' ` COMMISSIONE / A �J� DATF WHEREAS ,- it has been made to appear to the Council by reason of certification of the Secretary of the St. Paul Teachers Retirement Fund Association that the members thereof have duly adopted an amend- ment to the by-laws of the Teachers Retirement Fund Association, said ,certification of which action has been presented by the Secretary showing as follows : 1. The Board of Trustees of such Associa- tion on October 18, 1956, adopted a proposed resolution of amendment to the by-laws , to-wit : Section 1 of Article V, which resolution of the Board proposed to the members the adoption of said amendment. 2. That each member of said Association was notified of the annual meeting to be held January 17, 1957, and was sent a copy of the proposed amendment. 3. That at the annual meeting on January 17, 1957, the matter of the amendment of said section of the by-laws referred to was presented to the members , voted on by them, and that said proposed amendment received an affirmative vote of 1060 yea votes and no nay votes . Anderson, Secretary of Teachers' Retirement Fund Association, hereby certify that: At a duly called meeting of the Board of Trustees, held on October 18, 1956, in the office of the Association, a resolution (attached to this statement ) was unanimously adopted, proposing to the members of the Association the adoption at their annual meeting of a resolution amending Article V, section 1 of the by—laws of Teachers' Retirement Fund Association, to read: ( See resolution attached ) I, hereby, Certify further that a notice of the annual meeting of the members of the Association to be held on January 17, 1957 at 4 P.M. at 25 East Fifth Street, St. Paul, Minnesota and a copy of the proposed amendment to the by-laws ( attached to this statement ) was sent to each member of the Association and to each of the ex-officio trustees at his last known address, mailed December 31, 1956. Marzitelli Commissioner of Public Works Dear Sir: Pursuant to your request, I have prepared a resolution which approves the amendment to Section 1 of Article V of the by—laws of the St. Paul Teachers Retirement Fund Association. This is a ratification by the Council of such change, a matter which has been discussed with you and me by Mr. Anderson of the Association. I understand that he has also talked with Mr. Faricy of the Comptroller's office and that there is a question involving the refund to the City of City contributions to the Fund in the specific case, where a teacher resigns from the service prior to retirement age and becomes ineligible for the pension, leaving in the Fund not only the contribution which she has made but also the contribution which' was made by the City. This matter has been discussed by Mr. Faricq with me and I believe also that he has discussed the matter with Mr. Anderson at some length. I thought that I would call this to your attention because it has arisen in conversations, but this is a matter for the Comptroller's office and the Council and not for this office. We believe we have accomplished our responsibility in drafting the proposed form of resolution in line with the .mendments which were voted in by the members of the Association and pursuant to the request which you made that we prepare such resolution. During the month of July of each year the Secretary shall prepare and submit to the Board, or to its Executive Committee, the budget of the Association for the next following calendar year. The budget shall include, but need not be limited to, his estimates of the following receipts and expenditures: (1) The amount of all income from investments; (2) The amount of all members' dues; (3) An amount equal to eight per cent of that part of the teachers' salaries to be taken into account in computing the amount of members' dues, adjusted as hereinafter provided; (4) The amount required to pay the increase in the pensions of retired members provided by Paragraph 9 of Section 3 of Article IV; (5) The amount of all pensions and other benefits; (6) The amount of all administrative and operating expenses; and (7) Any other amounts and details that the Board may require.
