09-966Council File # 09- 9G (o Green Sheet # 3071203 RESOLUTION CITY Presented by SAINT PAUL, MlNNESOTA 3� - 1 WHEREAS, Deparlment of Safety and Inspections has requested the City Council to 2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking 3 and removal of a two story, wood frame, single family dwelling and its detached garage located 4 on property hereinafter referred to as the "Subject Property" and commonly known as 851 5 MARION STREET. This property is legally described as follows, to wit: LEWIS SECOND ADDITION TO ST PAUL BLOCKS 7, 8, 9, 10, 11, 12, 13, 14, & 15 LOTS 12 & LOT 13 BLK 13 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before March 2, 2009, the following are the now known interested or responsible parties for the Subject Property: Vang Xiong WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated May 15, 2009; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the shucture located on the Subject Property by June 1, 2009; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subj ect to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held befare the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, August 11, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested D y- 9G� 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 or responsible parties to make the Subject Property safe and not detrimental to thepublic peace, health, safety and welfaze and remove its blighting influence on the community demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, September 2, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 851 MARION STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00}. That there now exists and has existed multiple Housing or Building code violations atthe Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). GQ 7 � That the deficiencies causing this nuisance condition haue not been corrected. That Department of Safety and Inspections has posted a placard on the Subj ect Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 haue been fulfilled. •�� • The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its ����� 83 84 85 86 87 88 2. 89 90 91 92 93 94 95 96 97 98 99 100 101 blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition and removal of the structure must be completed within fifteen (15) days after the date of the Council Hearing. If the above conective action is not completed within this period of time Deparhnent of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personai property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since February 6, 2009. The current property owner is Vang Xiong per AMANDA and Ramsey County property records. The city has had to board this building to secure it from trespass. There have been three (3) SUMMARY ABATEMENT NOTICES since 2009. There have been two (2) WORK ORDERS issued for: - Improperly stored refuse, garbage and misc debris - Boazding/securing On Apri123, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NLTISANCE BUILDING was posted on May 15, 2009 with a compliance date of June 1, 2009. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees went to assessment on March 27, 2009. Ta;cation has placed an estimated market value of $24,500 on the land and $54,600 on the building. As of August 6, 2009, a Code Compliance Inspection has not been completed. The exterior walls and/ar trim of the house and/or garage have defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. 2. The exterior walls of the house and/or garage are defective. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof covering to a sound, tight and water impervious condition. Permit may be required. 4. The window and/or door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. 6. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation defects in a professional manner to a weather-tight, water-tight and rodent-proof condition. Pernut may be required. Interior was not available for inspection due to complete boazd up. House has extensive fire damage throughout interior per Fire Dept. $74,000 fire damage per St Paul Fire Dept. report and conversation with property owner (who intends to raze). As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by June 1, 2009 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). As an owner or responsible party, you aze required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. The property shall not be sold, transferred or conveyed in any manner until the Nuisance Conditions have been abated and the Certificate of Code Compliance or Certificate of Occupancy has been issued. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subj ect to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Tnspections, Division of Code Enforcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolufion calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if conective action is not taken within the specified time, the City shall abate this nuisance. The costs of this action, including administrative costs will be assessed against the property as a special assessment in accordance with law. No other parties of interest appeazed. Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two- story, wood frame, single-family dwelling with a detached garage on a lot of 6,098 square feet and had been vacant since February 6, 2009. A code compliance inspection had not been done, the vacant building registration fees in the amount of $1,000 went to assessment on March 27, 2009, and the $5,000 performance bond had not been posted. On Apri123, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on May 15, 2009 with a compliance date of June 1, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $24,500 and the building to be $54,600. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $80,000 to $90,000. The cost for demolition was estimated to be approximately $10,000 to $12,000. There had also been three summary abatements issued to this property since 2009, two of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and debris, boarding/securing, and remove graffiti. Mr. Magner stated that there was a fire on Februazy 5 or 6 which began on the first floor of the building and did extensive damage. The building was vacant at the time but the fire also did extensive exterior damage to the house next door. Fire estimated the structural loss of the building to be approximately $74,000. The bids to demolish the building were due as of the date of this hearing so he was unsure as to the actual estimated cost of the demolition. Code Enforcement recommends the building be repaired or removed within 15 days. He presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1888 and was a worker's cottage-style building with an adjoining vacant lot. She noted that there was a loss of context to the neighbarhood and given the report of the fire, she did not believe demolition would have an adverse effect on the neighborhood. Mr. Vang stated that he needed more time to find a demolition contractor as he did not have the money. He had insured the property with State Farm for the amount of the mortgage which was $194,000. State Farm had paid off the mortgage; however, he did not receive any money from the insurance company to recover the loss from the fire damage. He had consulted a demolition contractor who indicated to him that if there was asbestos present, which he believed there was, the cost to remove the debris would cost significantly more. At this point in time, he would need to take out a loan to pay for the demolition himself or to pay the City for the taY assessment. Mr. Magner stated that at this time, Mr. Vang owned the land with a fire damaged house. If the City proceeds with the demolition, Mr. Vang will have a taac assessment for the cost of the demolition which he can either chose to pay and own the vacant parcel ar the parcel will go tas forfeit and become the property of the County. Ms. Moermond asked about the lot size. Mr. Vang said he owned the adjoining vacant lot and believed the total square footage was 50 feet. Ms. Spong stated that according to STAMP, Mr. Vang owns both parcels which did amount to over 50 square feet. She said he could rebuild on the 09-966 -99�9�T August 11, 2009 Legislative Hearing Minutes Page 3 double lot; however, a building would need to be centered in the middle of the two parcels. Ms. Moermond recommended the building be removed or repaired within 15 days. She also recommended continuing the Legislative Hearing to August 25 to obtain a report concerning the cause of the fire and the results of the demolition bids. 09-966 -�9�=�I29 August 25, 2009 Legislative Hearing Minutes Page 3 2. He also requested a copy of the bids received by the City which was mailed Mr. Xiong. Ms. Moermond modified her recommendation that the building be removed within 15 days with no option for repair.
