1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ardering the repair or wrecking
3 and removal of a one and one-half story, wood frame dwelling and its one stall, detached, wood
4 frame gasage located on property hereinafter refened to as the "Subj ect Property" and commonly
5 known as 376 ERIE STREET. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before April 14, 2008, the
following are the now known interested or responsible parties for the Subject Property: Kally
US, LLC, 214 12"' St W., Hastings, MN 55033; Reiter & Schiller, 25 N. Dale St., St. Paul, MN
55102; Craig Murphy, Epic Realty, 1922 l Ave S, #202, Anoka, MN 55303; US Bank National
Assoc Trustee/Co America's Servicing, 3476 Stateview Blvd, Fort Mill SC 29715; West
Seventh/Fort Road Federation.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated June 19, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subj ect Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by July 21, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolirion; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 23, 2008 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

41 interested or responsible parties to make the Subject Property safe and not detrimental to the
42 public peace, health, safety and welfare and remove its blighting influence on the community by
43 rehabilitating this structure in accordance with all applicable codes and ordinances, or in the
44 altemative by demolishing and removing the structure in accordance with all applicable codes
45 and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen
46 (15) days after the date of the Council Hearing; and

48 WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
49 January 21, 2009 and the testimony and evidence including the action taken by the Legislative
50 Hearing Officer was considered by the Council; now therefore

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 376 ERIE STREET.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subj ect to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, VacantlNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
fifteen (15) days after the date of the Council Hearing.
2. If the above conective action is not completed within this period of time Deparhnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
105 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
106 parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, single-family dwelling with a detached one-
stall garage on a lot of 4,792 squaze feet.
According to our files, it has been a vacant building since March 26, 2008.
The current property owner is Kally US, LLC, per AMANDA and Ramsey county property records.
The city has had to board this building to secure it from trespass.
There have been five (5) SUMMARY ABATEMENT NOTICES since 2008.
There has been one (1) WORK ORDER issued for:
- Boarding
On May 28, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on June 14, 2008 with a compliance date of July
21, 2008. As of this date this property remains in a condition which comprises a nuisance as defined
by the legislative code.
The Vacant Building registration fees are paid.
Tasation has placed an estimated market value of $40,800 on the land and $95,000 on the building.
As of July 24, 2008, a Code Compliance inspection has been completed.
As of July 9, 2008, the $5,000.00 performance bond has been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $70,000 to $80,000. The
estimated cost to Demolish is $10,500 to $14,500.
DSI, Division of Code Enforcement Resolution submitted far consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes the
Division of Code Enforcement to demolish and assess the costs to the property.

conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspecfion will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspecrion and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the reshictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance ar a Certificate of Occupancy has been issued.

wood frame garage.
1. T'he roof covering was replaced without a pernrit; unapproved flashing; roof
covering separating from the roof deck — west side.
2. There is no chimney liner seen.
3. There is cracked, missing, open stucco siding — exposed wood surface, interior
wall members exposed to weather.
4. The basement windows are boarded.
5. There is a broken boazded window on the east side.
6. There is missing stonn or screen windows.
7, There is chipped/peeling paint.
8. There is rot and rodent damaged eave.
9. The water service is off.
10. The gas service is locked off.
11. The rear deck has unapproved guard rail; steps lack hand rail.
12. There is chipped/peeling paint.
13. There is rot damaged or missing door trim or framing.
14. There is rot damaged roof decking.
15. There is no Certificate of Occupancy.
A Condemnation Report was prepared on March 24, 2008 by Fire Inspector, Sean Westenhofer

this property.-Salt and sand as needed.
4. SPLC 163.03,163.01 {2), (3) - Currently license (tabs) all vehicles on the property and
return the vehicles to an operarive mechanical condition or remove vehicles from the
property.-Blue Dodge Durango, License Plate* PEZ 064.
SPLC 34.23, MSFC 110.1 - This occupancy is condemned as unfit for human habitation.
This occupancy must not be used until re-inspected and approved by this office.
6. SPLC 3411 (6), 3434 (3) - Provide service of hearing facility by a licensed contractor
which must include a carbon monaxide test. Submit a completed copy of the Saint Paul
Fire Marshal's Existing Fuel Biiming Equipment Safety Test Report to this office.
7. SPLC 34.11(4), 34.34(1) SPC 4715.0200A - Provide an adequate water supply to all
water closets, sinks, showers and tubs.-W ater was shut-off on 3f20l08. House has been
winterized.
8. SPLC 39.02(c) - Complete and sign the provided smoke detector affidavit and return it
to this office.

Repair the structure to a habitable condition.
This structure is a registered vacant building that must have a Code Compliance
Certificate before the structure may be occupied. Obtain a Code Compliance
Certificate from the Department of Safety and Inspections. You may contact 7im
Seeger at D.S.I., 651-266-9016, for a code compliance inspection, permits, and
issuance of Code Compliance Certificate. Under Chapter 33.03 of the Saint Paul
Legislafive Code, failure to obtain a Code Compliance Certificate before
occupying the structure may result in issuance of criminal smnnlonses.
As owner, agent or responsible party, you aze hereby nofified that if these deficiencies and the
resulting nuisance condition is not corrected by July 21, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrarive costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial acrion, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection wiil idenfify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.

As an owner or responsible party, you are required by law to provide full and complete
disclosure ofthis "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer,.or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declazes it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. T'he departrnent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If correcfive action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what acrion if any, it deems appropriate.
If the resolution calls for abatement action the Council may eitYier order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Pau1 Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of tYus
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

BUILDING
1. Repair all damaged stucco (stucco permit required).
2. Replace all rotted rim joist at rear entry to code also replace steps or deck with
footings and inspectaons.
3. Replace roof covering and roof decking on garage with inspections.
4. Repair or replace basement windows.
5. Re-level and make porch floor sweepable.
6. Install guardrail and handrail to code for stairs to second floor.
7. Replace or re-support rotted support beams in baseinent.
8. Replace basement stairs.
9. Install provide hand and guardrails on all stairways and steps as per attachment.
10. Strap or support top of stair stringers.
11. Tuck point interiorfexterior foundation as needed.
12. Install floor covering in the bathroom and kitchen that is impervious to water.
13. Install tempered glass in window on stair landing at top of stairs at second floor.
14. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
15. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc as necessary.
16. Provide storms and screens complete and in good repair far all door and window
openings.
17. Repair walls and ceilings throughout as necessary.
18. Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards and
requires inspections.
19. Prepare and paint interior and exterior as necessary (take the necessary precautions if
lead base paint is present).

4. Ordering the owner to remove or repair the building(s) at 376 Erie Street within fifteen (15)
days from adoprion of resolution.
Jessica Williams representin� Kally US LLC, the property owner, appeared. No other parties of
ittterest appeazed.
Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling
with a detached one-stall gazage on a lot of 4,792 square feet and had been vacant since March 26,
2008. A code compliance inspection had been done on July 24, 2008, the vacant building
registration fees were current, and the $5,000 performance bond had been posted on July 9, 2008.
On May 28, 2008, 2008, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condition was developed. An order to abate a nuisance building was posted on
June 19, 2008 with a compliance date of 7uly 21, 2008. To date, the property remained in a
condition which comprised a nuisance as defined by the Legislative Code. Ramsey County
Taxation estimated the market value of the land to be approximately $4�,800 and the building to be
$95,000, Real estate taxes were cunent. Code Enforcement estimates the cost to repair the building
to be approximately $70,000 to $80,000. The cost for demolition was estimated to be
approximately $10,500 to $14,500. There had also been five summary abatements issued to this
property since 2008, one of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, and boarding. Mr. Magner stated that he had talked to
Ms. Williams the previous day and she anticipated the rehab should be completed within the next 30
to 60 days. He presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1889 and was a workers cottage-style building in the Schmidt Brewery neighborhood. She noted
that the exterior had been stuccoed; however, the upper windows had the original hoods and the
porch windows appeared to be early. She explained that this area was being considered for special
designation as the Schmidt Brewery neighborhood and she encouraged rehab of the building.
Ms. Williams stated that she believed approximately 75 percent of the work was completed and the
exterior wark, such as painting, would be done as weather permitted. She currently had the
property listed for rent beginning Februaxy 1 st and had scheduled a C of O inspection for the end of
January.
Mr. Magner stated that a certificate of code compliance with deficiencies could be issued by Mr.
Seeger to allow the time to paint the exterior of the building.
Ms. Moermond stated that she would recommend 180 days to complete the rehab of the property
provided the following is received by January 13: 1) a work plan outlining all wark that has already
been completed with a list of items, including a timelines, for the remaining items; and 2) financial
documentation. Ms. Moermond also encouraged Ms. Williams to come up with a plan for
landscaping the front of the yard to give the exterior of the property some curb appeal.
