Presented by
1 WHEIiEAS, The City Council of the City of Saint Paul, pursuant to Chapter 62 of the Administrative
2 Code d'ad hold a public hearing on November 5, 2008, in the City Council Chambers for the purpose of
3 establishing the level of Right-of-Way maintenance to be performed in the City of Saint Paul and the
4 amount of service charges to be levied against benefitted properties; and
5
6 WHEREAS, The Department of Public Works did perform the 2009 Right-of-Way maintenance services
7 in a manner as set forth and approved by the City Council and described in the report of the Department of
8 Public Works; and
9
10 WHEREAS, Pursuant to Chapter 62 of the Administrative Code, the Department of Public Works has
11 submitted to the Department of Finance and Management Services a report showing the total cost of street
12 maintenance to be $28,476,107 a copy of such report has heretofore been delivered to the City Council;
13 now, therefore, be it

15 RESOLVED, That the City shall pay $4,498,624 of the cost of streets and alley maintenance by using
16 Municipal State Aid ($1,651,244), Trunk Highway Aid ($573,750) County Aid ($533,466), other revenue
17 ($1,594,400), Use of Fund Balance ($145,764); and be it further

72 Clerk is hereby directed to publish notice of this Aearing pursuant to Minnesota Statute Chapter 429, and
73 the Department of Public Works, Real Estate Division is hereby directed to mail notices in accordance with
74 said Chapter 429.

NOTICE OF PUBLIC HEARING
Notice is hereby given tha[ a Public Heazing wil] be held on the 7` day of October 2009 at 5:30 pm in the
Saint Paul City Council Chambers, City Hall and Court House, Saint Paul, Minnesota. The purpose of the
Public Heazing is to consider the level of Righ[-of-Way maintenance performed in the City of Saint Paul in
2009 and to ratify the cost of such service to be charged against benefited properties in accordance with Chapter
62 of the Administrative Code.
The particulaz service has been performed and the estimated costs as proposed by [he Deparrment of Public
Works aze as foLlows:
CLASS I-A - DOWNTOWN STREETS
Description:
Class I-A service has been performed on al] downtown streets (face of curb ro face of curb) within the following
boundaries: Kellogg Boulevard on the south and west, Eleventh Street on the north, and Broadway on [he east
(except streets listed in Class I-B, Dowutown Streets (Brick)).
2009 Level of Services:
The down[own streets have been vacuum swept approximately four times per week ([wo [imes on easUwest
streets and two trmes on north/south streets). All routine maintenance, includmg patching and repairing of
street surfaces, tree trimming, streetligh[ maintenance, and snow plowing has been performed on an as-needed
basis.
Assessment:
All Class I-A service will be assessed at a rate of 15.25 per assessable foot.
CLASS I-B - DOWNTOWN STREETS BRICK)
Descriotion:
Class I-B service has been performed on all downtown brick streets (face of curb to face of curb): St. Peter St.,
from Kellogg Blvd to Sixth St.; Wabasha, from Kellogg Blvd to Sixth St.; Fourth St., from St. Peter to
Wabasha; Fifth St., from St. Peter to Wabasha; Sixth, from St. Peter to Wabasha; Mazket St., Kellogg Blvd to
Fourth St.; Muket St., Fifth St. to Sixth St.; Washington St., Kellogg to Fourth St.; Fourth St., St. Peter St. to
Washington St.; Fifrh St., Market to St Peter St.; Sixth St., Market to St. Peter St.; Kellogg Blvd., north side;
Wabasha St, just west of Mmnesota (Wild) Club and adjacent to Xcel Arena; and Kellogg Blvd., south side:
Seventh St to the RiverCentre Pazking Ramp.
2009 Leve] of Services:
The downtown streets listed above have been vacuum swept approximately four times per week (two times on
easUwest streets and two times on north/south sheets). All routine maintenance, mcluding patching and
repairing of the brick street surfaces, tree tnmming, streetligh[ maintenance, and snow plowing has been
performed on an as-needed basis.
Assessment:
All Class I-B service will be assessed at a rate of 18.46 per assessable foot.

CLASS II - OUTLYING COMMERCIAL AND ARTERIAL STREETS
Descriotion:
Class II service has been performed on all outlying commerctal and azterial streets in the City. These are the
major arteries in the City and have both heavy volumes of vehicular and pedesh'ian traffic and, in most cases,
have business or commercial properties fronting on [hem. Typical examples would be as follows: University
Avenue, Snelling Avenue, W est Seventh Street, East Seventh Stteet, Rice Street, Payne Avenue, Arcade Street,
Summit Avenue, Grand Avenue, and others. All of these Class II streets aze accura[ely defined on a map
available for viewing in the Departmen[ of Public Works, 900 City Hall Annex.
2009 Levei of Service:
The Class II stree[s have been swept approximately 8[imes per season. All routine maintenance, includmg
patching and repairing of stree[ surfaces, sidewalk maintenance, tree trimming, streetlight mamtenance, and
snow plowing has been done on an as-needed. Includes mowing miscellaneous city right-of-way parcels.
Assessment:
Under Class II service there are two assessmen[ rates, one commercial and one residentiaL The commercial
property rate is 7.68 per assessable foot and the residential property rate is 3.13 per assessable foot.
CLASS III - ALL RESIDENTIAL STREETS
Descripdon:
Class III service has beeu performed on all residential streets including oiled streets, paved streets and
intermediate type streets.
2009 Level of Service:
Residential s[reets, includmg oiled, paved and intermediate streets, have received a thorough cleaning m the
spring which included sweeping and flushing. Patching and repairing street surfaces, sidewalk maintenance,
tree trimming, s[reeflight maintenance, and snow plowing has been done on an as-needed basis. Due to
increases in the cost of fuel and materials along with citywide budget reductions, all residential streets
(oiled and paved) will now be chip sealed on a 10 year cycle. One-tenth of these residential streets (a
total of 51 miles) will be chip sealed each yeac In the fall, leaves will be picked up from these streets.
Includes mowing miscellaneous city righriof-way parcels.
Assessment:
Under Class III service there aze two assessment rates. The commercial property rate is 5.67 per assessable
foot and the residential property rate is 2.94 per assessable foot.

CLASS IV - ALL OILED AND PAVED ALLEYS
Descriotion:
Class IV service has been performed on all oiled, paved and intermediate type alleys within the City.
2009 Level of Service:
All oiled, paved and intermediate alleys have been swept once each summer. All routine maintenance,
including patching and repair of the altey surface, has been performed on an as-needed basis. Due to increases
in the cost of fuel and materials along with citywide budget reductions, all alleys (oiled and paved) will
now be chip sealed on a 10 year cycle. One-tenth of the total number of alleys (approximately 203 alleys)
will be chip sealed each year.
Assessmen[:
Under Class N service, there aze two assessment rates. The commercial property rate is 1.06 per assessable
foot and the residential property rate is 0.67 per assessable foo[.
CLASS V - UNIMPROVED STREETS
Descrintion:
Service has been performed on all unimproved streets. By unimproved, we mean those streets that have not
been developed for one reason or anothec They are platted City rights-of-way; however, the abutting residents
have never petitioned for their improvement nor have there been any assessments levied. Because [hey are City
rights-of-way, the City has the responsibility to perform minimal repairs and maintenance work on them to
reduce any hazards or potential hazards.
2009 Level of Services:
The maintenance and repair of these streets has consisted of patching, minor blading, placing of crushed rock
and other stabilized material, tree trimming, and snow plowing in order to make them passable and reduce
hazards.
Assessment:
The assessment rate on unimproved stree[s is 2.82 per assessable foot for commercial
property and 1.59 per assessable foot for residentia] property.

CLASSVI-UNIMPROVED ALLEYS
Description:
Service was performed on unimproved alleys. By unimproved we mean those
alleys that have not been developed for one reason or another. They aze platted City
rights-of-way; however, the abutting residenu have never petitioned for their improvement
nor have there been any assessments levied. Because they aze City rights-of-way, the City
has the responsibility to perform minimal repairs and maintenance work re reduce hazards.
2009 Level of Services:
The maintenance and repair of [hese alleys will consist of patching, minor blading, placing of crushed rock
and other stabilized material in order to make them passable and reduce hazards.
Assessment:
The assessment rate on unimproved alleys is 0.51 per assessable foot for commercia]
property and 0.34 per assessable foot for residential property.
