RESOLVED, that the Council of the City of Saint Paul
hereby authorizes the withdrawal of the appeal of Elmer
L. Martin and Mrs. Florence M. Martin, under Par. 0,
Section 20 of the Zoning Ordinance, for permission to
remodel a building at Po. 349 North Wilder into a triplex,
and the proper City officers are hereby authorized to
refund to said Elmer L. Martin and Mrs. Florence M.
Martin the filing fee paid therefor, in the amount of
$20.00.

Mr. Elmer L. Martin and Mrs. Florence M.
Martin, owners of the above described property, have
requested that I, as their attorney, advise you of
their withdrawal of their Petition and Appeal under
Paragraph 0, Section 20 of Ordinance No. 5840, commonly
called the "Zoning Ordinance", which was filed with
you by me as their attorney on January 24, 1957, and
with which was paid to you the sum of Twenty ($20.00)
Dollars.
I therefore hereby withdraw said Petition and
Appeal, and request a refund of the filing fee paid
therewith, and I wish to thank you for your courtesy
in this matter.

We, the undersigned, Elmer L. Martin and Florence M.
Martin, husband and wife, being the owners of that certain real
property situate at 349 North Wilder, in the City of Saint Paul,
County of Ramsey, State of Minnesota, legally described as
follows, to wit:
The North twenty (N 20) feet of Lot Fifteen (15) ,
and the South one-half (S i) of Lot Sixteen (16) ,
Block Seventeen, Merriam Park, according to the
plat thereof on file and of record in the office
of the Register of Deeds in and for said County
and State,
do hereby APPEAL under Paragraph 0, Section 20, of Ordinance No.
5840, commonly known as "The Zoning Ordinance", for permission
to continue the use of the dwelling house thereon, as a triplex,
or three-family dwelling, and to remodel, repair and maintain the
same as such, and in support of said appeal, do set forth the
following facts, to wit:
1. To the best of Petitioners ' knowledge, information
and belief, said dwelling house was constructed
prior to the year 1922, the effective date of
said Zoning Ordinance.
2. The foundation area of said dwelling house is in
excess of one thousand (1,0001net, being one
thousand one hundred (1,100) square feet in area,
measuring twenty-five (25) by forty-eight (48)
feet, measured along the inside of the foundation
walls.

3. At some time prior to December 15, 1951, the date
Petitioners purchased said property, the interior
of said dwelling house had been remodeled as a
triplex, or three-family dwelling, and was then
being, and ever since has been, used as such, and
Petitioners were wholly unaware that such condition
and use of said dwelling house was in violation of
said Zoning Ordinance.
4. The income from the use of said dwelling house as
a triplex, or three-family dwelling, inurring to
Petitioners is necessary to and required by them
to maintain said dwelling house in an attractive,
safe and serviceable condition, and the denial of
this appeal would result in great and grave hard-
ship to Petitioners.
