is demolished. He said he understood Ms. Spong's concern
that this was a corner lot and the removal of the wall will change the appearance of the corner. He
said he would go out and look at the retaining wall and contact Ms. Moermond with his
recommendation.
