THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Ordinance No. 5840, approved July 7, 1922, as amended, be and the same is hereby further amended so as to rezone the following described property from "B" Residence District to Light Industry District: That portion of the following described parcel which is presently zoned Class B Residential (being that portion of the below described parcel which lies southeasterly of a strip which is zoned Commercial, said commercially zoned strip being 100 feet wide and lying immediately adjacent to West Seventh Street) : 1 Except Rankin Street, that part of the east one-third (E 1/3) of the Southeast Quarter (SE4) of the Southwest ,. The applicants are contemplating the construction of a building of approximately 31,000 square feet which would cover 9% of the site and provide employment for a maximum of 325 persons. There is space on the site for off-street parking of over 200 cars and still provide adequate space for landscaping and yards. Off-street loading would be adequately provided for by access from Rankin street. Field investigation discloses that the underlying rock strata which ex- tends throughout this section of the community is within 2" to 6" of the surface and thus has operated to prevent the provision of sanitary sewers for this area on the basis of residential occupancy. As illustrated on the attached exhibits this factor, and other considerations, have led the Zoning Board to the conclusion that this tract is but a larger portion of a tract which would most properly be developed for light industrial pur- poses. The Zoning Board finds that this particular proposal before the City Council fits in well with an ultimate land use plan for the develop ment of this section of the community. . The close proximity of trackage of the Chicago, Milwaukee, St. Paul & Pacific Railroad Co. diminishes the value of the land for residen- tial purposes. 4. There is what might be called "traffic blight" on West Seventh Street due to the high volume of traffic on that street. In addition, there are areas in close proximity to the tract in question which are zoned Light Industrial and Commercial. 5. Perhaps the best indication of the desirability in the area for hous- ing is seen in a comparison of the above described area with the Highland Park area. In recent years the Highland Park area, which is close by, has rapidly developed into an area of fine homes and is an increasing source of revenue for the city. While progress has in- creased in the Highland Park area, in the above described area and the surrounding area, few homes have been built and the homes that have been constructed have been generally of substandard construction and value. In addition, while streets have long been dedicated in the area, there has been no move to grade Or improve them. The petitioner feels that the property above described that is presently zoned Commercial is not as suitable for commercial purposes as it is for light industrial purposes for the following reasons; 1. The commercially zoned land above described is considerably below the grade of West Seventh Street and considerable fill would be needed to raise the land to the level of West Seventh Street. 2. The land most logically should be in zoning harmony with the land lying between the commercial land above described and the trackage of the Chicago, Milwaukee, St. Paul & Pacific Railroad Co., for this area is a distinct geographic area. 3. In spite of this commercial zoning`for some years, no commercial enter- prise has been commenced on the above described premises. The petitioner believes that the entire above described premises should more appropriately be zoned Light Industrial for the following reasons: 1. There is a proximity to railroad trackage and highway access from West Seventh Street, and in the near future there most likely will be ac- cessibility to interstate highways. Thus the tract is convenient to many forms of transportation. 2. The premises are close to other industrial enterprises and commercial areas (e.g., land owned by Schirmer Transportation Co. contiguous to the above described premises on its easterly border, and the new plant of Remington Rand farther West on West Seventh Street). There To The Honorable Mayor and City Council - 3 - January 14, 1957 is convenient bus transportation available on West Seventh Street for employees who would commute to a working facility on the above des- cribed premises and there is a substantial labor force within walking distance of the premises. 3. The above described premises are one of the few large undeveloped tracts suitable for industrial purposes in the City of St. Paul and a conversion from the present zoning to Light Industrial zoning, with the subsequent erection of an office building and industrial plant of the kind petitioner proposes to construct, would greatly in- crease the value of the land, and the tax revenues to be derived therefrom. 4. Utilities (e.g., sanitary sewer, water and electric power) in suf- ficient quantity for industrial purposes are available to the premises from West Seventh Street. 5. Rezoning of the premises, as requested by the petitioner, would pre- serve for St. Paul an enterprise of established national reputation and distribution currently employing some 225 employees. For the above reasons it is respectfully urged that The Honorable Mayor and the City Council take affirmative action on the petition of the Pearson Candy Company to rezone the above described land as requested in its filed petition. As of the middle of January, 1957 the company had approximately 190 employees engaged in the plant operation of the business and approximately 12 employees engaged in office duties. There is some seasonal fluctuation in the number of plant em- ployees. The company employed, as of the snmmper of 1956, approximately 240 plant workers. It is anticipated that if the company constructs the facility contemplated adjacent to West Seventh Street, the number of plant employees will increase within a short period to approximately 300, and the number of office personnel will increase slightly. Mr. John Connelly of the staff of the City Planning Commission of the `/( s" City of St. Paul has inquired as to whether there is any offensive odor ema- nating from the present plant of the Pearson Candy Company and, if there is NUT GOODIES such a condition, how it is controlled. The company is engaged in the busi- ✓ ness of the confection of candy products. As a part of these processes it is SEVEN UP necessary for them to cook such component ingredients as corn syrup, sugar ° and chocolate. In addition, there is some roasting of peanuts. None of these activities produces an odor either strong or offensive, and these processes do SALTED NUT ROLL not produce any odor outside of the plant. Even inside the plant there is but o a slight sweet smell which no one could call a heavy odor and which rapidly NUT CLUSTER diffuses.
