WHEREAS , Fred Driver, Jr. , an employe of the of Public Utilities of the City of Saint Paul ,
was injured on ':larch 7 , 1957 , in a third party accident ,
while engaged in the performance of his duties for the
Department of Public Utilities , at which time, also, the
truck belonging to the Public Utilities Department
was damaged as a result of a collision with a vehicle
driven by Emil Eichholz , which vehicle was insured
by the Iowa National rliutual Insurance Company; and
WHEREAS , the office of Corporation Counsel
is presently in receipt of two drafts from the Iowa
National Mutual Insurance Company, one in the amount
of $121 . 00 payable to the City of Saint Paul Lighting
Division, which is to reimburse the City for damage
to the City vehicle which is presently being repaired
at the Mitch & Heck Garage, and another check in the
amount of $1 , 600.p0, payable to the City of Saint Paul ,
and to Fred Driver, and to Irving Gotlieb, attorney
for Fred Driver; and
WHEREAS , the City has incurred salary loss
in the amount of $540.60 and is committed to pay the
outstanding medical bill incurred by Mr. Driver in
the amount of $75.00, or a total expenditure by the
City of the sum of $615.60,
Now, therefore, be it
RESOLVED, That the proper City officers are
hereby authorized to accept the property damage draft
in the amount of $121. 00 in full and final settlement
of the City' s property damage claim as a result of the
aforementioned accident , and the proper City officers
are further authorized to accept the sum of $615.60
representing medical expense and wages incurred by

the City in said employe 's behalf , less an amount of
25 per cent, or $153.90 attorney's fee to be paid to
Irving Gotlieb as the City' s share of attorney's fees
resulting from said recovery, or a total recovery to
the City for personal injuries of Mr. Driver in the amount
of $461 .70; and be it further
RESOLVED, That the proper City officers are
hereby authorized to issue a City draft payable to Fred
Driver, Jr. and his attorney, Irving Gotlieb, in the
amount of $1138. 30; and be it further
RESOLVED, that the amount of $75. 00 of the
City' s recovery be credited to Fund 31-G1-B, and the
amount of $386.70 be credited to Fund 22-R.
