WHEREAS, the Avoles Contracting Company of Saint Paul had
a contract with the City, No. 56-P-113A, L. No. 5654-3, for the installa-
tion of sewer service connections on Maryland Avenue between Western
Avenue and E. Como Boulevard, and during the course of their work'a
manhole at Maryland and Norton was damaged by Virgil D. Schaaf, who was
varkipgc:fofs said Company; and
WHEREAS, Virgil D. Schaff apparently was insured with the
Iowa Mutual Insurance Company under policy No. L-550347, and the draft,
No. 13637, issued by that insurance company for claim No. M25221 in
favor of the City of Saint Paul and the Avoles Plumbing Service, Inc.
(the correct name of the Avoles concern) was in payment of the damage
to the manhole; and
WHEREAS, the Avoles Plumbing Service, Inc., has repaired
the manhole satisfactorily and the City has no further claim or interest
in this check, and it is desired to have the proper City officers endorse
the check and turn the same over to the Avoles Plumbing Service, Inc.,;
now, therefore, be it
RESOLVED, that the proper City officers are hereby authorized
and directed to endorse said draft on behalf of City of Saint Paul and to
turn said draft over to the proper officer representing the Avoles Plumbing
Service, Inc., and to take a receipt therefor.
