1 WHEREAS, adverse action was taken against the Retail Food (A) - Grocery 1-100 sq. ft. license
2 held by Arthur Rinehart d/b/a Art's Barber Shop (License ID#20030000274) for the premises located at
3 779 Central Avenue West in Saint Paul by Notice of Intent to Suspend License dated August 3, 2009,
4 alleging licensee failed to pay delinquent license and late fees in the amount of $114.00; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend License pay the
delinquent license and late fees; and
9 WIIEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the
10 delinquent license and late fees by August 13, 2009, that the matter would be placed on the consent agenda
11 to impose the recommended penalty; now, therefore, be it

13 RESOLVED, that the Retail Food (A) - Grocery 1-100 sq. ft. license held by Arthur Rinehart d/b/a
14 Art's Barber Shop is hereby suspended.

Dear Mr. Rinehart:
The Deparfinent of Safety and Inspections (DSn has recommended suspension of the Retail Fd (A) —
Grocery I-100 sq. ft. license held by Ar[hur Rinehart d/b/a Art's Barber Shop for the premises located at 779
Central Avenue West in Saint Paul. The basis for the recommendation is as follows:
On June 22, 2009, you were sent a letter and RENEWAL INVOICE
from the Department of Safety and Inspections (DSI), stating that your
Retail Fd (A) — Grocery 1-100 sq. ft. license was delinquent as of March
21, 2009, and you now owed $114.00 in license and late fees.
You were given until July 13, 2009, to submit payment of your
delinquent license and late fees. As of today's date, that payment has
not been received.
At this time, you have three options on how to proceed:
You can pay the $114.00 in delinquent license and late fees. If this is your choice, you should send the
payment directly to the Department of Safety and Inspections, at 375 Jackson Street, Ste. 22Q St. Paul,
Minnesota 55101-1806 no later than Thursday, August 13, 2009. Information shou]d be directed to the
attenaon of Christine Rozek. A self-addressed envelope is enclosed for your convenience. Payment of the
$114.00 in delinquent license and late fees will be considered to be a waiver of the hearing to which you
are entitled.

2. If you wish to admit the facts but contest the penalty, you may have a public hearing before the Saint
Paul City Council, you will need to send me a letter with a statement admitting the facts and
requesting a public hearing. We will need to receive your letter by Thursday, August 13, 2009. The
matter will then be scheduled before the City Counci] for a public hearing to determine whether to
suspend your license. You will have an opportunity to appear before the Council and make a
statement on your own behalf.
If you no longer wish to do busir.ess in the City of Saint Paul, you will need to send a written statement to
that effect to the Department of Safety and Inspecuons, at 375 Jackson Street, Ste. 220, St. Paul,
Minnesota 55101-1806 tater than Thursday, August 13, 2009. Informarion should be dizected to the
attention of Chrisrine Rozek.
If you have not contacted me by that date, I will assume that you do not contest the
suspension of your license. In that case, the matter will be placed on the City Council Consent
Agenda for approval of the recommended penalty.
