WHEREAS, In the matt- of the construction of a Sewer on Kasota Street from
Bayless Avenue to a point 910 feet west of the center-line lof Bayless
Avenue, Avoles Contracting Company, Contractor, Comptroller's Contract
L-5682-C for the contract thereof, the specified date of cdmpletion
was JANUARY 30, 1957, and
WHEREAS, Said Contractor has prosecuted the work diligently, but due to negoti-
ations with the Northern Pacific Railroad Company relative !to the type
of construction to be placed underneath their tracks, which negotiations
constituted a condition beyond the control of the Contractor, it was not
possible to complete the work by said date, now therefore by it
RESOLVED, That the proper C,ty Officers be and they are hereby authorized and
directed to execute an amendment to said contract extending the time of
completion to MAY 15, 1957, provided however, that this Res lution shall
have no force or effect unless the sureties on the Contrac is Bond
consent thereto and file such consent in writing with the City Comptroller,
and be it
FURTHER RESOLVED, That the City of St. Paul hereby waives all claim for liquidated
damages and that no engineering and inspection costs on thi project
will be charged by the City on account of such extended period.
