Owner missed three legislative hearings; refened back by Council on August 5 and Councilmember
Carter indicated no further rescheduling if the owner misses the hearing.
Mr. Essling stated orders were issued on February 20, 2009 to remove fiuniture, mattresses, debris
from the rear yard and on rear deck with a compliance date of Mazch 2. The property was re-
inspected on March 2 and was not in compliance. A work order was sent to the Parks Deparhnent
who did the work on March 10, 2009 for a total assessment of $383.
Hashim Mohamud, property owner, stated that he was out of the country when the orders were sent
and did not know what was done at the property. He did not believe he should be responsible for
the assessment as he claimed he had cleaned up the yard when the City had a"free day."
Ms. Moermond asked to see the video which showed tile on the side of the house and two
mattresses behind the shed; one of the mattresses was frozen to the ground so the Parks crew was
unable to remove it. The other items, the tile and one mattress, were removed by Parks. Ms.
Moermond asked what happened if Parks was unable to remove items if they were frozen to the
ground.
Ms. Seeley responded that once the work order is sent, the inspectar closes the file as it is then
Parks responsibility. She believed they sometimes did go back out and pick up items that they were
unable to remove, such as the case when something was frozen to the ground.
Mr. Mohamud stated that he had cleaned up the yard after he returned home and didn't believe the
City had done the work. Ms. Moermond asked to see the video again which clearly showed the
Parks crew had removed tile pieces and a mattress but left a mattress that was $ozen to the ground.
Mr. Mohamud asked that the assessment be reduced since the City did not clean up everything as
the orders indicated and he again said that he had cleaned up the yard himself. Ms. Moermond
asked him when he had cleaned up the yard. Mr. Mohamud responded that it was when the City
had a"free day" maybe in May or 7une.
Ms. Moermond asked what the breakdown for the cost of the assessment was. Mr. Essling
responded that the trip charge for the crew to go out was $260 and was a flat fee. Accarding to
STAMP, the other chazges were $28 for cubic yardage fee, $20 for the mattress, and $75 in
administrative fees.
Ms. Moermond stated that clearly the City had done the work; that he was charged the appropriate
amount for the assessment and she could not recommend reducing the fee based on his argument.
She recommended approving the assessment.
