Morin to construct a single-family home on a lot of inadequate front- age located on the west side of Chatsworth between Front and Hatch. This property is described as lot 7 and the south 10' of lot 6, block I, Como Park Second Addition. The.:zoning is "B" residence. The applicant is the owner of the property which has a 35' frontage and an area of 4,412 sq. ft. In this case the appli- cant is prevented from developing this lot because the lot does not have forty feet of frontage. In reviewing this matter, the Zoning Board finds that a genu- ine hardship exists in that the lot cannot be developed unless the relief sought is granted. The proprty is flanked by single- family homes on either side. In consideration of these factors, the Zoning Board recommends that the frontage requirements of section 3 of the Zoning Ordinance be relaxed pursuant to the provisions of section 20, paragraph "i" of the Zoning Ordinance and in accordance with the applicant's appeal filed January 31, 1957. c C. Morin whose address is 933 Hatch Avenue, St. Paul, Minnesota, appeal is hereby taken from the decision of the Commissioner of Parks, Playgrounds and Public Buildings with reference to the application of the building zone ordinance as applied by the Commissioner on application of Mr. Morin for a permit to construct a house on Lot 7 and the South 10 feet of Lot 6, Block 1, Como Park Second Addition. The tract referred to, which is owned by Mr. Morin, has a frontage of 35 feet and a depth of 126.07 feet. The area of the tract is slightly in excess of 4400 square feet. The property is situated on the West side of Chatsworth Street between Front and Hatch Avenues. Mr. Morin proposes to build a one-family dwelling on the property. The proposed dwelling will be 24 feet wide and 32 feet deep. The set-back line will be in conformity with the established building line for that block. The proposed house would be so placed on the property that the Northerly wall will be 19 feet distant from the North line of the property and 23 feet distant from the South side of the house adjoining on the North. The Southerly wall of the proposed house will be 7 feet from the South line of the property and 9 feet from the house adjoining on the South. In the platting of Como Park Second Addition, Lots 6 and 7 in Block 1, as well as the other lots in that block fronting on Chatsworth Street, were platted as 25 foot lots. The Commissioner, in denying Mr. Morin's application for a building permit, strictly construed the provisions of Subdivision b, Section 2, Article I, of the zoning ordinance which relates to "A" resident districts. The property is an "A" residence district. Such strict construction results in practical difficulties for Mr. Morin and makes the development and improvement of the property impossible. The proposed building plans are in harmony with the general purpose and intent of the zoning ordinance. The proposed construction will be beneficial rather than detrimental to the district. CITY CLERK FILE APPLICANT Z.F.N City Council Page 2 January 31, 1957 A similar appeal was presented to your honorable body in 1947 by Alma Quigley who then owned the property. Pursuant to that appeal, the City Council, as then constituted, adopted a resolution under date of December 5, 1947, by which permission was granted to Alma Quigley to construct a house on the property. Since she did not proceed with her construction plans, that resolution is no longer of any force or effect. It is respectfully submitted that the reasons justifying the adoption of the resolution at that time apply with equal, if not greater, force at this time. Therefore, you are respectfully requested to adopt an appropriate resolution which will authorize Mr. Morin to proceed with his construction plans as above outlined and which will direct the Commissioner of Parks, Playgrounds and Public Buildings to issue to Mr. Morin a permit. FARICY March 13, 1957 The Honorable Mayor and City Council City Clerk Saint Paul, Minnesota In re: Council File No. 13663 Appeal of Omer Morin to construct dwelling adja- cent to 980 No.Chatsworth, Saint Paul, Minnesota Gentlemen: Please be advised that we represent Mr. and Mrs. Wilmer Vierling who are the purchasers under a Contract for Deed, and the residents in possession of the property located at 980 No. Chatsworth Street, Saint Faul, Minnesota, to make known to you their opposition to the appeal referred to above. They have informed us that their house is constructed approximately four or five feet from the property line separat- ing their lot from the property concerned in this appeal. It is their feeling that if the applicant Omer L. Morin is permitted to construct a dwelling house on such a narrow lot that it would necessarily be so close to the Vierling's home as to constitute an extremely crowded and unsightly condition. We, therefore, request the Honorable Mayor and City Coun- cil to deny the appeal so as to refuse to permit the construc- tion of a dwelling house on the extremely narrow lot next to that of Mr. and Mrs. Vierling.
