- posed, a stipulation for the compromise
and settlement of all pending con--
troversies therein be made by and
RESOLVED, that the recommendation of the Corporation Counsel
therefor be and the same hereby is approved and adopted and that,
as presently proposed, a stipulation for the compromise and settle-
ment of all pending controversies therein be made by and between
the plaintiffs and the defendant in that certain civil action in
the Municipal Court of the City of Saint Paul, Ramsey County,
Minnesota, entitled "Sussel Realty Company, a Minnesota corpor-
ation, and Sussel Lumber Co. , a partnership, Plaintiffs, vs.
City of St. Paul, Defendant", wherein said plaintiffs seek to
recover as against the defendant the sum of $375.00 deposited
by the plaintiffs with the defendant as and for and in the nature
of an advance sewer assessment payment imposed by said defendant
as a condition precedent to the issuance by the latter of a sewer
connection permit for the drainage of the following described
property:
All of Lots 31, 32, and 33, and those portions of Lots
27, 28, 29, 30 and 34 in Block 12, Lot 1, Block 6,
St. Anthony Park, according to the recorded plat thereof
on file and of record in the Office of the Register of
Deeds of Ramsey County, Minnesota,
which stipulation, among other things, shall provide for the
refund by said defendant to said plaintiffs of the sum of $25.00
of said deposit and the dismissal with prejudice of said civil
action.
RESOLVED FURTHER, that upon the filing of such stipulation
in said civil action, together with the order of said Municipal
Court dismissing said civil action with prejudice, the proper City
officers hereby are authorized and directed to make payment from
funds of the City of Saint Paul necessary to effect such refund.
