An oa ait Or , No..4841k +.. s An ordinance amending Ordinance No. 5840, entitled: " An ordinance for the purpose of promoting the public health, safety, order, convenience, prosperity and general welfare by providing for the classification, regulation and restriction of the location of trades and industries, and of buildings used for human habitation and for specified purposes, and the height and bulk of buildings hereafter erected or altered; and regulating and determining the minimum size of lot line courts and other open spaces, and • establishing the boundaries of districts for said purposes", approved July 7, 1922, as amended. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Ordinance No. 5840, approved July 7, 1922, as amended, be and the same is hereby further amended so as to rezone Lots 21 through 29, inclusive, Block 16, Merrill's Division of Rice Street Villas, from "A" Residence District to Commercial District. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. This ordinance shall take effect and be in force upon its passage, approval and publication. J. Ryan Landscape Supply Company Inc. to rezone from "A" residence to "commercial", lots 21 through 29 inclusive, block 18, Merrilltts Addition of Rice Street Villas Addition. This property is located on the north side of Arlington between Rice and Park. The applicant's tract has a frontage of 360' on Arlington and extends to a depth of 126.03' . It is directly south of a larger tract of land which the Council recently re-zoned for the purpose of establishing a shopping center which would be adjacent to Rice Street. The land is presently vacant with the exception of a storage building which was authorized by a special Council Use Permit in 1952. Briefly, the applicant proposes to establish a landscape business which will be related in its function to the proposed shopping center to be located to the north. Field investigation discloses no objection to this proposal from the standpoint of adjacent land use. As has been brought in previous reports of the Zoning Board with reference to this portion of the community, sub-soil conditions are such as to inhibit residential development in this area. In view of the established market for additional commercial land in this part of the community, the Zoning Board feels that. the applicant's plans conform to the general objectives of sound community development. These lots are described as follows: Lots 21 thru 29, Block 16 of Merrill's Division of Rice Street Villas. A few years back the City Council acted to rezone this property for us, whereas a permit was granted to construct a temporary building. Since that time, and recently, the Twin Plaza Cor- poration has acquired approximately 10 acres adjacent and immediately north of this property, and they have been granted the right to construct a shopping center on these ten acres. In order that we might be in harmony with the proposed construction of the shopping center, we are contemplating moving our business building back onto the above lots. We feel that this move would greatly benefit and improve these corners and would encourage more tax benefits for the City of St. Paul. We are hoping that your respected judgment will be favorable.
