An ordinance granting permission to Stanley R. Pr*am,
Edward D. Smith, Kenneth A. Peterson, Vincent E. Gustafson,
Thure Arthur Johnson, James Ramacier- and Cyril C. Sammon
to grade and surface that part of Rogers Street within
that strip of land 20 feet wide, being 10 feet on each
side of the center line of said Rogers Street and e*tend-
ing from Eleanor Avenue to the westerly extension of the
north line of the alley in Block 1, Lexington Park Plat
11, and that part of said Rogers Street within that
strip of land lying between the northerly and southerly
lines of the public alley in Block 1, Lexington Park Plat
11 extended westerly to the east line of said strip of
land 20 feet wide above described, all within the cor-
cti porate limits of the City of Saint Paul, Ramsey County,
State of Minnesota. This is an emergency ordinance ren-
dered necessary for the preservation of the public peace,
health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby
given to Stanley R. Pream, Edward D. Smith, Kenneth A. Peterson,
Vincent E. Gustafson, Thure Arthur Johnson, James Ramacier ands,
Cyril C. Sammon to grade and surface the fklowing portions of
Rogers Street, a public street within the corporate limits of
the City of Saint Paul, County of Ramsey, State of Minnesota,
to-wit:
That part of Rogers Street within that strip
of land 20 feet wide, being 10 feet on each side of
the center line of said Rogers Street and extending
from Eleanor Avenue to the westerly extension of the
North line. of tht alley in Block 1, Lexington Park
Plat 11, and that part of said Rogers' Street within that
strip of land lying between the northerly and southerly
lines of the public alley in Block 1, Lexington Park
Plat 11 extended westerly to the east line of said strip
of land 20 feet wide above described,
and the Commissioner of Public Works is hereby authorized to
issue a permit therefor upon their compliance with the following
conditions, to-wit:
1. Said permittees shall grade and surface
said portions of Rogers Street entirely at their own
cost and expense, and to the satisfaction and under
the supervision of the Commissioner of Public Works
and in accordance with the plans and specifications
approved by said Commissioner and the Chief Engineer
of the City of Saint Paul.

2. Said permittees shall pay the cost of engineer-
ing and inspection, and the cost of publication of this
ordinance.
3. That sad permittees' written covenant unto
said City for said permittees' performance of said
grading and surfacing work having been filed with the
City Clerk in compliance with one of the several
conditions to the vacation of contiguous parts of said
RoQgers Street under that certain Resolution of said
CYty Council, Council File No. 181174, approved January
23, 1957, and said permittees, as principals, with
corporate surety, in each case, having executed and
delivered unto said City as Obligee, two separate
surety bonds in compliance with other requirements
of said Resolution, the ordinary requirements for
the furnishing by the permittee or permittees of a
surety bond unto said City as a condition to the
issuance of such a permit shall be and hereby are
relaxed, and no such surety bond shall be rquired to
be furnished by said permittees or any of them here-
under, said permittees having been the petitioners in
the street vacation proceeding which included said
Resolution, and such conditions of said Resolution having
been met by them as such petitioners therein.
4. Said permittees, after the inception of said
work, shall prosecute same continuously, with diligence,
and fully complete said work, to the satisfaction and
approval of the Chief Engineer, on or before July 1, 1957.
5. Said permittees shall, within ten days after
the publication of this ordinance, file a written acceptance
thereof with the City Clerk.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
the public peace, health and safety.
Section 3. This ordinance shall take effect and be in force
upon its passage, approval and publication.
