Appeal of Margaret Kvasnicka, on behalf of Sisters of St. Joseph, to a Certificate of Occupancy Deficiency List for property at 520 Warwick Street South. Appellant Sister Margaret Kvasnicka, Patrick Croke (1884 Randolph Avenue), and Cheryl Steeves appeared. Ms. Shaff gave a staff report. She said that she had conducted an inspection for the Fire Certificate of Occupancy on June 4 and found that the openable dimensions of a1132 casement windows were 58 inches high by 12 inches wide and that the building was not a sprinklered building. Ms. Steeves provided a diagram and described the configuration of the windows. Ms. Shaff also described the windows and possibilities for gaining more width by changing the hazdware. Ms. Shaff asked whether the appellants had spoken to a contractor about different hardware. Ms. Steeves said that the input that she received was on replacing the windows. Ms. Shaff described the egress hardware that was available far casement windows. Mr. Croke said that he was familiar with the hardware but that it would still require re-doing all of the windows. Ms. Moerniond asked about the organization's capital improvement plan. Ms. Kvasnicka said that there was no capital improvement plan for the current year or the next because of the economy, and that the budget process had been completed before the inspection. She said they were asking for a variance based on 50 years of the building being safe; there were no candles, smoking, drugs or alcohol allowed. Mr. Croke said that it was primarily a concrete, masonry and steel conshuction. Ms. Moermond asked whether it was currently being used as a convent. Ms. Kvasnicka said that they had had sisters living there for nearly 50 years and for the past several years, they had also been providing housing for women who were homeless and living in poverty. Ms. Moermond said this was a large shortfall in the width. Mr. Croke said there was a hard-wired alarm and monitoring system in the building. Ms. Moermond said that she would lay the matter over to September 15 to explore other options. She said that at the very least she would recommend a long compliance period. Mr. Croke said that there were also neighborhood aesthetic concerns with having different types of windows. On August 13, 2009, Ms. Moerxnond visited the property and recommended granting an 8-inch variance on the openable width of the bedroom egress windows with the following conditions: 1) the systematic lubrication of the windows in the building shall be concluded within 60 days; 2) the windows shall all be replaced with code compliant windows by 2020; and 3) any windows which are damaged and need to be replaced priar to that deadline shall be replaced with fully code compliant windows.
