RESOLUTION
SAINT PAUL, MINNESOTA
Presented by
I WHEREAS, on September 10, 2008, the Saint Paul City Council under Council File 08-1024,
2 deternuned that a structure owned by Leroy Smithrud at 1863 Montana Avenue East was a nuisance
3 pursuant to Saint Paul I.egislauve Code Chapter 45 and ordered it removed or repaired within fifteen days
a of the date of the Council hearing; and
6 WHEREAS, the Court of Appeals for the State of Minnesota issued a writ of certiorari to the City
7 Clerk of the City of Saint Paul regazding Council File No. 08-1024 regarding the demolition of 1863
S Montana Avenue, Saint Paul, Minnesota and 5mithrud requested a stay of enforcement of the Resolution
9 pending the outcome of the appeal; and

I i WHEREAS, the Court of Appeals issued an Order dated January 6, 2009, discharging the writ of
12 certiorari and dismissing the appeal;

14 NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby revokes any stay of the
15 enforcement of its resolution to demolish the property at 1863 Montana Avenue East.
