An ordinance amending Ordinance No. 5840,
entitled:
"An ordinance for the purpose of promoting
the public health, safety, order, conven-
ience, prosperity and general welfare by
providing for the classification, regula-
tion and restriction of the location of
trades and industries , and of buildings
used for human habitation and for specified
purposes, and the height and bulk of build-
ings hereafter erected or altered; and
regulating and determining the minimum
size of lot line courts and other open
spaces, and establishing the boundaries
of districts for said purposes" ,
approved July 7, 1922, as amended. This is an emergency ordinance
rendered necessary for the preservation6f the public peace , health
and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Ordinance No. 5840, approved July 7, 1922,
as amended, be and the same is hereby further amended so as to
rezone Lots 10 to 18, inclusive, Block 2, Kuhl' s Addition,
situated on the north side of Selby Avenue between Fry and Pierce
Streets, from Commercial District to "C" Residence District.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
the public peace, health and safety.
Section 3. This ordinance shall take take effect and be
in force upon its passage, approval and publication.

Dear Sir:
This is in the matter of the petition of Mrs. Alice Meisel to rezone from
"Commercial" to "C" residence that property abutting the north side of Selby
located between Fry and Pierce. This property is described as lots 10 to 18
inclusive, block 2, Kuhl's Addition. The southerly 100' of this property is
zoned "commercial," the northerly 9.16' of the property is zoned "C" residence.
The property has a frontage of 109.16' along Pierce and Fry and extends a dis-
tance of 384' on Selby. The property is presently developed into six single-
family homes, two four-plexes and one 40' vacant lot. Mr. Stone, who is the
owner of the vacant lot which is lot 11, has been contacted and has stated
verbally that he has no objection to this re-zoning petition.
The applicants have stated that this petition is for the purpose of stabiliz-
ing the residential character of this particular portion of Selby Avenue. The
adjacent land uses are as follows: there are 7 four-plexes across Selby to the
south: there are retail stores across Pierce to the west: single-family homes
across Fry to the east: one apartment, two duplexes and five single-family
homes to the north.
Field investigation disclosoa.that both sides of , elby Ave. at this point are
completely developed for residential purposes with the exception of the single
vacant lot mentioned previously.
In view of the existing residential character of the area and the general
interest and desire on the part of the community of stabilizing this residential
area at this point and the fact that field investigation discloses that there is
commercial zoning and commercial development adequate to serve the needs of this
community within the immediate vicinity, the Zoning Board feels that the present
classification of "commercial" is not reflective of the interest and objectives
of the community.
In consideration of these factors, the Zoning Board. recommends that this petition
be granted.
