An ordinance granting permission of William 0. Kiwus
to rough grade Wilson Avenue from a point 300 feet west of
Griffith Street westerly to the west line of Lot 22, Block
7, H. F. Schwabe's Addition, within the corporate limit* of
the City of Saint Paul, County of Ramsey, State of Minnesota.
This is an emergency ordinance rendered necessary for the
preservation of the public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby
given to William 0. Kiwus to rough grade Wilson Avenue from
a point 300 feet west of Griffith Street westerly to the
west line of Lot ;2, Block 7, H. F. Schwabe's Addition, and
the Commissioner of Public Works is hereby authortfid to- issue
a permit therefor upon his compliance with the following•
conditions, viz:
1. Said permittee shall rough grade said street

I entirely at his own expense, and to the satisfaction
and under the supervision of the Commissioner of
Public Works, and Lk accordance with plans and speci-

2. Said permi tee shall pay the cost of
engineering and inspection, and also the cost
of the publication of this ordinance.
3. Before entering upon or doing any of
1 said work, said permittee shall procure from
% the abutting owners such easements in and to
the abutting property as may be necessary for
slopes, cuts and fills, and shall obtain a
written release from such owners, releasing
, . and discharging City from any and all damages

40 4. Said permittee shall furnish a bond
` of $5,000.00 to the City of Saint Paul, con-
ditioned to comply with all the terms of this
ordinance, and to indemnify and save the City
harmless from any and all loss, liability,
judgments, suits, costs, charges, damage or
expense that may accrue to person or property
occasioned by the rough grading of said street.
5. Said permittee after the inception of
said work, shall prosecute same continuously,

to the satisfaction and approval of the Chief
Engineer, on or before December 1, 1957.

file a written acceptance thereof with the
City Clerk.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, approval and publication.
